MINUTES
July 27,2000
Mr. Osgood called the meeting to order at 7:00 p.m.
MEMBERS PRESENT:
Gayton Osgood, Chairman, Francis P. MacMillan, M.D., Member, Sandra Starr, Health
Director
TOBACCO REGULATIONS FOR NORTH ANDOVER PUBLIC SCHOOLS
Diane Pickles and Angel Santana from Healthy Communities outlined to the Board the
procedure they would like the Town to adopt. The regulation that is being presented is to
issue non-criminal tickets to the students who are caught smoking on school grounds.
The school committee has approved this policy. The ultimate goal is to eliminate smoking
on school property. Susan Nicholson, Principal of the North Andover High School and
Lou Rusty, Principal of the North Andover Middle School would be deputized by the
Board of Health to be able to issue fines to anyone caught smoking on school grounds.
The goal is not to fine but to get the children into services. A first offense, they can pay
the $100.00 fine or opt to go to six hours of tobacco education. The schools will provide
the services. A second offense they would have to pay the fine and the tobacco education
is mandated. Teachers will not be fined under this policy. The Board would like the
papers to receive this information to let the public know there is a regulation for smoking
on school grounds. Mr. Osgood would like Ms. Pickles to call the Youth Center and
speak to Rick Gorman and see if there is any kind of program the two can come up with
to put together a tobacco education program at the Youth Center.
On a motion by Dr. MacMillan, seconded by Mr. Osgood the Board voted to accept
as an amendment to the Town of North Andover Tobacco Regulations for North
Andover Public Schools and the Board also deputized Susan Nicholson, Principal of
the High School and Lou Rusty, Principal of the Middle School as agents of this
Board for the purpose of issuing non-criminal tickets for smoking relating issues on
school grounds.
DEPUTIZE ANGEL SANTANA OF HEALTHY COMMUNITIES
Angel is a representative of Healthy Communities. He will be issuing non-criminal tickets
to establishments that sell cigarettes to under age children. Angel will also be educating
the establishments. Diane Pickles would like a resident list to send out a survey to the

residents of North Andover about smoking in restaurants. Ms. Starr will supply the list
for Ms. Pickles.
On a motion by Dr. MacMillan, seconded by Mr. Osgood the Board voted to
deputize Angel Santana as an agent of the Board of Health for Healthy
Communities to issue non-criminal tickets.
49 SALEM STREET
The owners are requesting a waiver to Title 5. The owners are selling their house and the
new owners will tie-in to sewer. The Board agreed to sign the waiver and grant the
extension.
475 GREAT POND ROAD.
s.Starr read the DPW's response to sewer tie-in for Nass is impossible to
provide Mr. Nassar a gravity connection to the left side o 4 e ouse. It appears that it is
possible to serve the house by gravity by installing pipe on the right side of the house, then
along the back of the house to the sewer tank. A sewer stump was installed during the
phase two-sewer project in this location for this purpose. A gravity connection is
preferred to a pump system therefore; I recommend the gravity option. The Board would
Re Mr. Nassar to tie-in to sewer by the end of the year, if not then the Board would like
Mr. Nassar to appear before the Board. Dr. MacMillan would like a letter to be sent to
Mr.Nassar on the Boards decision.
179 MAIN STREET
Mr. Willis did comply with the complaint. Ms. Ford recommended that Mr. Willis buy a
copy of the state sanitary code for human habitation. Ms. Ford did receive a very nice
letter from the tenant's family.

On a motion by Dr. MacMillan, seconded by Mr. Osgood, the Board voted to accept
the minutes of June 22, 2000.

Bill,
T'lus memo is regarding the next BOH meeting to be held on Thursday,May 25,
2000 in the lower level conference room of the Town Hall. Your presence could
greatly assist the Board with a couple of the agenda items. In attendance will be
residents who have issues with the Health Department Regulations requiring
mandatory hook-up to the municipal sewer lines. These are mostly residents that
have had sewer available for quite sometime and have not complied with the Health
Departments regulation.
One person in particular has a problem which he directly blames on the North
t�ndover DPW and specifically Buddy Cyr. His name is Mr. Nasser of 475 Great
Pond Road. You may already have heard of his problem. He has told the Board
members that he feels that it is the DPW's responsibility to run his personal sewer
line. This is because many years ago, Buddy Cyr told him where his stub would be
and he ran a line under his driveway. Now the plans find that to utilize this existing
line he would have to pump to it because it is not where he was told it would be. He
insists that because he followed the direction of the Town once already,the town
should pay for it.
Mr. Nasser came before us over two years ago and still has not tied into sewer. The
Board would like to bring all of the parties together in hopes to reach a resolution.
The Health Department would greatly appreciate your input. Please let me know if
you can attend. Thanks.

I am writing in reply to a letter which I received from the
Office of Community Development and Services dated March 24, 2000.
On April 25, 2000, I, Henry Nassar, had a phone conversation
with Susan Contarino. This letter is being sent to the Health
Department because of her recommendation. The letter which I
received, informed me that there is going to be a board of
health meeting on May 25, 2000 regarding the physical tie-in
to the existing sewer system. I will be present at the meeting,
as I was at the previous three or four meetings that I was asked
to attend. The only thing that I ask is that the minutes of the
previous three or four meetings be available to the board
members , so that they will be familiar with the concerns that
were discussed at that time.

Dear Mr.Nassar:
As we discussed, I met with Buddy Watson to discuss the different options for connecting your house to town
sewer. Four options were discussed as follows.
Option 1:
Install a gravity sewer line from the stub along the right side of the house, around the back to the septic tank.
Option 2:
Install a grinder pump at the end of the dry sewer line, to the left of the driveway near the street. Install a force
main across the driveway, along the front yard,to the stub at the right side of the house.
Option 3:
Install a grinder pump at the same location as Option 2. Install a force main in the shoulder of the road.
Option 4:
Install a grinder pump in the same location as Option 2. Install a force main up the middle of the road.
You should consult with your contractor, JW Watson, and decide which option to take.

I have been informed by the Town Manager that you would like a letter stating that the Board of Health wants you
to tie-in to the municipal sewer. I have enclosed the relevant portion of the recent minutes of the Board of Health
meeting on December 14,2000,The relevant portion of the minutes of the Board of Health meeting of July,27,
2000,a copy of the letter sent to you in March of 2000,and a copy of the letter sent to you in August of 1996.
Each one states that you must tie-in to municipal sewer.
As indicated by the comments of the December 2000 meeting,you must connect to the town's municipal sewer by
May of 2001. In addition,a signed contract with a contractor,including a start date,is required by the Board to be
submitted to this office as soon as possible. To make it easier for you,please have all the paperwork into this office
by February 20,2001,no later. Generally outside work begins in March of most years,so this date is timely. It is
also prior to the Board of Health meeting so that the Board can be apprised of the status of the project.
As far as the engineering goes,I have spoken with your chosen contractor,Buddy Watson,and he is aware of the
options you have. I look forward to receiving your paperwork.

Mr. Osgood called the meeting to order at 7:10 p.m.
MEMBERS PRESENT:

Ms. Starr spoke regarding Mr. Nassar, the homeowner at 475 Great Pond Road. Mr.
Nassar informed Ms. Starr that it will cost him$30,000 to tie-in to sewer. His first quote
was for $6000. He would like some help from the Board. After discussion it was stated
that an extension had actually been given because sewers are not built during the winter
because of the weather. In effect, Mr. Nassar has an extension until May 2001. The Board
determined that Mr. Nassar must pull the sewer permit, get a signed contract for the work
and a start date and submit copies of the paperwork to the Health Department as soon as
possible.
SEWER TIE-INFIXED INCOME AND GENERAL WAIVER
Ms. Starr recommended granting the elderly who are on fixed incomes a general waiver
for a time extension for sewer tie-in as long as they file a deed restriction saying that on
transfer of the property the house will be tied into municipal sewer. The deed restriction
must be on file with the Health Department. The Board agreed to that recommendation.
POLICE—AIR QUALITY
Ms. Starr gave the Board an outline of conditions at the Police Station. The report
consists of Ms. Starr's report when she went to the Police Station. She also included
several documents from air quality books about air pollution irritants. The Police
Department did an air quality study around two years ago and very high carbon dioxide
levels were found. Personnel also present the same symptoms that indicate a sick building,
colds, sinus infections, headaches, frequent coughs, stinging eyes, etc. There is no
ventilation in the building; everything is sealed up. Housekeeping is at a minimum,
cleaning of toilets, dusting, vacuuming, etc. After a short discussion the Board agreed
that a letter should be written to the Town Manager demanding that something be done.

residents of North Andover about smoking in restaurants. Ms. Starr will supply the list
for Ms. Pickles.
On a motion by Dr. MacMillan, seconded by Mr. Osgood the Board voted to
deputize Angel Santana as an agent of the Board of Health for Healthy
Communities to issue non-criminal tickets.
49 SALEM STREET
The owners are requesting a waiver to Title 5. The owners are selling their house and the
new owners will tie-in to sewer. The Board agreed to sign the waiver and grant the
extension.
475 GREAT POND ROAD
Ms. Starr read the DPW's response to sewer tie-in.for Mr. Nassar: `-It is impossible to
provide Mr. Nassar a gravity connection to the left side of the house. It appears that it is
possible to serve the house by gravity by installing pipe on the right side of the house, then
along the back of the house to the sewer tank. A sewer stump was installed during the
phase two-sewer project in this location for this purpose. A gravity connection is
preferred to a pump system therefore;I recommend the gravity option. The Board would
lice Mr. Nassar to tie-in to sewer by the end of the year, ifnot then the Board would like
Mr. Nassar to appear before the Board. Dr. MacMillan would like a letter to be sent to
Mr.Nassar on the Boards decision.

Mr. Willis did comply with the complaint. Ms. Ford recommended that Mr. Willis buy a
copy of the state sanitary code for human habitation. Ms. Ford did receive a very nice
letter from the tenants family.

The Health Department has been supplied with a list of allresidences, currently on septic,
which have access to the municipal sewer system As previously published at a Public
Hearing on March 17, 1994, the Board of Health has adopted regulations concerning the
required sewer tie-in. The following timetable concerning your property status was
adopted:
4.1 All establishments that currently do not have municipal sewer available
to them most connect to the sewer as soon as it becomes available, with a
maximum time limit of six months.
The purpose of these regulations is to safeguard North Andover's drinking water, surface
waters, groundwater and surrounding environment. Sanitary sewer is believed to be the
most effective form of wastewater treatment. A copy of the entire regulation can be
obtained at our office.
Your property is in violation of this Board of Health regulation. Please contact the Health
Department regarding this matter immediately. If we do not hear from you by May 10,
2000 your name will be placed on the regularly scheduled Board of Health meeting agenda
and placed on public notice. The meeting will be held on May 25, 2000 for discussion of
legal action including court hearings.

way in and he hired Andover Construction - Andover Construction suggested to hire The Boai
Buddy Watkins to run pipes to sewer, and at the end of drive-way put a temporary hot to recomme
where they were to tie-in. Mr. Nassau stated that then he got notification that that is not
where the tie-in will be and that it was going to be 40 or 50 feet up the street. Mr. Nasser ;The Boar

correct. Mr. Nassar stated that he spent $7,500 to run it underneath the driveway for
hook-up.
Osgood asked, "it can't be tied in where it is now"? Mr. Nassar stated right, they tell
e it can't be, that it has to be pumped to the top of the hill.

Osgood asked Ms. Starr if she knew what was going on. Ms. Starr stated, "no, but
e will talk with Bill Hmurciak". Mr. Osgood suggested that Mr. Nassar meet with Bill

Ms. Starr spoke regarding Mr. Nassar, the homeowner at 475 Great Pond Road. Mr.
Nassar informed Ms. Starr that it will cost him$30,000 to tie-in to sewer. His first quote
was for $6000. He would like some help from the Board. After discussion it was stated
that an extension had actually been given because sewers are not built during the winter
because of the weather. In effect, Mr. Nassar has an extension until May 2001. The Board
determined that Mr. Nassar must pull the sewer permit, get a signed contract for the work
and a start date and submit copies of the paperwork to the Health Department as soon as
possible.
SEWER TIE-INFIXED INCOME AND GENERAL WAIVER
Ms. Starr recommended granting the elderly who are on fixed incomes a general waiver
for a time extension for sewer tie-in as long as they file a deed restriction saying that on
transfer of the property the house will be tied into municipal sewer. The deed restriction
must be on file with the Health Department. The Board agreed to that recommendation.
POLICE—AIR QUALITY
Ms. Starr gave the Board an outline of conditions_ at the Police Station. The report
consists of Ms. Starr's report when she went to the Police Station. She also included
several documents from air quality books about air pollution irritants. The Police
Department did an air quality study around two years ago and very high carbon dioxide
levels were found. Personnel also present the same symptoms that indicate a sick building,
colds, sinus infections, headaches, frequent coughs, stinging eyes, etc. There is no
ventilation in the building; everything is sealed up. Housekeeping is at a minimum,
cleaning of toilets, dusting, vacuuming, etc. After a short discussion the Board agreed
that a letter should be written to the Town Manager demanding that something be done.

deputize Angel Santana as an agent of the Board of Health for Healthy

The owners are requesting a waiver to Title 5. The owners are selling their house and the
new owners will tie-in to sewer. The Board agreed to sign the waiver and grant the
extension.

Ms. Starr read the DPW's response to sewer tie-in for Mr. Nassar: "It is impossible to
provide Mr. Nassar a gravity connection to the left side of the house. It appears that it is
possible to serve the house by gravity by installing pipe on the right side of the house, then
along the back of the house to the sewer tank. A sewer stump was installed during the
phase two-sewer project in this location for this purpose. A gravity connection is
preferred to a pump system therefore;I recommend the gravity option.4' The Board would
like Mr. Nassar to tie-in to sewer by the end of the year, if not then the Board would like
Mr. Nassar to appear before the Board. Dr. MacMillan would like a letter to be sent to
Mr.Nassar on the Boards decision.

Mr. Willis did comply with the complaint. Ms. Ford recommended that Mr. Willis buy a
copy of the state sanitary code for human habitation. Ms. Ford did receive a very nice
letter from the tenant's family.

The Health Department has been supplied with a list of all residences, currently on septic,
which have access to the municipal sewer system. As previously published at a Public
Hearing on March 17, 1994, the Board of Health has adopted regulations concerning the
required sewer tie-in. The following timetable concerning your property status was
adopted:
4.1 All establishments that currently do not have municipal sewer available
to them must connect to the sewer as soon as it becomes available, with a
maximum time limit of six months.
The purpose of these regulations is to safeguard North Andover's drinking water, surface
waters, groundwater and surrounding environment. Sanitary sewer is believed to be the
most effective form of wastewater treatment. A copy of the entire regulation can be
obtained at our office.
Your property is in violation of this Board of Health regulation. Please contact the Health
Department regarding this matter immediately. If we do not hear from you by May 10,
2000 your name will be placed on the regularly scheduled Board of Health meeting agenda
and placed on public notice. The meeting will be held on May 25, 2000 for discussion of
legal action including court hearings.

I have been informed by the Town Manager that you would like a letter stating that the Board of Health wants you
to tie-in to the municipal sewer. I have enclosed the relevant portion of the recent minutes of the Board of Health
meeting on December 14,2000,The relevant portion of the minutes of the Board of Health meeting of July,27,
2000,a copy of the letter sent to you in March of 2000,and a copy of the letter sent to you in August of 1996.
Each one states that you must tie-in to municipal sewer.
As indicated by the comments of the December 2000 meeting,you must connect to the town's municipal sewer by
May of 2001. In addition,a signed contract with a contractor,including a start date,is required by the Board to be
submitted to this office as soon as possible. To make it easier for you,please have all the paperwork into this office

Mark, It, indeed, sounds familiar. He's been repeating this for the last five years. The Board had Bill Hmurciak in to a
meeting when Mr. Nassar was there and it was discussed. Bill pointed out that the person who had purportedly given him
this information was long dead, and that at that time there were no existing plans for the sewer. However, Bill agreed to
look at all engineering possibilities for the site. He did this and presented Mr. Nassar two options: he could use the line
that was installed several years ago and pump up to the sewer or he could have a gravity system that would result in a
line being put in around the back of the house and to the side and thence to the sewer. The Board felt these were
sufficient options and told Mr. Nassar to choose one and connect. The-Board of Health's jurisdiction extends only to the
actual connection. Mr. Nassar has attended several Board meetings through the years and been given extension after
extension. The Board is concerned with public health, and with.475 Great Pond Road being not tied-in it is being
jeopardized. As far as documentation, Mr. Nassar apparently didn't even have the conversation himself. A contractor
(Harry Nargosian, I think) reported that this was the information HE had gotten from Buddy Cyr. Everything was verbal.
Besides, the Board of Health couldn't do much about what anyone did or didn't say; the regulation was promulgated to
protect public health and that's still the overriding goal. Frankly, neither I, nor the Board, nor Bill Hmurciak can think of
anything else to do. It's Mr. Nassar's option as to how he ties-in. It's the Board's jurisdiction to determine when, and
DPW can only issue him a permit when he applies. I will certainly tell Mr. Nassar about the deed restriction for the
elderly-we speak rather often, although I can't say we're chummy. I've spoken to his contractor who also can't
understand why he just won't do it. Another clarifying letter to Mr. Nassar is, perhaps, in order. Thanks.

Sandy, in my discussions with Mr. Nassar, I don't believe that he is objecting to tying in to the sewer, but rather how
and where he ties in. He is of the opinion that some years back, when he was replacing his septic system he inquired
to 'someone' in the dpw as to where the eventual sewer line would be located. Based on the information he received,
he had the septic installer put a sewer connection pipe from his house to where he thought the main sewer line was
going. Since that time he was informed that the sewer line was not going to be where he allegedly had already been
told and now he has to eat the cost of the pipe he previously put in and the cost for the new connection. Does this
sound familiar? If it does, maybe we can ask him to doucment who he talked to those many years ago and provide
some evidence to that effect. If he can't document it then I think we are in are rights to enforce the BOH regulations.
On a related matter, in my conversation with him he refered to a "little old lady"down the road who wasn't being
required to hook up. Based on my readings of your minutes, you may want to explain to him the elderly exemption
and deed restriction the BOH has instituted so that he understands the full picture.

I understand that Mr. Nassar contacted you about his"problem". Briefly, the Board of Health adopted a
sewer tie-in regulation in 1994 that anyone with access to municipal sewer, particularly in the Watershed, must
tie-in within a certain time limit. In 1996 Mr. Nassar and some others were given a nine month extension. All the
others have tied-in; Mr. Nassar has not. The Board discussed the situation at their last meeting (Please see
attached draft of minutes.)and determined that time is up. The Board does not care how it's done as long as it's

legal; they just want the house connected to the sewer. Mr. Nassar's home is in a very sensitive area of the
watershed.

I am writing in reply to a letter which I received from the
Office of Community Development and Services dated March 24, 2000.
On April 25, 2000, I, Henry Nassar, had a phone conversation
with Susan Contarino. This letter is being sent to the Health
Department because of her recommendation. The letter which I
received, informed me that there is going to be a board of
health meeting on May 25, 2000 regarding the physical tie-in
to the existing sewer system. I will be present at the meeting,
as I was at the previous three or four meetings that I was asked
to attend. The only thing that I ask is that the minutes of the
previous three or four meetings be available to the board
members , so that they will be familiar with the concerns that
were discussed at that time.,

STREET).
2. IT APPEARS THAT IS POSSIBLE TO SERVE THE HOUSE BY GRAVITY BY INSTALLING PIPE
ON THE RIGHT SIDE OF THE HOUSE, THEN ALONG THE BACK OF THE HOUSE TO THE
SEPTIC TANK. A SEWER STUB WAS INSTALLED, DURING THE PHASE II SEWER
PROJECT, IN THIS LOCATION FOR THIS PURPOSE.
3. A GRAVITY CONNECTION IS PREFERRED TO A PUMP SYSTEM, THEREFORE I
RECOMMEND THAT THE GRAVITY OPTION BE PURSUED.

I hereby make application for a permit for a sewage disposal installation at
Great Pond Road . I will install this system in ac-
cordance with all the laws of the Commonwealth of Massachusetts and regulations of
the Board of Health of the Town of North Andover.
Further, I will construct the house sewer of bell and spigot pipe, the minimum
diameter being 4 inches, and will maintain a minimum grade of 1% until 10 feet pre-
ceding the septic tank, where the grade shall not exceed 2%. I will install a con-
crete septic tank of 750 gal. in size. A manhole (s) permitting easy cleaning
will be provided with removable cover (s) of iron or concrete within 12 inches of
the ground surface. I will provide subsurface disposal field with 4 inch perforated
`r open jointed pipe and laid in a series of trenches, the bottom of which will pro-
vide a minimum of 900 lineal O feet of effective absorption area.
The pipes will be laid on a 6 inch layer of washed gravel or crushed stone ranging
in size from 3/4 to 1-1/2 inches (dia.) and the pipes will be surrounded by similar
material to a height of 2 inches above the crown of the pipe. The joints of these
pipes will be protected from clogging and before filling the trench, 2 inches of
gravel or stone 1/8" to 1/0 (dia. ) will be placed over the course gravel or stone.
The disposal field will be installed at a grade of 4 to 6 inches/100 feet. No single
tile line will exceed 100 feet in length and in any case, two lines of tile will be
installed. A minimum of 6 feet will be maintained between the center lines of the
disposal field trenches and the average depth of trench shall not exceed 36 inches.
No part of the installation will be less than 100 feet from any private water supply,
25 feet from any stream, 20 feet from any dwelling or 10 feet from any property line. _{
I further agree not to cover any12ortion of this installation until approved by the
inspection officer, as provided below, and to incorporate any additional requirements

I talked with Mr. Nasser today and explained the situation to him. I think he is resolved to the necessity of hooking up to
the sewer system. I told him he had two options, one to use his existing sewer connection line but to install a pump and
the other to go through his back yard and install a gravity line. He requested that the Town send him a letter that would
1) inform him of the Board of Health determination that he had to hook up and 2)what his engineering options would be
to allow that connection. To that end, could you (Sandy& Bill H.)jointly send him a letter that would address those two
matters with a copy tome. I also explained to him the elderly-deed restriction matter to him, so there is no need to
discuss that in the letter. Many thanks, I think were close to putting this one to bed.

Mark, It, indeed, sounds familiar. He's been repeating this for the last five years. The Board had Bill Hmurciak in to
a meeting when Mr. Nassar was there and it was discussed. Bill pointed out that the person who had purportedly
given him this information was long dead, and that at that time there were no existing plans for the sewer. However,
Bill agreed to look at all engineering possibilities for the site. He did this and presented Mr. Nassar two options: he
could use the line that was installed several years ago and pump up to the sewer or he could have a gravity system
that would result in a line being put in around the back of the house and to the side and thence to the sewer. The
Board felt these were sufficient options and told Mr. Nassar to choose one and connect. The Board of Health's
jurisdiction extends only to the actual connection. Mr. Nassar has attended several Board meetings through the
years and been given extension after extension. The Board is concerned with public health, and with 475 Great
Pond Road being not tied-in it is being jeopardized. As far as documentation, Mr. Nassar apparently didn't even
have the conversation himself. A contractor(Harry Nargosian, I think) reported that this was the information HE had
gotten from Buddy Cyr. Everything was verbal. Besides, the Board of Health couldn't do much about what anyone
did or didn't say;the regulation was promulgated to protect public health and that's still the overriding goal. Frankly,
neither I, nor the Board, nor Bill Hmurciak can think of anything else to do. It's Mr. Nassar's option as to how he ties-
in. It's the Board's jurisdiction to determine when, and DPW can only issue him a permit when he applies. I will
certainly tell Mr. Nassar about the deed restriction for the elderly-we speak rather often, although I can't say we're
chummy. I've spoken to his contractor who also can't understand why he just won't do it. Another clarifying letter to
Mr. Nassar is, perhaps, in order. Thanks.

Sandy, in my discussions with Mr. Nassar, I don't believe that he is objecting to tying in to the sewer, but rather
how and where he ties in. He is of the opinion that some years back, when he was replacing his septic system he
inquired to 'someone' in the dpw as to where the eventual sewer line would be located. Based on the information
he received, he had the septic installer put a sewer connection pipe from his house to where he thought the main
sewer line was going. Since that time he was informed that the sewer line was not going to be where he
allegedly had already been told and now he has to eat the cost of the pipe he previously put in and the cost for
the new connection. Does this sound familiar? If it does, maybe we can ask him to doucment who he talked to
those many years ago and provide some evidence to that effect. If he can't document it then I think we are in
are rights to enforce the BOH regulations.
On a related matter, in my conversation with him he refered to a "little old lady"down the road who wasn't being
required to hook up. Based on my readings of your minutes, you may want to explain to him the elderly

exemption and deed restriction the BOH has instituted so that he understands the full picture.

I understand that Mr. Nassar contacted you about his"problem". Briefly, the Board of Health adopted a
sewer tie-in regulation in 1994 that anyone with access to municipal sewer, particularly in the Watershed,
must tie-in within a certain time limit. In 1996 Mr. Nassar and some others were given a nine month
extension. All the others have tied-in; Mr. Nassar has not. The Board discussed the situation at their last
meeting(Please see attached draft of minutes.)and determined that time is up. The Board does not care
how it's done as long as it's legal; they just want the house connected to the sewer. Mr. Nassar's home is in
a very sensitive area of the watershed.
