The restoration report was submitted to this Department on May 2, 2000 by Leah Basbanes, Assoc. No restoration was proposed due to the current site conditions. Staff from this Department conducted a compliance inspection on May 2, 2000 and agree with the recommendation by Leah Basbanes and considered this the termination date, as it was the date this department considered the property in compliance with the Enforcement Order. The North Andover Conservation Commission(NACC) has levied a fine in accordance with Section 178.)0 of the North Andover Wetlands Protection Bylaw and M.G.L. CA, S.21D in the amount of$200/day. Each day or portion thereof during which a violation continues shall constitute a separate offense. The current total due to the town of North Andover is $2,800.00. I trust that this meets with your acceptance . I do believe the initial impact in this situation was extremely minimal . In fact I can see bottom grasses now growing that were not there before. Last evening my wife and I witnessed from the window a wild duck which visited the pond for a short while, an omen of good things to come. Andover, MA 01845 RE: 46 Shannon Lane As required by the Enforcement Order issued by your Commission to Mr. Paul Antinori on April 19, 2000, I have consulted with Mr. Antinori and inspected the Wetland Violation on the property at 46 Shannon Lane on April 25, 2000_ The violation consisted of removing with a backhoe approximately 4 buckets of soil material from a wetland resource area without an Order of Conditions. It is my estimation that less than a yard of material was removed from the wetland and placed on the embankment in the BVW. No stream bank was disturbed,no vegetation in the buffer zone was destroyed, nor were any soils altered in the BVW and buffer zone. The area from which the soil was removed is already re-establishing itself with aquatic grasses and sedges, apparently the thick leaf layer in this wetland area was inhibiting the herbaceous growth. Since there was no alteration of vegetation or soils in the buffer, and the removal of material from the wetland has actually spurred vegetative growth,I would strongly recommend not replacing the removed material in the wetland, but instead removing the excavated material from where it was placed and disposed of properly (outside the 100' buffer zone.) There is water f lowing into and out of this area . Replacing the soil and leaf material would likely cause a more serious water quality problem downstream. I also would not recommend any seeding in the area because vegetative growth is already occurring. It would be unnecessary to introduce non-indigenous species.
