Hedstrom, et als Dear Mr. Perna: The purpose of this letter is to request a meeting with the Planning Board on Thursday, September 21 , 1989 , in executive session, to discuss the above-noted matter. We also request that your legal counsel, Joel B. Bard, Esquire, be present to represent your interest. To focus the discussion and in compliance with the suggestion .of Karen H.P. Nelson, your Planning Director, I have set forth below 6 of the 7 reasons given in your Denial Decision, each followed by our current response to those° concerns . As you can see, Angus has satisfied each concern by obtaining the appropriate governmental approvals . The sole remaining specific reason for your denial, in essence, raised the validity of the 1987 Special Permit issued to Angus by the Zoning Board of Appeals . That matter is a principal issue in the Land Court litigation referred to above and represents, we .be.lieve,. the single remaining issue to -be resolved between the parties. we are hopeful a frank discussion with the Planning Board will lead to a prompt resolution of this entire case. SPECIFIC REASONS FOR DENIAL ( #2 through #7 ) Reason: 2 . A complete set of sewer plans were not submitted to DPW for review. The Board cannot determine if the proposed sewer design meets DPW standards due to lack of information. Response: 2 . A complete set of sewer plans have been submitted and approved by both Local and State DPW. Necessary street opening permits and sewer extension permits have been obtained, along with an Order of Conditions for the sewer project. Reason: 3 . Detail plans regarding the natural spring on-site have not been submitted to the DPW for review. The board finds that the potential adverse impact to the Lake due to inadequate design for the spring requires a more dtail and complete review. Response: 3 . Plans regarding the so-called natural spring on site have been submitted and reviewed to the satisfaction of the DPW. This matter was also reviewed and considered fully as part of the Conservation Commission public hearing process. The Conservation Commission has issued its Order of Conditions for the mall project. Reason: 4 . Conflict with the proposed drainage pipes from the site and a major water line which currently exists along Osgood Street has not been resolved to the satisfaction of the Board or DPW. Response: 4 . A re-routing .of the proposed drainage pipes from the site has eliminated any conflict with water lines in Osgood Street, all to the satisfaction of the DPW. I Reason: 5 . The applicant has altered a resource area along the rear property line in violation of the Wetlands Protection Act. The applicant shall be required to replace the wetland disturbed by 3 times as required by the act. The replacement area shall require the movement of the proposed structure and rear loading docks. A new site plan showing these changes should be submitted, which is in compliance with an Order of Conditions from the NACC. Response: 5 . All questions concerning the Wetlands Protection Act were taken up, .discussed at .length, and resolved in public hearings with the North Andover Conservation Commission. An Order of Conditions has been issued. Reason: 6 . An Environmental Impact Report as required by the state was not submitted concurrently with the application before us. The board requests that the MEPA process run concurrently with the Planning Board review in order to coordinate with state agencies which have jurisdiction with this project. Response: 6 . All processes related to an Environmental Impact Report have been completed and a satisfactory Certificate of the Secretary of Environmental Affairs on the Final Environmental Impact Report was issued August 2 , 1989 . Reason: 7 . Adetail Traffic Impact Report has not been submitted to the Board studying the current design of the access to the site. A traffic Impact Report submitted was for the original access drive, and the board requires anew Traffic Impact Report based upon the new access design. Response- ' 7 . A major focus of the environmental impact report was the traffic to be generated by this project. A detailed traffic impact report was included as part of the EIR process and found satisfactory for that purpose. We believe evidence of each of the above-noted responses is in your file, or available to you through the Conservation Commission. Should you need, for the meeting, any specific evidence to support our Responses, please let me know in advance of the meeting. We are hopeful the long and costly details in this project have come to an end. We sincerely request the full cooperation of the Planning Board in expediting the final procedural steps . The petitioner does mind if the petition is limited to a specific use. All of the glass used in the operation, will be brought intothe building through the front overhead doors and not the loading dock door. Mr. Serio asked what the petitioner thought about the .points covered in Mr. Stocking's letter? Could you abide by these rules if put into the decision? Mr. Caffrey stated that most of the points were agreeable, but feels that only two curb cuts are needed. When questioned regarding the billboard against the retain- ing wall, Mr. Caffrey said that it is leased and has approximately two more years on the lease. Mr. Caffrey was requested to bring in a copy of the lease covering the billboard, and also a plot plan, not a sketch as presented tonight. All of the points in Mr. Stocking's letter were gone over one by one. Petitioner asked by Board if they would agree to extension and return complete plans to Board before a decision is make? They agreed. Upon a motion made by Mr. Soule and seconded by Mr. Nickerson, the Board voted, unanimously, to continue this hearing until the February 9, 1988 meeting. (Serio, Nickerson, Soule, Vivenzio and O'Connor) . r ISCUSSIONVREQUEST Alan D. Solomont - Special Permit - Route 114 Attorney J. James, Jr. spoke about the changes in the petition for the nursing home on Route 114 which has been approved by the Board, increasing the parking spaces and eliminating one of the openings to Route 114 as requested. Originally had one driveway for service and one for main building, now only have one drive- way for both with a cul de sac. The old plans were compared with the new plans by the Board. The Board decided to wait until Mr. Dunlap, the architect to arrive so that further questions could be taken up. Upon the arrival of Mr. Dunlap, the plans were explained in detail, stating that all of the setback requirements are exactly as on original plans, the only change is that there are now 90 parking spaces as required and that it is limited to one entrance. Mr. Dunlap further stated that part of the parking area is over the leech field and the service area will be blocked from view by the new buildings. The plans have to go to the Fire Department for approval as a stipulation of the Board's decision. Upon a motion made by Ms. O'Connor and seconded by Mr. Nickerson, the Board voted to ACCEPT the changes in the plans subject to the approval of the North Andover Fire Department. EXTENSION REQUEST �.-e,.,,e...,,�e;_..,..T. ......o-...+rr..rR..,,.. !Angus- Realty Corp. - Special Permit"" 1077 Osgood Street Letter from Attorney Caffrey read by Mr. Nickerson, Clerk, as follows: "Please consider this letter an application for an extension, under Section 10.31 - 3 of the Zoning ByLaws, of a Special Permit granted September 24, 1985 to our above- noted client (Angus Realty Corp.) . Our request is based on the existence of good cause for the delay in construction. By condition 8 of the Board's decision, no construction could begin at the site until revised plans were submitted to and approved by the Board. This was done on February 10, 1987. Thereafter, on or about May 8, 1987, the Board signed the re- vised site plan and it was recorded(with a copy of the Board's decision) at the Registry of Deeds. Thus, May 8, 1987 became, for all practical purposes, the effective date of the Board's decision. A Y Y Page 3 Angus Realty Corp. (con'd) 'A further and fundamental requirement of the project is that it be connected to a sanitary sewer system. Access to the sewer system, for reasons beyond the control of Angus, did not develop when anticipated. An alternative route has been devised and is currently being engineered. Another obstacle, now overcome, was a lawsuit brought by an abuttor, in the Land Court. The abuttor claimed ownership by adverse possession of a substantial portion of Angus' land. If the abuttor had prevailedt, the location of the retaining wall (referred to in conditions 2 and 3 of the Special Permit) , as well as the siting of the building itself, would have been affected. The abuttor's suit directly affecte Angus' title because it was accompanied by a Notice of Lis Pendens recorded in the Registry of Deeds on March 18, 1986. A certified copy of the Judgement in favor of Angus was recorded in the Registry of Deeds on September 24, 1987. Other obstacles to construction, related to obtaining necessary governmental approvals for the project, also existed. Based on the foregoing good causes, we respectfully request the Board's Special Permit dated September 24, 1985(Petition No. 39-85) be extended one year to September 24, 1988. Signed: Thomas F. Upon a motion made by Mr. Vivenzio and seconded Soule, the Board voted to EXTEND-T' DECISION for oneyear, '.Septemberr24;''1988; as allowed by Section 10.31, Paragraph 3 of the Zoning ByLaws. (Serio, Nickerson, Soule, Vivenzio and O'Connor) On January 12, a letter from Bruce H. Clark, Asst Building Inspector was received by the Board and read at the meeting by Mr. Nickerson, Clerk, as follows: RE: Anthony Conte, 11-13 Third Street - "In granting the Special Permit for three (3) rental units, was it intended that the parking area and shrubbery planting be com- pleted prior to the issuance of a Building Permit as required on previous Special Permits? After a short discussion, the Board determined that the answer to this question is NO, unanimously. (Serio, Nickerson, Soule, Vivenzio and O'Connor) . On January 12, a letter from Bruce H. Clark, Ass't Building Inspector was received by the Board and read at the meeting by Mr. Nickerson, Clerk, as follows: RE: James Mavorkos, 88-90 Pleasant Street - "I viewed the parking area at 88-90 Pleasant Street at the owner James Mavrokos' request and I have the following concerns in relation to the decision and plans from the Board of Appeals. Telephone/utility pole in middle of entrance to parking area, curb, cut to street is not done; Turn-around at back of lot not existing, as shown on plan; apron removed and landscaped - unsure where and what is required for landscaping. In my opinion, he has not completely complied with the conditions set prior to issuing a Building Permit and I am looking for further input or review by the Board in determining if the condition has been met to its satisfaction." After a short discussion, the Board determined that the decision is clear. There is no pole shown on the plans presented to the Board. If a utility pole exists on the entrance to the main parking lot, then the plans should be revised or the pole removed. Plans have to be revised by the petitioner and presented to the Board!°their decision and to change the records. The Board decided that a letter should be sent to the Building Department stating the above information. Caffrey: Upon my meeting with Peter- Shaheen and Karen Nelson on Wednesday , February 24th , I have made the following conclusion regarding the applicable zoning Regulations which will be applied to the above cited project : Fact I The regulations in effect upon your original Special Permit submission to the Board of Appeals in 1985 will apply for a period of six (6) months after the Board of Appeals granted your- application. FACT II Your Special Permit from the Board of Appeals was officially granted as of February 10, 1987. However , due to the inpediments to pursuing the work allowed by the Special Permit , you were unable to obtain a Building Permit to begin construction . The impediments were ( 1 ) a law suit brought by an abutter in land court and , (2 ) unable to obtain a sewer connection with a private party as was required by the Board of Appeals Special Permit . Pertaining to impediment ( 1 ) cited above, the suit was settled and judgement filed with the Registry of Deeds Office on September- 24 , 1987. Pertaining to impediment (2 ) cited above , the sewer issue changed upon filing a Site Plan Review Special Permit with the Planning Board which shows a new sewer connection for this project which is different than the original route shown and granted by the Board of Appeals Special Permit [The determinations of fact made in this letter are consistant with the regulations found in f1.G.L . Chapter 40A, Section 6 and Section 10 .57 of the North Andover zoning Bylaw. ] =Page 2: Your Special Permit must now receive approvals by the Planning Board (Site Plan Review) , Conservation Commission (New Notice of Intent ) and the State DPW (curb--cut ) . All these actions and any other- applicable action which applies to this site must be obtained prior to being able to receive a Building Permit from the Town, This office finds that your six (6 ) month clock to obtain a Building Permit under the 1985 Bylaw will start upon your ability to legally obtain a Building Permit from the Town. Since then, a set of conditions was ordered by the Board of Appeals and since the project has taken some time, I suggested that the developers informally present the plans to each department head and provide each department with the list of thirteen items mandated by the Board of Appeals. On that same afternoon, I met with the architect at the fire station and reviewed the revised plan. The only change I requested was that a fire hydrant be placed on the site. This was agreed to. With that change, the petitioners have met the requests I made to your Board for site plan review on March 6, 1985. A copy of that letter is attached. The details relating to fire alarm and sprinkler installation will be addressed, as they are with all projects, as the project proceeds. At the April 22, 1985 meting the retaining wall was placed on the plan so as to not infringe upon the no cut area within 150 feet of the lake. In accordance with Massachusetts General Laws, Chapter 40A, Section 6, the Special Permit must be 'issued (prior to the first publication on the change proposed to the zoning ordinance) so as not to be effected by a change in the zoning ordinance or by4aw'.
