It is as follows: Upon review of the site and associated site plans and supporting report entitled "Wireless Service Facility-Special Permit(s)and Variance Application Technical Review Package", the Conservation Department has determined that the proposed work is located greater than 100 feet from any jurisdictional wetland resource area. Therefore,said work is not subject to a filing with the North Andover Conservation Commission pursuant to the Massachusetts Wetlands Protection Act and the North Andover Wetlands Protection Bylaw. The closest wetland resource area to the proposed site activities (new utility pole)is approximately 130+feet away and is located across Peters street to the east of the project site. This resource area is a jurisdictional pond, officially named Becky's Pond. While proposed work remains outside of the 100 foot buffer zone of a wetland resource area, it should be noted however, that the wetlands information in the above referenced report is not correct. The report states that there are no wetlands within 300'of subject parcel and that the closest wetland resource area is located approximately 1,300 feet the northwest of the site. ("Nextel" "Applicant") proposes to construct and operate a Wireless Service Facility at 47 Peters Street (Map 24, Lot 59). The property is owned by the First United Methodist Church of North Andover. Nextel proposes to install twelve(12) panel antennas (Model# RFS/APXV86-906513-C) inside a replacement steeple. The replacement steeple will not exceed the height of the pre-existing steeple (sixty-seven (67') feet) and will be designed and constructed to match the existing church materials. The panels will be mounted behind stealth radio frequency-transparent screens painted to match the existing conditions. The center line for the antennas will be 44' + and 51' + (AGL). At each level, there will be three (3) sectors with two (2) antennas per sector for a total of six(6) antennas per level or twelve(12)antennas total. Each antenna weighs 26.4+ pounds and is approximately 53"x13"x5" (h/w/d). The radio frequency maximum power output will be: 806- 824MHz; 896-901 MHz(receiving)and 851-869MHz; 935-940MHz(transmitting). The antenna arrays in the steeple will be connected to anequipment shelter on the ground using 1 5/8" cables (Model: Andrew CDFS). The cables will be concealed behind a vertical cable tray on the northwesterly side of the Church. The exposed portion of the cable tray will be made of materials that will be compatible to the existing structure. Two (2) FCC mandated E911 global. positioning systems (GPS) antennas, approximately one (1) foot in height, will be flush-mounted to the proposed steeple at an approximate height of forty-seven (47')feet. Equipment associated with Nextel's WSF will be housed in an unmanned, concealed 240 sq. ft. equipment shelter located on a 12' by 20' concrete slab adjacent to the Church's west parking lot. It will be approximately 200 feet northeast of the church and 250 feet northwest of the utility pole to the north of Peters Street. No new access road will be constructed. The shelter will be pre- fabricated concrete with two(2)wall-mounted HVAC units. A six by ten (6'x10')concrete slab will be constructed next to the equipment shelter for an"emergency-use only"generator. The location of the proposed equipment building meets the dimensional requirements of fifty feet(50') side, rear and front lot line setbacks. The height restrictions for the Business(64)zone—sixty feet(60')and for a WSF—a height that does not increase the height of the pre-existing-structure- -are also satisfied. As indicated above and on the attached materials, I would submit that Nextel satisfies the following WSF and general zoning regulations 8.9. Nextel's WSF: 1. will have a minimal visual and environmental impact(§8.9,1(a)) 2. adheres to regulations adopted by the Town and other zoning and general bylaws under (§ 8.9.1(b)) 3. demonstrates a need(§8.9.3(a)(i)) (see attached radio-frequency affidavit); 4. meets(§8.9.3(a)and (c)) Use regulation 84 zone and WSF dimensional requirements; 5. is located on a preexistent structure and preserves the character and integrity of the structure(§8.9(b)(i) 6. is camouflaged (§8.9(b)(iii); 7. is legally feasible(§ 8.9(b)(iv)—(owner authorization provided); 8. meets(§8.9(c)height restrictions; it is no higher than 10' above the average height of buildings within 300 nor the height restrictions for a business (134)zoning district 9. satisfies building setback provisions for the B4 zoning district(§8.9(3)(v)(1)); 10. does not increase any non-conformity of the pre-existing structure(§8.9(3)(v)(2); 11. will satisfy Design standards(§8.9(4)(a)(i)(2); (iii); (iv)(2); (b)lighting and signage; 12. will satisfy Environmental Standards(§8.9(4)(e)and Safety Standards(§ 8.9(4)(f) 13. Regulations that are not applicable include§ 8.9: a. (4)(c) Historic Buildings b. (4)(d)Scenic Landscapes and Vistas To our knowledge, the only regulation that will not be satisfied through Nextel's proposed WSF application and therefore requires a variance is: 14. (ATC) has completed the Phase I Environmental Site Assessment (ESA) for the above-referenced Site pursuant to the scope and limitations of the Nextel Phase I Cell Site Scope of Work dated December 6, 2004. The purpose of this ESA was to identify any environmental conditions that may have impacted the Site. The following sections describe ATC's findings during the performance of this ESA. The following terms are used in this report: Site—the proposed or existing telecommunications compound,including both existing equipment and the equipment(i.e.,the equipment shelter,trenching,and icebridge)that is proposed. Nextel Parcel—the specific parcel of land that Nextel proposes to lease,license or purchase. Parent Parcel—the parcel of land that contains the Nextel Parcel and is considered to be adjacent for the purposes of this ESA. Brief Description of Subject Property The Site is located on portions of an approximately 6.1-acre lot developed with a church a residence multiplegarages/storage sheds and a h asphalt-paved spa paved parking and drive areas. Specifically,the Site consists of the church's steeple, the church's northeastern fagade, an approximately 240 square-foot landscaped area located on the central portion of the Parent Parcel and necessary trenches for utility lines. The Parent Parcel is currently occupied by the First United Methodist Church. According to the Town of North Andover Assessor's Office, the Parent Parcel is identified as Map 24, Block 59 and is owned by the First United Methodist Church. Brief Description of the Proposed Installation According to the plans provided by General Dynamics (East Elevation, North Elevation and Site Plan, Reliable Applied Wireless,LLC,March 21,2006),Nextel, on behalf of General Dynamics, is proposing to install a total of six (6) panel antennas, two (2) global positioning system (GPS) antennas, an approximately 240 square-foot equipment shelter, a pad-mounted generator, and associated utility lines. The six panel antennas will be mounted at an approximate height of 51 feet above ground level (agl) within the church's steeple. Proposed stealth radio frequency-transparent screen panels painted to match the existing church conditions will cover the six antennas. The two GPS antennas will be mounted on the church's steeple at an approximate height of 47 feet agl. Concealed utility lines will run from the proposed antennas to grade. The utility lines will then traverse the Parent Parcel's parking lot from southwest to northeast via underground conduit to the proposed equipment shelter to be located approximately 200 feet northeast of the church. Underground utility lines and associated conduit will also connect the equipment shelter to a utility pole located to the north of Peters Street and approximately 250 feet northwest of the proposed equipment shelter. No new access road will be constructed. ATC ASSOCIATES INC. 2 PROJECT NO.:60.26358.0047('Task 1) General Dynamics MA-2105-G Den Rock Park North Andover,Massachusetts May 8,2006 Records Review The earliest land use of the Parent Parcel, documented through a historical USGS topographic quadrangle dated 1955, appears to be residential. Based on an interview with Mr. Bob Cookson,representative of the First United Methodist Church,the Parent Parcel consisted of a residence and agricultural land prior to the construction of the church. The Parent Parcel has been occupied by the First United Methodist Church since 1968. The church was reportedly constructed in three phases between 1968 and 1993. The final stage of construction (1993) consisted of the steeple, which is associated with the proposed Site installations. Please refer to Section 8.1 for additional information regarding the interview with Mr. Cookson. Based on a review of available historic sources, the surrounding area appears to have been occupied by residences and commercial facilities from at least 1955 to present. Given the residential, agricultural and commercial use of the Site, Parent Parcel and surrounding area, the historical use of the Site area is not considered to represent an environmental concern to the Site. The Parent Parcel was not identified on the federal or state environmental regulatory databases searched for this assessment. A total of five (5) Resource Conservation and Recovery Act (RCRA)-Small Quantity Generator (SQG) listings, six (6) State Hazardous Waste Site listings, two (2) Underground Storage Tank (UST) listings, three (3)Leaking UST(LUST) listings,one (1)Dry Cleaners listing and fifteen(15)Release listings were identified on the federal and state agency databases within the specified search distances. Based on distance, presumed groundwater flow direction, current regulatory status, absence of reported violations, and/or the absence of reported releases, none of the facilities listed in the federal or state environmental regulatory databases are considered to represent a likely past, present or material threat of release to the Site. Based on review of the Interior Fish and Wildlife Service National Wetlands Inventory (NWI) Map, Site observations, and local government representative interviews, wetlands are not located on or within 300 feet of the Parent Parcel. Therefore, wetlands are not considered to be an environmental concern to the Site. Based on review of the Federal Emergency Management Agency(FEMA)Flood Insurance Rate Map, Site observations,and local government representative interviews,flood plains are not located on or within 300 feet of the Parent Parcel. Therefore,flood plains are not considered to be an environmental concern to the Site. Site Reconnaissance Lease exhibits provided by General Dynamics illustrate the power and telecommunication lines extending from the proposed antennas within the steeple to grade. The proposed antennas will be mounted within the steeple and the power and telecommunication lines will be concealed within the exterior wall of the church. Based on the construction date of the steeple portion of the church (1993), it is unlikely that asbestos-containing material(ACM) is present at the Site. However,ATC was not provided access to the steeple and was unable to observe the interior of the walls)that are involved in the proposed installations. Therefore,ACM is considered to represent an environmental concern to the Site at this time The steeple is painted with white paint,which appeared to be in good condition at the time of the Site visit. Based on the construction date of the steeple portion of the church (1993), it is unlikely that lead-based paint (LBP) is present at this portion of the Site. However, this area will be impacted during proposed installation activities. Therefore,LBP is considered an environmental concern to the Site at this time. The Site is located on portions of an approximately 6.1-acre lot developed with a residence, a church, multiple garages/storage sheds and asphalt-paved parking and drive areas. The Parent Parcel is currently occupied by the First United Methodist Church. Typically, the maximum depth of ground disturbance for equipment shelter foundations is approximately five feet below ground surface(bgs); the maximum depth of ground disturbance for the generator pad is approximately three feet bgs;and the maximum depth of ground disturbance for utility lines is approximately four feet bgs. The Nashoba Zone is comprised of Andover Granite, which consists of light to medium gray, foliated, medium to coarse-grained muscovite-biotite granite. Bedrock outcrops were not observed on-Site at the time of the Site reconnaissance. 3.2 Topography ATC reviewed the United States Geological Survey (USGS) 7.5 Minute Series Topographic Lawrence, Massachusetts quadrangle, dated 1987, for the elevation of the Site. Based on the USGS Lawrence,Massachusetts quadrangle,the Site is located approximately 210 feet above mean sea level. The topography of the site generally slopes to the west towards an unnamed tributary of the Shawsheen River,located approximately 3,600 feet from the Site. Please refer to Appendix A,Figure 1. 3.3 Hydrogeology Information obtained from the State Database Well Information (SDWI) database included in the Environmental Data Resources Inc. (EDR) Report indicates that no identified groundwater wells are located within one mile of the Site. Based on the topography of the Site and the surrounding area, groundwater flow is expected to travel to the west towards an unnamed tributary of the Shawsheen River, located approximately 3,600 feet from the Site. Depth to groundwater at the Site is unknown. The actual depth to groundwater and groundwater flow direction at the Site can be accurately determined only by installing groundwater monitoring wells, which was beyond the scope of this project. 3.4 Wetlands Maps A review of the U.S. Department of the Interior Fish and Wildlife Service National NWI map, Lawrence,Massachusetts,revealed no designated wetland areas on the Site;therefore,wetlands are not considered to be an environmental concern. The closest wetlands to the Site are isolated and located approximately 1,300 feet northwest of the Site. A copy of the NWI wetland map is included in Appendix E. 3.5 Federal Flood Insurance Maps A review of the FEMA Flood Insurance Rate Map (FIRM),Community Panel Number 250098 0006 C, revealed that the Site is not located within the 100-year or 500-year flood zones; therefore, flood zones are not considered to be an environmental concern. The closest flood zone to the Site is located approximately 2,500 feet northwest of the Site and is associated with the Shawsheen River. A copy of the FIRM is included in Appendix E. Therefore, watercourses are not considered to be an environmental concern to the Site. 3.7 Endangered Species or Habitats A review of the Massachusetts Natural Heritage Atlas 11`h Edition dated July 1, 2003 revealed that no endangered species or habitats are located within 300 feet of the Site. Therefore, endangered species and/or habitats are not considered to be an environmental concern to the Site. No aerial coverage for the Site was available for review. ATC reviewed a 1995 aerial photograph available through Terraserver. The review of the 1995 aerial photograph revealed that the Site and Parent Parcel were similar in use to that which was observed during the Site visit. The review of aerial photograph did not identify past uses indicating environmental concern at the Site or surrounding area. A copy of the 1995 aerial photograph is included in Appendix C. 5.2 Fire Insurance Maps A search for fire insurance maps for the Parent Parcel and surrounding area was conducted by EDR. No fire insurance map coverage for the Site was available for review. A copy of the No Coverage Letter is included in Appendix E. 5.3 Historical Topographic Maps ATC reviewed historical USGS topographic quadrangles provided by EDR for information regarding past uses of the Site and surrounding area. Quadrangles dated 1955, 1966 and 1979 were available for review. All three maps depict a residence at the Parent Parcel. The surrounding area is depicted with gradually increasing development over time of commercial and/or residential properties. The review of historic USGS topographic quadrangle did not identify past uses indicating an environmental concern associated with the Site and surrounding area. Copies of the USGS topographic quadrangle maps are included in Appendix E. 5A City Directories Research regarding the availability of historical city directories was conducted by EDR. Directories dated 1961 to 2005 were reviewed in approximately five-year increments. The Parent Parcel address was first listed in 1972 as a residence. This use continued through 2005. The First United Methodist Church was identified at 57 Peters Street on directories dated from 1977 through 2005. The surrounding properties were occupied by commercial and residential structures on directories dated from 1961 to 2005. The review of city directories did not identify past uses indicating an environmental concern associated with the Site and surrounding area. A copy of the city directories is included in Appendix E. ATC also interviewed various Town of North Andover government representatives for information regarding ardin the Site and Parent Parcel. Information obtained during these interviews may be found in pertinent sections of this report 8.2 Office of Zoning ATC reviewed available zoning/land use records for information regarding uses of the Site. According to the Town of North Andover Zoning Map,the Site is zoned as General Business District. 8.3 Fire Department ATC requested a review of available fire department records at the Town of North Andover Fire Department, Fire Prevention Office. The Town of North Andover Fire Department, Fire Prevention Office did not report the use or storage of hazardous materials, including USTs or above-ground storage tanks(ASTs),at the Parent Parcel. 8.4 Building Inspector ATC reviewed available building department records at the Town of North Andover Building Department. Based on review of these records, the steeple portion of the church was constructed in 1993. Record of the original church construction (reportedly in 1968) was not observed. No additional environmentally pertinent files are on record for the Parent Parcel. 8.5 Health Department ATC reviewed available health department records at the Town of North Andover Health Department. No environmentally pertinent files are on record for the Parent Parcel. 8.6 Conservation Commission ATC requested a review of available records at the Town of North Andover Conservation Commission. No environmentally pertinent files are on record for the Parent Parcel. ATC ASSOCIATES INC. 14 PROJECT NO.:60.26358.0047(Task 1) General Dynamics MA-2105-G Den Rock Park North Andover,Massachusetts May 8,2006 9.0 SITE RECONNAISSANCE 9.1 Methodology and Limiting Conditions The Site reconnaissance consisted of a walk-through of the proposed Site and Parent Parcel (see Appendix A for a copy of the lease exhibits). As noted,the Site is located within and shares the same address as a parcel of land that is developed with a church, a residence,multiple garages/storage sheds and associated asphalt-paved parking and drive areas, which are considered adjacent to and distinct from the Site for the purposes of this assessment. A walk along the perimeter of the Parent Parcel and a walk along the immediate Site area were conducted during the Site inspection. At the time of the Site visit,the weather was approximately 60 degrees Fahrenheit and clear. 9.2 General Site Setting The Site is located on portions of an approximately 6.1-acre lot developed with a church, a residence, multiple garages/storage sheds and associated asphalt-paved parking and drive areas. Specifically,the Site consists of the church's steeple, the church's northeastern fagade, an approximately 240 square- foot landscaped area located on the central portion of the Parent Parcel and necessary trenches for utility lines. The Parent Parcel is currently occupied by the First United Methodist Church. The surrounding area is generally occupied by properties of residential and commercial use. 9.3 Site Reconnaissance The Site reconnaissance was conducted by Mr. Jason M. Roback, Project Manager of ATC, on April 18, 2006. ATC was accompanied by Mr. Bob Cookson, representative of the First United Methodist Church. The following is a summary of visual and/or physical observations of the Site and on the day of the Site visit. Photographs can be found in Appendix A. 9.4 Hazardous Substances Used or Stored On-Site ATC did not observe the use or storage of hazardous substances at the Site. 9.5 Petroleum Products Used or Stored On-Site ATC did not observe the use or storage of petroleum products used or stored on the Site. 9.6 Unidentified Hazardous Materials Containers ATC did not observe the presence of unidentified substance containers on the Site. 9.7 Aboveground and Underground Storage Tanks i I ATC did not observe evidence of ASTs or USTs at the Site. Stormwater from the Site building is expected to flow into gutters that discharge to paved areas of the Parent Parcel. Given the observed conditions,stormwater at the Parent Parcel is not considered a concern at this time. 9.14 Waste Water ATC did not observe evidence of the generation,storage or disposal of waste water on the Site. 9.15 Wells ATC did not observe evidence of wells on the Site or Parent Parcel. 9.16 Other Conditions A limited visual survey was conducted during the Site visit to evaluate the possible presence and condition of suspect asbestos-containing debris/materials and lead-containing paint, if present at the lease area. Please note that this survey addressed only areas present at the proposed Site area(s). Lease exhibits provided by General Dynamics illustrate the power and telecommunication lines extending from the proposed antennas on the steeple to grade. The proposed antennas will be mounted on the steeple and the power and telecommunication lines will be concealed within the exterior wall of the church. Based on the construction date of the steeple portion of the church(1993), it is unlikely that ACM is present at the Site. However,ATC was not provided access to the steeple and was unable to observe the interior of the wall(s) that are involved in the proposed installations. Therefore, ACM is considered to represent an environmental concern to the Site at this time. ATC recommends that an asbestos survey be conducted at the Site prior to any disturbance. The steeple is painted with white paint,which appeared to be in good condition at the time of the Site visit. Based on the construction date of the steeple portion of the church (1993), it is unlikely that lead-based paint (LBP) is present at this portion of the Site. However, this area will be impacted during proposed installation activities.
