Michael Graf , Sanitation Inspector Town Hall North Andover , MA 01845 Dear Mr .- Graf: We live on the corner of Mark Road and Johnson Street and have two town storm drains abutting our property . When e . we moved in we immediately became aware of a very pungent odor emitting from' these drains. We have been told that this area has a high water table and with the high terraine, the results , we think, is that the ground is washing out the leaching fields into the catch_ basin- which flows down to Johnson Street , This is a ,very unhealthy condition. ' We also discovered that Mark Road is scheduled. .to be repaved :.,::this spring and thus is would be a9 ood time to correct this situation . We have submitted an article for the warrant for Town Meeting April 26 , 1986. Unfortunately , the Advisory Board is not supporting this article. At this time , they. do not think it is necessary to correct this unhealthy situation. We would appreciate your support and your expertise in_ helping. to resolve this problem. I will installthis system in ac- cordance with all the laws of the Commonwealth of Mhssachusetts and regulations of the Board of Health of the Town of North Andover. Further, I will construct the house sewer of bell and spigot pipe, the minimum diameter being 4 inches, and will maintain a minimum grade of 1J until 10 feet pre- ceding the septic tank, where the grade shall not exceed 2%. I will install a con- crete septic tank of 1goo gal, in size. A manhole (s) permitting easy cleaning will be provided with removable cover (s) of iron or concrete within 12 inches of the ground surface. I will provide subsurface disposal field with 4 inch perforated or open jointed pipe and laid in a series of trenches, the bottom of which will pro- vide a minimum of 2.00 lineal (sem) feet of effective absorption area. The pipes will be laid on a 6 inch layer of washed gravel or crushed stone ranging in size from 3/4 to 1-1/2 inches (dia.) and the pipes will be surrounded by similar material to a height of 2 inches above the crown of the pipe. The joints of these pipes will be protected from clogging and before filling the trench, 2 inches of gravel or stone 1/8" to 1/4P (dia. ) will be placed over the course gravel or stone. The disposal field will be installed at a grade of 4 to 6 inches/100 feet. No single tile line will exceed 100 feet in length and in any case, two lines of tile will be installed. A minimum of 6 feet will be maintained between the center lines of the disposal field trenches and the average depth of trench shall not exceed 36 inches. No part of the installation will be less than 100 feet from any private water supply, 25 feet from any stream, 20 feet from any dwelling or 10 feet from any property line. I further agree not to cover any portion of this installation until approved by the inspection officer, as provided below, and to incorporate any additional requirements that may be attached to the permit. When we moved in we immediately became aware of a very pungent odor emitting from these drains. We investigated the origin and have determined that it is sewage coming from the houses on the north side of. Prark Road . An underground stream located behind their homes causes water to pass through their leach- inF fields , which carries the sewage into the town storm drain system, which connects to and empties into the drains on the corner of Mark Road and Johnson Street. (see diagram) . This not only creates a public nuisance but also a public health prob7_em as well. There is no way that the people on Mark Road can prevent this from occurring, nor are they to blame , b,.it they do want to correct it, as evidenced by the signed warrant. The board of Health and the board of Public Works have been aware of this serious , unhealthy problem for years , but because of the lack of interest by the residents , have not corrected it. I personally called both boards and was told that the only way to correct this problem would be with town sewer. The sewer line only needs to be extended a short distance to reach Mark Road , which is itself a short dead end 0 U +, ualf of Q:l�e cost vi ;i18 p1--oJe0t wili be incurred by the residents when thej hook up to the line. Unfortunately our house will not be hooked up to the sewer , so it is evident that we are not acting in self interest, in the submission of this article . We also discovered that Mark Road is scheduled to be re paved this spring and thus this would be a very opportune time to have the sewer pipe laid , to correct this very serious prob- lem. We extend an invitation to every member of the advisory board to come to our house and smell the odor emitting from these drains, which can be smelled not only outside, but in our house as well and also by our neighbors in the area. Not only is the smell evident, but one can see the dark liquid pouring in from the pipes of Mark Road. We have submitted an article for the warrant for Town Meeting April 26 , 1986 . Unfortunately , the Advisory Board is not supporting this article . This sanitary waste was also. discharging into the storm drain system on Mark Road and Johnson Street, in violation of 310 CMR 15.02 (11) of the State Environmental Code. The Zoning :; Board of Ap- peals last night denied a vari- ance requested DiSalvo by Theodore •••Permit denied DiSalvo, 463 Johnson St., that would allow him to build a second house on his property, which is undersized for two houses under zoning. DiSalvo's wife Rita is daughter of McConaghy,who also works as a part-time builder in town. Neighbor Richard Foulds, 483 Johnson St., was one of several who complained about the project and its effect on the neighborhood. He charged at the meeting that the DiSalvos told him soon after they moved to Johnson Street near- ly two years ago, that they bought the property with an eye to make money and that McConaghy would build the second house there. DiSalvo said he could not re- member saying anything about this when he moved to Johnson Street. He also said his father-in-law . would not be building the house. After last night's unanimous denial, nobody can build there. The board decided that DiSalvo had not shown a real hardship that would justify granting a variance. His lawyer, John J. The landscaping of the property was designed to accommodate two lots. It is presently contemplated that sewerage will be available in the area and to take advantage of the sewerage without being able to divide the lots would constitute an economic hardship. The topography and shape of the land are not conducive to one lot, but more appropriately fit two lots. NELSON, DIRECTOR February 9, 1987 Mr. Frank Serio, Chairman Zoning Board of Appeals 120 Main Street North Andover, MA 01845 Re: DiSalvo Variance Request Dear Frank: We believe that this variance request should be denied because it does not meet the statuatory requirements of the North Andover Zoning Bylaw (Section 10.4) and Massachusetts GL (Chapter 40A Sec. 10) and further because it would create a bad precedent for future land use and zoning matters. The specific factors that we have considered in reaching this conclusion are as follows: (1) The proposed variance does not relate to the soil conditions, shape or topography of the lot; rather it relates to the size of the lot (i.e. , it is too small to comply with zoning!) (2) A variance is not the appropriate remedy for a general condition that exists in the zoning district; instead it must relate to a condition that is unique or special to that lot. In fact, any proposed undersized lot in the zoning district would share the same condition as the lot in question. (3) Personal hardship is not grounds for a variance. The hardship must relate to the physical character of the property. There have been numerous cases in Massachusetts law that have upheld this principle (Prusik vs. Board of Appeal of Boston, Blackman vs. Barnstable Board of Appeals, Dowd vs. Board of Appeals of Dover, etc.) (4) This variance is a "self created" one because the proposed undersized lot could have remained part of a conforming lot (Raia vs. Board of Appeals of North Reading) . (5) In our estimation, granting of this variance would be a substantial derogation of the intent of the N.A. zoning bylaw. The bylaw is very explicit about the lot size for an R--3 zone (25,000 sq. ft.) and does not mention any exceptions for special circumstances. Also, to the best of our knowledge, there are no undersized lots in the area; in fact, most lots exceed one acre. -2- We are sensitive to the high cost of housing in North Andover and appreciate the difficulties young couples face in affording a typical property. However, we do not feel that the granting of variances is the appropriate mechanism to solve this problem; rather we would be glad to work with the Appeals Board to draft some creative changes in the zoning bylaw (to be voted on at Town Meeting) that would address this issue.
