APPLICATION FOR SEWAGE DISPOSAL INSTALLATION
HEALTH DEPARTMENT--NC=RTH ANDOVER, MASS.
I hereby make application for a permit for a sewage disposal,
installation at Great Pond Road I will install this
system in accordance with all the laws of the Commonwealth of
Massachusetts and regulations of the Board of Health of the Town
of North Andover.
Further, I will construct the house sewer of bell and spigot
pipe, the minimum diameter being .4 inches, and will maintain a
minimum grade of 1% until 10 feet preceding the septic tank, where
the grade shall not exceed 2%. T will install a concrete septic
tank of 0 al. in size. A manhole (s) permitting easy clean-
ing will be prove d with removable cover (s) of iron or concrete
within 12 inches of the ground surface. I will provide subsurface
disposal field with open jointed bell and spigot Ackron pipe at
least 4 inches in diameter and laid in a series of trenches, the
bottom of which will provide a minimum of ,,,,, "e`p�p3es 120 „� Lineal

on a 6 inch layer of washed gravel or crushed stone ranging in
size from 3f4 to 1 1/2 inches (dia. ) and the pipes will be
surrounded by similar material to a height of 2 inches above the
crown of the pipe. The joints of these pipes will be protected
from clogging and before filling the trench, 2 inches of gravel
or stone 1/8" to 1/4a (dna. ) will be placed over the course gravel
or stone. The disposal field will be installed at a grade of 4
to 6 inches/100 feet. No single tile line will exceed 100 feet
in length and in any case, two lines of the will be installed.
A minimum of 6 feet will be maintained between the center lines of
the disposal field trenches and the average depth of trench shall
not exceed 36 inches. No part of the installation will be less
than 100 feet from any private water supply, 25 feet from any
stream, 20 feet from any dwelling or 10 feet from any property

T The soil in the area consisted of a powdery
clay. A percolation test of three minutes was conducted.

Dear Ms. Loughlin:
The Health Department has been supplied with a list of all residences, currently on septic,
which have access to the municipal sewer system. As previously published at a Public
Hearing on March 17, 1994, the Board of Health has adopted regulations concerning the
required sewer tie-in. The following timetable concerning your property status was
adopted:
4.1 All establishments that currently do not have municipal sewer available
to them must connect to the sewer as soon as it becomes available, with a
maximum time limit of six months.
The purpose of these regulations is to safeguard North Andover's drinking water, surface
waters, groundwater and surrounding environment. Sanitary sewer is believed to be the
most effective form of wastewater treatment. A copy of the entire regulation can be
obtained at our office.
Your property is in violation of this Board of Health regulation. Please contact the Health
Department regarding this matter immediately. If we do not hear from you by May 10,
2000 your name will be placed on the regularly scheduled Board of Health meeting agenda
and placed on public notice. The meeting will be held on May 25, 2000 for discussion of
legal action including court hearings.

Dear Ms. Bradshaw,
The North Andover Planning
Board held a public hearing on Tuesday evening April 21 1998 at
7:30 p.m. in the Department of Public Works, upon the application of Marie W. Loughlin, 465
Great Pond Road, North Andover, MA 01845 requesting a special permit under Section 4.136
watershed protection district of the North Andover Zoning Bylaw. The legal notice was properly
advertised in the North Andover Citizen on April 1 & April 8, 1998 and all parties of interest
were duly notified. The following members were resent: Richard Rowen Chairman Alison
Lescarbeau, Vice Chairman, Joseph V. Mahoney, and Alberto Angles, Associate Member.
The petitioner was requesting a special permit to obtain approval to construct 4 dwellings,
driveways, yards within the non-discharge zone of a wetland resource area in the watershed; To
install stormwater ponds and appurtances and to do regrading (vegetation removal) within the
non-disturbance and non-discharge zones; to regrade soil (vegetation removal) to create yards
(lots 4 & 5) within the non-disturbance zones.
The premises affected is land numbered 465 Great Pond Road in the Residential - 1 (R-1) Zoning
District and the Watershed Protection District.
The North Andover Planning Board held a regular meeting on May 19, 1998. The following
members were present: Richard Rowen, Chairman, Alison Lescarbeau, Vice Chairman, Joseph V.
Mahoney& Alberto Angles, Associate Member. Kathleen Bradley Colwell, Town Planner was
also present.

The North Andover Planning Board held a regular meeting on May 19, 1998. The following
members were present: Richard Rowen, Chairman, Alison Lescarbeau, Vice Chairman, Joseph
Mahoney, John Simons &Richard Nardella. Kathleen Bradley Colwell, Town Planner was also
present.
The Board discussed these Public Hearings together as they concern the same property. John
Morin of Neve Associates was present to represent Country Club Estates and 465 Great Pond
Road. Mr. Morin stated that the applicant does want to go forward with the proposed 4 lots.
Mr. Morin stated that he has responded to 15 of the 21 comments by Mr. Chessia. Mr. Morin
stated that one of the issues was the traffic and they are waiting for a response from Dermit
Kelley, traffic engineer. Mr. Rowen asked how long the road is. Mr. Morin stated that the road
is 750' long. Mr. Morin stated that a 22' wide road is required because they are in the watershed.
Mr. Mahoney asked if Mr. Chessia has seen the drainage plans. Mr. Morin stated yes, but he has
to go over a couple of comments. Mr. Rowen stated that at the last meeting the applicant stated
that they were taking drainage from Great Pond Road and treating it. Mr. Morin stated that they
were. Mr. Nardella asked where the catch basins were. Mr. Morin went over the location of the
catch basins on the plan with the Board. Mr. Rowen stated that he wants Mr. Morin to make it
clear to the applicant that the Board is not in favor of 4 lots.
Ms. Colwell stated that she needed to know whether the Board wants the island or not. The
Board agreed that they would like to see the island. Ms. Lescarbeau stated that the island could
be deeded to the homeowners. She will forward a sample deed to the Planning Department.
Continued until June 16, 1998.

The applicants requested a continuance until July 7, 1998.

Tom Neve of Neve Associates was present to represent Country Club Estates & 465 Great Pond
Estates. Ms. Colwell stated that the Board needs an extension to issue a decision. Mr. Neve
stated that he did not want to put any drainage on Great Pond Road. Mr. Chessia stated that he
would like them to do a test pit. Mr. Neve stated that they did do permeability tests and they are
at the lab and are waiting for results. Mr. Chessia stated that we don't want the water to stay
there. Jim Rand of D.P.W stated that the 22' pavement with an island will be a problem and
D.P.W. would like all catch basins within the pavement. Mr. Neve stated that they would like to
have an island and will take any comments from D.P.W. and Planning. Dermit Kelly of DJK
Associates stated that the speed limit changes frequently through the area. Mr. Kelly went over
the traffic study with the Board. Mr. Kelly stated that they would like to place extra speed limit
signs in the area. Mr. Neve stated that they need to cut back some brush at the entrance of the
road to see better. Ms. Lescarbeau asked if that is the applicants property. Mr. Neve stated yes.
Mr. Simons stated that it is in the right of way and that is the Town's property. Paul Hajec of
Hajec Associates stated that Dermit Kelly pretty much summed it up but, in his opinion would like
to change the location of the entrance of the road. Mr. Neve stated that we can't with respects to
drainage. Mr. Simons asked where the closest impact on the watershed is. Mr. Neve stated it is
about 150'. Mr. Neve stated that.he would like to close the Public Hearing and accept an
extension until August 31, 1998.
On a motion by Mr. Simons, seconded by Mr. Nardella, the Board voted unanimously to close the
Public Hearing and except an extension until August 31, 1998.
The North Andover Planning Board held a regular meeting on August 18, 1998. The following
members were present: Richard S. Rowen, Chairman, Alison Lescarbeau, Vice Chairman, John
Simons, Clerk, Joseph Mahoney, Richard Nardella& Alberto Angles, Associate Member .
Kathleen Bradley Colwell, Town Planner was also present.
On motion by Ms. Lescarbeau, seconded by Mr. Mahoney, the Board voted unanimously to
approve the watershed special permit decision for 465 Great Pond Road as amended.

Special Permit-Watershed Protection District
The Planning Board makes the following findings regarding the application of Marie W. Loughlin, 465
Great Pond Road, North Andover, dated March 18, 1998, requesting a Special Permit under Section
4.136 of the Zoning By-Law of the North Andover Zoning Bylaw to allow activities which cause a
change in topography and grade, vegetation removal, and surface and subsurface discharge of storm
water runoff within the Non-Disturbance Zone and surface and sub-surface discharge of stormwater
within the Non-Discharge Zone of the Watershed Protection District.
FINDINGS OF FACT:
In accordance with 4.136(4)the Planning Board makes the finding that the intent of the Bylaw, as well
as its specific criteria,are met. Specifically the Planning Board finds:
1. That as a result of the proposed construction in conjunction with other uses nearby, there will
not be any significant degradation of the quality or quantity of water in or entering Lake
Cochichewick. The Planning Board bases its findings on the following facts:
a) All of the homes will be connected to the Town sewer system;

c Nograding will occur within the 100 buffer zone;
d) No permanent structures will be built within the 150' non-disturbance.zone;
e) Storm water from driveways and dwellings are proposed to be captured and culverted
to storm water management ponds.
2. that there is no reasonable alternative location outside the Non-Discharge Buffer Zone for any
discharge, structure or activity, associated with the proposed driveway construction as the lot
is located within the Non-Discharge Zone.
In accordance with Section 10.31 of the North Andover Zoning Bylaw, the Planning Board makes the
following findings:
A. The specific site is an appropriate location for the proposed use as all feasible stormwater and
erosion controls have been placed on the site;
B. The use will not adversely affect the neighborhood as the lot is located in a residential zone;
C. There will be no nuisance or serious hazard to vehicles or pedestrians;

D. Adequate and appropriate facilities are provided for the proper operation of the proposed use;
E. The Planning Board also makes a specific finding that the use is in harmony with the general
purpose and intent of the North Andover Zoning Bylaw.
Upon reaching the above findings, the Planning Board approves this Special Permit based upon the
following conditions:

c) The Town Planner shall approve any changes made to these plans. Any changes
deemed substantial by the Town Planner would require a public hearing and
modification by the Planning Board.
2. Prior to any work on site:
a) Plan to be revised to show limit of work line on all lots and add erosion control as
necessary on Lot 4.
b) House on lot 4 to be rotated away from 150' line as much a minimum of 10"to allow
for construction of the home without disturbing the non-disturbance buffer zone.
c) The limit of clearing line on each lot must be marked in the field with yellow caution
tape and must be reviewed and approved by the Town Planner.
d) A performance guarantee of five thousand ($5,000) dollars in the form of a check
made out to the Town of North Andover must be posted to insure that construction

will take place in accordance with the plans and the conditions of this decision and to
ensure that the as-built plans will be submitted.
e) All erosion control measures as shown on the plan must be in place and reviewed by
the Town Planner.
fl The site shall have received all necessary permits and approvals from the North
Andover Conservation Commission, Board of Health, and the Department of Public
Works and be in compliance with the above permits and approvals.
3. Foundation Plan: Immediately upon completion of the dwelling foundation and prior to
further construction activities associated with the site, the applicant shall complete a plan
prepared by a Registered Professional Land Surveyor (R-P.L.S.) which accurately depicts the
foundation location and its proximity to wetland resource areas as shown on the approved
Watershed Special Plan. Said plan shall be submitted to the Town Planner for review to verify
that the setback limits under the special permit have been met.
4. Prior to release of the Performance Bond:
a) The applicant shall submit a certified copy of an as-built plan that shows all
construction, including topography, sewer lines, storm water mitigation trenches and
other pertinent site features. This as-built plan shall be submitted to the Town Planner
for approval and shall be stamped by either a Registered Professional Land Surveyor or
Practicing Engineer in Massachusetts.
b) The Planning Board must by a majority vote make a finding that the site is in
conformance with the approved plan.
5. Lawn Care: No pesticides, fertilizers, or chemicals shall be used in lawn care or
maintenance. This restriction shall apply and be binding on all current and future owners,
their heirs, administrators, successors and assigns, and shall be incorporated within all
subsequent deeds to the premises.
6. Any stockpiles of earth must be covered with a tarp and contained by hay bales and silt fence if
the piles are to remain on the site for longer than two weeks.
7. In no instance shall the applicant's proposed construction be allowed to fiufther impact the site
than asPro sed the plan referenced in Condition# 1.

8. No open burning shall be done except as is permitted during burning season under the Fire
Department regulations.

9. The Contractor shall contact Dig Safe at least 72 hours prior to commencing excavation.

Country Club Estates Definitive Subdivision
Conditional Approval
The Planning Board herein APPROVES the Definitive Subdivision for a five(5) lot subdivision
known as Country Club Estates. Thomas Neve for Marie W. Loughlin,465 Great Pond Road,North
Andover,MA 01845 submitted this application on March 18, 1998. The area affected is located off of
Great Pond Road in the R-1 Zoning District.
The Planning Board makes the following findings as required by the Rules and Regulations Governing
the Subdivision of Land:
A. The Definitive Plan,dated 3/6/98 includes all of the information indicated in Section 3 of the Rules
and Regulations concerning the procedure for the submission of plans.
B. The Definitive Plan adheres to all of the design standards as indicated in Section 7 of the Rules and
Regulations except as noted in Condition 16 Waivers.
C. The Definitive Plan is in conformance with the purpose and intent of the Subdivision Control Law.
D. The Definitive Plan complies with all of the review comments submitted by various town
departments in order to comply with state law,town by-laws and insure the public health, safety,
and welfare of the town.
Finally,the Planning Board finds that the Definitive Subdivision complies with Town Bylaw
requirements so long as the following conditions are complied with:
1) Environmental Monitor: The applicant shall designate an independent environmental monitor
who shall be chosen in consultant with the Planning Department. The Environmental Monitor
must be available upon four-(4)hour's notice to inspect the site with the Planning Board
designated official. The Environmental Monitor shall make weekly inspections of the project and
file monthly reports to the Planning Board throughout the duration of the project. The monthly
reports shall detail area of non-compliance, if any and actions taken to resolve these issues.
2) Prior to endorsement ofthe plans by the Planning Board the applicant shall adhere to the
following:
a) The following information must be submitted to the Town's engineering consultant for review
and approval:
i) Testing must be performed and the data submitted to support the permeability used in the
infiltration areas.
ii) A detail of the stone spillways for the detention basins must be submitted.

Hi) To mmimize impact to the water table in the watershedprotection district cellar floors and
foundations should be above the water table.
iv) The design of the detention basins should include an access route to and along the top for a
maintenance vehicle to access the outlet. This route should be enclosed in an easement and
identified on the plans.
V) The vertical curve must be adjusted to accommodate the k value of 30.
b) The dwelling on lot four should be rotated if possible away from the non-disturbance zone line.
c) A covenant must be placed on lots 3 and 4 regarding the maintenance of the landscaped cul-de-
sac island.A sample of the proposed language is attached.
d) The name of the street must be reviewed and approved by the E911 coordinator.
e) A Development Schedule must be submitted for signature by the Planning Board,which
conforms to Section 8.7 of the North Andover Zoning Bylaw. The schedule must show
building permit eligibility by quarter for all lots.
fl A Site Opening Bond in the amount of five thousand ($5,000) dollars to be held by the Town
ofNorth Andover. The Site Opening Bond shall be in the form of a check made out to the
Town ofNorth Andover that will be placed into an interest bearing escrow account. This
amount shall cover any contingencies that might affect the public welfare such as site-opening,
clearing,erosion control and performance of any other condition contained herein,prior to the
posting of the Roadway Bond as described in Condition 4(d). This Site Opening Bond may at
the discretion of the Planning Board be rolled over to cover other bonding considerations,be
released in full,or partially retained in accordance with the recommendation of the Planning
Staff as directed by a vote of the NAPB.
g) The final subdivision plans must be reviewed and approved by the outside consultant,the
Planning Department and D.P.W. All final comments from the DPW must be incorporated
into the plans.
h) A covenant(FORM I) securing all lots within the subdivision for the construction of ways and
municipal services must be submitted to the Planning Board. Said lots may be released from the
covenant upon posting of security as requested in Condition 4(d).
i) The applicant must submit to the Town Planner a FORM M for all utilities and easements
placed on the subdivision.
j) All application fees must be paid in full and verified by the Town Planner.

k) The applicant must meet with the Town Planner in order to ensure that the plans conform to
the Board's decision.A full set of final plans reflecting the changes outlined above,must be
submitted to the Town Planner for review endorsement by the Planning Board,within ninety
(90)days of filing the decision with the Town Clerk.
1) The Subdivision Decision for this project must appear on the mylars.
m) All documents shall be prepared at the expense of the applicant, as required by the Planning
Board Rules and Regulations Governing the Subdivision of Land.
3) Prior to ANY WORK on the site,
a) Yellow"Caution"tape must be placed along the limit of clearing as shown on the approved
plan. The Planning Staff must be contacted prior to any cutting and or clearing on site.
b) All erosion control measures as shown on the plan and outlined in the erosion control plan
must be in place and reviewed by the Town Planner.
4) Prior to any lots being released from the statutory covenants:
a) Three(3)complete copies of the endorsed and recorded subdivision plans and one(1) certified
copy of the following documents: recorded subdivision approval,recorded Covenant(FORM
I),recorded Growth Management Development Schedule,recorded maintenance agreement
for the landscaped cul-de-sac island, and recorded FORM M must be submitted to the Town
Planner as proof of recording.
b) All site erosion control measures required to protect off site properties from the effects of work
on the lot proposed to be released must be in place. The Town Planning Staff shall determine
whether the applicant has satisfied the requirements of this provision prior to each lot release
and shall report to the Planning Board prior to a vote to release said lot.
c) The applicant must submit a lot release FORM J to the Planning Board for signature.
d) A Performance Security in an amount to be determined by the Planning Board,upon the
recommendation of the Department of Public Works, shall be posted to ensure completion of
the work in accordance with the Plans approved as part of this conditional approval. The bond
must be in the form of a check made out to the Town of North Andover. This check will then
be placed in an interest bearing escrow account held by the Town. Items covered by the Bond
may include,but shall not be limited to:
i) as-built drawings
ii) sewers and utilities

1) roadway construction and maintenance
iv) lot and site erosion control
v) site screening and street trees
vi) drainage facilities
vii) site restoration
viii)final site cleanup
A Performance Security may be established for each phase individually.
5) Prior to a FORM U verification for an individual lot,the following information is required by the
Planning Department:
a) Additional speed limit signs particularly for eastbound travel must be installed at or prior to the
base of the vertical curve on Great Pond Road east of the site. The signs must be installed in
conjunction with the Police Department and DPW.
b) Brush within the Town ROW of Great Pond Road must be selectively cleared under the
direction of the Town Planner and DPW to provide adequate site distance while maintaining
the rural character of the roadway.
c) An as-built plan must be submitted to the Division of Public Works for review and approval
prior to acceptance of the sewer appurtenances for use.
d) If a sidewalk is to be constructed in front of the lot,then such sidewalk must be graded and
staked at a minimum
e) The applicant must submit a certified copy of the recorded FORM J referred to in Condition
4(c)above.
fl A plot plan for the lot in question must be submitted,which includes all of the following:
i) location of the structure,
ii) location of the driveways,
iii) location of the septic systems if applicable,
iv) location of all water and sewer lines,
v) location of wetlands and any site improvements required under a NACC order of
condition,
vi) any grading called for on the lot,
vii) all required zoning setbacks,
viu)Location of any drainage,utility and other easements.
g) All appropriate erosion control measures for the lot shall be in place.The Planning Board or
Staff shall make final determination of appropriate measures.

h) Lot numbers,visible from the roadways must be posted on all lots.
6) Prior to a Certificate of Occupancy being requested for an individual lot,the following shall be
required:
a) Sprinkler systems must be installed in all homes per NAFD requirements.
b) The roadway must be constructed to at least binder coat of pavement to properly access the lot
in question. Prior to construction of the binder coat,the applicant shall.ensure that all required
inspection and testing of water, sewer, and drainage facilities has been completed. The
applicant must submit to the Town Planner an interim as-built,certified by a professional
engineer,verifying that all utilities have been installed in accordance with the plans and profile
sheet.
c) All necessary permits and approvals for the lot in question shall be obtained from the North
Andover Board of Health,and Conservation Commission.
d) Permanent house numbers must be posted on dwellings and be visible from the road.
e) There shall be no driveways placed where stone bound monuments and/or catch basins are to
be set. It shall be the developer's responsibility to assure the proper placement of the driveways
regardless of whether individual lots are sold.The Planning Board requires any driveway to be
moved at the owner's expense if such driveway is at a catch basin or stone bound position.
7) Prior to the final release of security retained for the site by the Town,the following shall be
completed by the applicant:
a) The applicant is expected to make a contribution to the sidewalk Rind in amount equal to the
cost of constructing a sidewalk along one side of the roadway as determined by the DPW.
b) An as-built plan and profile of the site shall be submitted to the DPW and Planning Department
for review and approval.
c) The applicant shall petition Town Meeting for public acceptance of the street.Prior to
submitting a warrant for such petition the applicant shall review the subdivision and all
remaining work with the Town Planner and Department of Public Works. The Planning Board
shall hold a portion of the subdivision bond for continued maintenance and operations until
such time as Town Meeting has accepted(or rejected in favor of private ownership)the
roadways.It shall be the developer's responsibility to insure that all proper easements have been
recorded at the Registry of Deeds.
8). The Applicant shall ensure that all Planning, Conservation Commission,Board of Health and

Division of Public Works requirements are satisfied and that construction was in strict compliance
with all approved plans and conditions.
9) The Town Planner will review any signs utilized for this project. The applicant must obtain a sign
permit as required by Section 6 of the Bylaw. The Planning Board shall approve any entrance
structures. The applicant must remove any lighting used for the entrance signs prior to acceptance
of the subdivision.
10)The applicant shall adhere to the following requirements of the Fire Department
a) Open burning is allowed by permit only after consultation with the Fire Department.
b) Underground fuel storage will be allowed in conformance with the Town Bylaws and State
Statute and only with the review and approval of the Fire Department and Conservation
Commission.
11)There shall be no burying or dumping of construction material on site.
12)The location of any stump dumps on site must be pre-approved by the Planning Board.
13)The contractor shall contact Dig Safe at least 72 hours prior to commencing any excavation.
14)Gas,Telephone, Cable,and Electric utilities shall be installed as specified by the respective utility
companies.
15)Any action by a Town Board, Commission,or Department which requires changes in the roadway
alignment,placement of any easements or utilities,drainage facilities, grading or no cut lines,may
be subject to modification by the Planning Board.
16)The following waivers from the Rules and Regulations Governing the Subdivision of Land,North
Andover,Massachusetts,revised February, 1989 have been granted by the Planning Board:
a) Section 7(D)(1) Sidewalks: The Planning Board has determined that it is in the public interest
to waive this section as this subdivision is located within the watershed protection district. The
applicant will be expected to make a contribution to the sidewalk fund an amount equal to the
wa as determined b the DPW.

b) These waivers have been granted in an effort to minimize the amount of cutting and filling
required on site thereby decreasing the amount of erosion and siltation on site.
