It is at the edge of the yard and within 25' of the wetland.Do you recommend they file an RDA for removing that? Jennifer A. O i A O cocei .111' C . � `y QAOIV e G P�PP (y SS US CONSERVATION DEPARTMENT Community Development Division September 1, 2009 461 Summer Street North Andover, MA 01845 RE: Selective cutting of dead trees within the buffer zone of a wetland resource area Jennifer, This is a follow up letter pertaining to your request to remove trees within and adjacent to wetland resource areas at 461 SummerStreet.,On August 14, 2009, I met you on the property to review the location and condition of'several trees. Upon review of the site, it was determined that one tree, located within Bordering Vegetated Wetland (BVW), was leaning toward the pool and associated structures. Another tree immediately adjacent to the BVW was dead. A third tree, a red maple,was within the 25-foot no disturbance zone and had a few dead limbs, but otherwise appeared in good health. The Conservation Department will permit the removal of the tree within the wetland resource area and the dead one adjacent to the resource area to prevent possible injury or property damage. Cutting activities shall be limited to the two trees identified and photographed during our site inspection (photos attached). Any additional tree removal will require a filing with North Andover Conservation Commission pursuant to the Massachusetts Wetland Protection Act and the Town of North Andover Wetland Protection Bylaw. Information regarding filing procedures can be found on the town website, www.townofnorthandover.com, under the Conservation Department heading. The approved cutting will be subject to the following conditions: ❖ The tree removal contractor shall submit a detailed construction sequence to the Conservation Department, prior to starting any work, outlining how the tree within BVW will be accessed, what erosion control methods will be used to prevent erosion, and how the area will be restored following the proposed work. ❖ No additional vegetation shall be disturbed or removed without prior approval of the Conservation Department. •3 Please notify this department of the commencement of cutting activities in the event a complaint should be received. 1600 Osgood Street,North Andover,Massachusetts 01845 Phone 918.688.9530 Fax 918.688.9542 Web www.townofnorthandover.com ❖ All work, including stabilization efforts, shall be completed no later than October 15, 2009 to allow for appropriate stabilization of the disturbed areas before the end of the growing season. ❖ All tree limbs, brush, and other debris materials shall be taken off site and disposed of properly. •S Stumps shall be left in place. ❖ Upon completion of construction, all disturbed areas shall be properly stabilized per the stabilization plan. :• The applicant shall notify this department immediately following completion of work for a final site inspection. ❖ Pruning or limbing of additional trees, outside of the 25-foot No-Disturb Zone, may occur if the trees are accessible from the existing maintained yard.
