Dear Mr. Long :
The Board of Appeals held a public hearing on Monday evening ,
September 19 1983 upon the application of Raymond and Beatrice
Canty. The h'eari_ng was advertised in the North Andover Citizen
on September 1 . and 8 , 1983 and all abutters were noti fed by
regular mail . The following members were present and voting :
Frank Serio, Jr . , Chairman ; Alfred E . Frizelle , Esq . , Vice-
Chairman ; Richard J . Trepanier , Esq . , Clerk ; Maurice .S . Foulds ;
and_ Walter. F . Soule .
The petitioner seeks a variance from the provisions of Section 7 ,
Paragraph 7 . 3 and Table 2 of the Zoning By Law to permit relief
from the side- an

Theetitioner an i
P d his attorney testified that a recently drawn
plot plan required by his bank revealed the violations . The
dwelling and the shed have existed on the premises for' several
years and it would involve a severe hardship to the petitioner
if the variance were denied and the structures had to be removed .
Upon a motion made by Mr . Trepanier and seconded by Mr. Frizelle ,
the Board voted unanimously to grant the variance as requested .
The Board finds that Section 10 . 4 of the Zoning By Law has been
satisfied. In particular , the Board finds that due to the exis -
tence of the structures on the lot for several years with their
deJ-:i-ations- from-:exist-ing zoning -requirements-= cons-t=it-utes a hard---
ship to the petitioner . as defined in the Zoning By Law .

maintain a rear porch without sufficient siddeline set back and ,to- maintain an out-
building without sufficient rear lot line set back.

The principal points upon which I base my application are as follows :
( Must be stated i n d e t a i l ) The rear porch of the premises and the -outbuilding
have been upon the premises of petitioners for a period of at least twenty-years.
While in the process of obtaining a new mortgage upon the premises, a survey and
plot plan showed that the porch and outbuilding did not meet the set back require-
ments of the zoning law. Failure to obtain a variance in this instance would cause
serious financial hardship to the petitioners in that they and unable_ to obtain a
mortgage upon the property; that the structures could not be removed without sub-
stantial cost and inconvenience; that since the structures have been upon the pre-
mises for so long a period of time, relief may be granted without derogating from
the intent and purpose of the by law and without harm to the neighborhood.

Sec. 1 APPLICATION FORM
Every application for action by the Board shall be made on a form-.,-
approved by the Board. These forms shall be furnished by the clerk
upon request . Any communication purporting .to be an application
shall be treated as mere notice of intention to seek relief until
such time as it is made on the official application form. All in-
formation- called for by the form shall be furnished by the applicant
in the manner therein presc-ribed.
Every application shall be submitted with a list of "Parties in
Interest" which list shall include the petitioner , abutters , owners
of land directly opposite on any public or Priv-ate street or way ,. !-
and abutters to the abutters within three hundred feet of the property
line of the petitioner as they appear on the most recent applicable
tax list , notwithstanding that the land of any such owner is located
in another city or town ,. the Planning Board of the city or town , and
the Planning Board of every . abutting city or town .
* Every application shall be submitted with an application charge cost
in the amount of $25 . 00 . In addition , the petitioner shall be respon-
sible for any and all costs involved in bringing the petition before
