The following members were present and voting: Frank Serio, Jr. , Chairman, Augustine NIckerson, Clerk, Walter Soule and Raymond Vivenzio. The public hearing was advertised in the North Andover Citizen on March 24 and March 31, 1988 and all abutters were notified by regular mail. Upon a motion made by R. Vivenzio and seconded by W. Soule, the Board voted to ; DENY the variance as requested. The vote was unanimous. The Board finds that no hardship, as defined in Chapter 40A of the ByLaw, has been shown, and that the petitioner has not satisfied the provision of Section 10, Paragraph 10.4 of the Zoning Bylaws and the granting of this variance would derogate from the intent and purpose of the Zoning ByLaws. Other issues include adjacent properties which have similar lot split configurations which may pursue this kind of application in order to gain access from Marblehead Street ' It also appears the Board granted a similar request on Lots 16 and 171. one }ot away from this request , and across the street for Lots 8 and 9 ( se-- attached ) .
