The Board of Appeals held a public hearing on September 11, 1990 on the application
of Edward & Gayle Nieburger requesting a variation from the requirements of Section 4,
Paragraph 4.121 of the Zoning Bylaw so as to permit relief from side yard setback
for construction of a family dwelling on the premises located at 476 Great Pond Road.
The following members were present and voting: Frank Serio, Jr. , Chairman, William
Sullivan, Vice-chairman, Raymond Vivenzio, Anna O'Connor and Louis Rissin.
The hearing was advertised in the North Andover Citizen on August 29, 1990 and
September 5, 1990 and all abutters were notified by regular mail.
Upon a motion made by Mr. Vivenzio and seconded by Ms. O'Connor, the Board voted,
unanimously, to GRANT the variance as requested subject to the following conditions:
1. That the proposed new dwelling be connected to the sewer system
before an occupancy permit is issued.
2. The dwelling on Lot 5B be connected to the sewer system within
two(2) years of system being installed on Great Pond Road.
The Board finds that the petitioner has satisfied the provisions of Section 10,
Paragraph 10.4 of the Zoning Bylaw and the granting of this variance will not
derogate from the intent and purpose of the Zoning Bylaw nor will it adversely
affect the neighborhood.

As you know, the Board of Appeals has granted a variance
for land at 476 Great Pond Road
Since twenty (20) days have elapsed without an appeal of this de-
cision being filed, your plan has been endorsed by the Board.
This plan, along with a certified copy of the Board' s decision , must
be recorded at the North Essex Registry of Deeds as soon as possible .
Please pick up your plan at the Board of Appeals office at your
earliest convenience. The certified copy of the decision may be
obtained from the Town Clerk .
