The Board of Appeals held a regular meeting on April 12, 1988 and a Special meeting
on April 26, 1988 upon the application of William A. & Janet Lees, Jr. requesting
a variance from the requirements of Section 7, Paragraph 7.1, 7.2, 7.3, 7.4 and
Table 2 of the Zoning ByLaw so as to permit variation of dimentional requirements
to allow construction on a lot whose frontage was taken by the construction of
Route 495. The following members were present and voting: Frank Serio, Jr. ,
Chairman, Augustine NIckerson, Clerk, Walter Soule and Raymond Vivenzio.
The public hearing was advertised in the North Andover Citizen on March 24 and
March 31, 1988 and all abutters were notified by regular mail.
Upon a motion made by R. Vivenzio and seconded by W. Soule, the Board voted to
; DENY the variance as requested. The vote was unanimous.
The Board finds that no hardship, as defined in Chapter 40A of the ByLaw, has
been shown, and that the petitioner has not satisfied the provision of Section
10, Paragraph 10.4 of the Zoning Bylaws and the granting of this variance would
derogate from the intent and purpose of the Zoning ByLaws.

Gentlemen and Madam:
As a result of a site review, I have :found that the area in question
is heavily congested in its present state. Additionally, the proposal
would be detrimental to the abutter to have a 12 ft. roadway (easement)
or driveway running the length of his property to service the landlocked
! parcel in the rear. I recommend that this petition be denied.

the access to Dever- 1v Str(?e(; and crested a land locked lot .
Compensation was paid for the p) oi,:,erty taken for the I-495
right-of-way . Whether compensation was in the amount needed for the
entire value of Lot 2 ( since its vaiurm, is near zero since it has no
access ) is not known frdm the apnlicatinn.
The R-4 Zoning District allows duplexes by Iju] t, and no
proposal is submitted for a dwelling on Lot 2 . Other issues include
adjacent properties which have similar lot split configurations which
may pursue this kind of application in order to gain access from
Marblehead Street ' It also appears the Board granted a similar request
on Lots 16 and 171. one }ot away from this request , and across the street
for Lots 8 and 9 ( se-- attached ) .
Recommendatioris
Bhouid the 8oa/ d see fit to grant the variances ( six (6) total )
requested , staff recommends the following conditions be placed on the
approval :
� ( 1 ) The appIicant, file a maintenance and access agreement

for both lots to be placed on the Deeds of the lots
invo � ved '
(2 ) The B-oard requires singie family dwellings only on both
lots . Thi-I restriction shall be placed on the Deeds of
lots invlived .
(3 ) All setbacks called for in the Bylaw shall be met on any
structure placed on Lot 2 .
