District Dear Mr. Long: The Nc_'_rth Andover Planning Beard held a public hearing on September 1.5, 1992, in the Town Building, Selectmen's Meeting Room upon the application of Edward and Gayle Nieburger,2 Sterling Street,Andover, MA,requesting a Special Permit. The hearing was duly advertised in the Lawrence Eagle Tribune on August 31, 1992 and September 7, 1992 and all parties of interest were properly notified. The following members were present: George Perna, Chairman,John Simons, Clerk, John Draper,Joseph Mahoney,Richard Nardella and Richard Rowen, Associate Member. The petitioner was requesting a Special Permit under Section 4.136,Paragraphs 2(b)and 5(b) of the North Andover Zoning Bylaw. The purpose of the Special Permit is for regrading and construction within the Non-disturbance and Non-discharge buffer zones of the Lake Cochichewick Watershed District. The premise affected is located at 476 Great Pond Road, in a Residential 1 (R-1) Zoning District and within the Watershed Protection District. John Simons read the legal notice to open the public hearing. A letter was read from the D.P.W. and David Zaloga, Agent for Coolidge Construction. Richard.Nardellaq uestioned when the sewer would be available in the area.. George Perna stated that there was no contract at the present time. Mr. Perna asked if there was a response for the Board of Health. No response has been received to date. Phil Christiansen, Christian & Sergi, stated that Lot 5 was subdivided. There is a cottage on Lot 6. The applicants would like to renovate that cottage and use the existing septic system for one year. If the sewer does not come up to the property at that time the applicant will tie into the sewer down the road at their cost. 476 Great Pond Road Page 2: Phil Christiansen stated that the Board of Health would not sign off on the Form U. A bond of $5,000 was suggested. Karen H.P. Nelson, Director of Planning & Community Development is to check with D.P.W. on the bonding figure. A draft decision was given to the Board. George Perna stated that if the problems can be resolved between the Board of Health and the applicant, he did not see any problems with the Planning Board. John Simons stated that the Board of Health should review the septic system because of the proximity to the Lake. He would. like feedback from the Board of Health. Phil Christiansen stated that the Board of Health would like the Planning Board to make a decision. An easement for the sewer will be put on the plans. A motion was made by Joseph Mahoney to close the public hearing and approve the decision as discussed. The motion was seconded. by John Draper and voted unanimously by those present. John Simons would like to review the decision before filing. Attached are those conditions. EDWARD AND GAYLE NIEBURGER 476 GREAT POND ROAD LOT 6 SPECIAL PERMIT FOR REGRADING WITHIN THE WATERSHED PROTECTION DISTRICT. ZONING BYLAW, SECTION 4.136 FINDINGS OF FACT• The Planning Board makes the following findings regarding this Special Permit as required by section 4 . 136 of the Zoning Bylaws: 1. The proposed use and site design for this lot are appropriate, due to its location in Town. 2 . Adequate vehicular and pedestrian access into the surrounding site has been provided. 3 . The applicant has met the requirements of the Town for a Special Permit as stated in Section 4 . 136 of the Zoning Bylaw. 4 . Adequate and appropriate facilities will be provided for the proper operation of the proposed use. 5. This application for construction within the Watershed Protection District, Section 4 . 136 of the North Andover Zoning Bylaw, was specifically granted for regrading within the Non-disturbance Zone to Lake Cochichewick. The Planning Board has determined that the regrading and sewer improvements associated with this Special Permit will reduce the potential for contamination to the Town's drinking water supply. The Planning Board finds under Section 4 . 136 of the Zoning Bylaw that the proposed site plan generally complies with the Town Bylaw requirements but requires minor conditions in order to be completely in compliance with Town Bylaws. Upon reaching the above findings, the Planning Board approves this Special Permit based upon the following conditions: SPECIAL CONDITIONS: 1. This decision shall be filed with the North Essex Registry of Deeds. Included as part of this decision are the following plans: Plans entitled: Site Plan of Land in North Andover, Mass. Gas, Telephone, Cable and Electric utilities shall be installed as specified by the respective utility companies. 5. No open burning shall be done except as is permitted during burning season under the Fire Department regulations. 6. No underground fuel storage shall be installed except as may be allowed by Town Regulations. 7. Prior to a Certificate of Occupancy being issued for any structures, this site shall have received all necessary permits and approvals from the North Andover Board of Health. (See letter dated 9/25/92) 8. The provisions of this conditional approval shall apply to and be binding upon the applicant, its employees and all successors and assigns in interest or control. 9. Any alteration to the approved plans as referenced in condition one (1) shall be submitted to the Planning Board as a modification to this approval. 10. The applicant shall be required to tie into the existing sewer system located within Great Pond Road. The existing Municipal Sewer System is located approximately 480 ' Southwest of the property within the Great Pond Road Right of Way. 11. Prior to the issuance of a Building Permit the applicant shall be required to provide or conform to the following: A. The Division of Public Works shall review and approve the 'proposed sewer line tie-in; B. The applicant shall receive a written determination from the Conservation Administrator that all work being done under the jurisdiction of the Conservation Commission is being satisfactorily performed and maintained. C. All catch basins shall be protected and maintained with hay bales to prevent siltation into the drain lines during construction. 12. Prior to a Certificate of Occupancy being issued for the proposed structure the applicant shall provide or complete the following: A. Construction of the proposed sewer line connection as reviewed and approved by the Division of Public Works; B. The applicant shall receive a written determination from the Conservation Administrator that all work being done under the jurisdiction of the Conservation Commission is being satisfactorily performed and maintained. C. BOARD OF HEALTH O p It 120 MAIN STREET TEL. 682-6483 �9SS�CHUSE��y NORTH ANDOVER, MASS. 01845 Ext. 32 MEMORANDUM TO: Karen Nelson J FROM: Sandy Starr RE: 476 Great Pond Road DATE: September 25, 1992 Earlier today I visited this site in order to meet with Dave Zaloga and inspect the "septic system" that is purported to exist on the property. When I arrived only builders were present on the lot. I found two small excavated holes in the back yard of the cottage over the cover of a tank in which there was water, possibly of ground water origin, and the end of the tank where a length of Orangeburg pipe protruded. The end of the pipe was not in evidence. I measured from the edge of the second hole over the pipe to the edge of a wet area near the brook in the back of the property. It measured 451 . Without further excavation, there is no way to tell whether there is a leaching area or not. If there is, it is much too close to the brook and, I believe, is actually in the wetlands. I do not feel that it would be in the best interests of the Lake or the Town of North Andover if the Board of Health were to approve this system for use. If an entirely new septic disposal system cannot be installed to the front of the property, then I feel the owners should be required to tie-in to the municipal sewer system before this house is occupied. cc: R. When I arrived only builders were present on the lot. I found two small excavated holes in the back yard of the cottage over the cover of a tank in which there was water, possibly of ground water origin, and the end of the tank where a length of Orangeburg pipe protruded. The end of the pipe was not in evidence. I measured from the edge of the second hole over the pipe to the edge of a wet area near the brook in the back of the property. It measured 451 . Without further excavation, there is no way to tell whether there is a leaching area or not. If there is, it is much too close to the brook and, I believe, is actually in the wetlands. I do not feel that it would be in the best interests of the Lake or the Town of North Andover if the Board of Health were to approve this system for use. If an entirely new septic disposal system cannot be installed to the front of the property, then I feel the owners should be required to tie-in to the municipal sewer system before this house is occupied. cc: R. This delay has created permit difficulties and in turn financial difficulties. It has taken seven years of delays and postlonements to get to this point. Therefore , we ask ,you to consider the following; proposal: 1) Approve the modifications as shown in the ApF,lication. 2) Allow the signing of the Form U by Planning and by the Health Dept. 3) Allow the use of the existing septic system for a 12 month period beginning from the issue date on the Building/Remodeling Permit. 4) Allow the installation of the approved pumping station and allow the lh" forced main to read-end at the 476 (ir-at Pond Road property line. 5) .Retain a $5,000 surity to insure a curinection to the proposed or the existing gravity sewer. 6) In the event the proposed gravity sewer is delayed further, for more than the stated 12 month jeriod, .,!e will extend the 1Y'2" forced main along tcie shoulder and into the existing sewer in Great Pond Road. Permission to uo this has been granted by the Sewer Dept. (see accompaning letter) 7) Release the surity in total upon the connection of the forced main to the town sewer. This application will require a Special Permit from the Planning Board for regrading and construction within 100 ' of a tributary to Lake Cochichewick. (Section 4. 136 NAZBL) As I will be leaving on September 4th, I would like to see that the following concerns are addressed by the Board at the time of the public hearing. The applicant should be required to provide an adequate sewage disposal system which will satisfy both the Local and State requirements without the necessity of a variance. As this existing system is located only 20 feet from a direct tributary both the Planning Board and Board of Health should be careful of the very real negative impact which could occur to the Town's drinking water supply. In past approvals the Planning Board has required extension of the municipal sewer system at the applicant's expense. Although I would never recommend that unnecessary expense be incurred by an applicant, the Town should consider all possible alternatives for protection of our drinking water supply. These tests were observed by Mr. Michael Rosatti of Merrimac Engineering Services, Inc. , representing the Town of North Andover Board of Health. A plan showing the location and elevation of these percolation tests is enclosed. Also shown on this plan is the location and elevation of the deep test pits that were observed by Mr. Joseph Cushing of Gelinas Associates, representing the Town of North Andover Board of Health on May 25, 1982. The results of these deep test pits and a plan showing their location was previously submitted to the Board of Health on June 1, 1982. This information is being submitted to the Board of Health for record purposes. It is our understanding that these soil tests are valid for a period of one year, and that design plans for subsurface sewage disposal systems can be submitted to the Board during that one-year period until September 7, 1983. We have shown on the enclosed plans, in sketch form, the proposed location of the primary disposal area and the reserve area for two possible subsurface sewage disposal systems. The design of the leaching facilities in all probability would be stepped (or terraced) trenches, and the design would be based on a percolation rate of between 25 and 30 minutes per inch. A percolation test was conducted in the primary disposal area and reserve area for each system as shown on the enclosed plan. Depending on the family's wishes for the property, the property may or may not be divided in the foreseeable future. It is our understanding that the family has until this September 7, 1983 date in order to weigh their decision and submit final design plans for the proposed subsurface sewage disposal systems. The public hearing was duly advertised in the North Andover Citizen on March 13 and March 20 , 1991 and all parties of interest were properly notified. The following members were present: George Perna, Chairman, John Draper and Joseph Mahoney. The petitioner is seeking a Special Permit for regrading within the 250 ' buffer zone of lake Cochickewick around the foundation of a proposed single family home located outside the 250 ' buffer zone of the Lake Cochickewick Watershed District. The premises affected is located on the east side of Great Pond Road, known as 476 Great Pond Road in a Residential-1 (R-1 ) Zoning District, also in the Watershed Protection District. Joseph Mahoney, Acting Clerk, read the legal notice to open the public hearing . A motion was made by Joseph Mahoney to continue the public hearing to April 11 , 1991 , due to the lack of a quorum. The motion was seconded by John Draper and voted unanimously by those present. On April 11 , 1991 , the Planning Board continued the public hearing with regard to the application of Ed & Gayle Nieburger for a Special Permit in the Watershed Protection District. Christian Huntress , Town Planner, stated that the Technical Review Committee has minor concerns with the application . The Division of Public Works is concerned with the design of the sewer tie in to Great Pond Road. The sewer connection shall be gravity fed out to the proposed structure to a forced pump located behind the existing cottage . The sewer line shall run across the property of N/F Walter Saxe and the applicant shall be required to secure a written easement across said property. Page 2 : George Perna asked if the forced pump could be redirected or relocated so as to be outside of 100 ' from the tributary to the lake . Christian Huntress stated due to topography of the lot and elevation of the proposed dwelling, the proper location of the pump was shown on the plans . Christian Huntress further stated that the applicant has filed a request for a Special Permit to construct a common driveway to service both lots . That Special Permit shall be opened on April 18, 1991 . A motion was made by Richard Nardella, seconded by Joseph Mahoney, the Planning Board voted to continue the public hearing to April 18, 1991 . On April 18, 1991 , the Planning Board opened the public hearing on the Special Permit for the Common Driveway application. John Simons read the legal notice to open that hearing. The petitioner is requesting was requesting a Special Permit for the construction of a common driveway to gain access to two lots. The premises affected are Lot 5 and Lot 6 , 476 Great Pond Road. Christian Huntress, Town Planner stated that the granting of a Special Permit for a Common Driveway shall eliminate unnecessary construction within the Watershed District. The applicant intends to hold both properties under one ownership but due to the requirements of the Zoning Bylaws, had to split the property into two lots . The common driveway will allow the property to remain as an estate rather than two separate properties . Christian Huntress further stated that the applicant is still awaiting an easement from Walter Saxe for the extension of the sewer line and asked the Board to wait upon granting of the Special Permits until the easement had been secured. A motion was made by John Draper to continue the public hearing on the common driveway as there were issued that still needed to be addressed. The motion was seconded by Joseph Mahoney and voted unanimously by those present. A motion was made by John Draper to continue the public hearing on the Special Permit for the Watershed District. The motion was seconded by Joseph Mahoney and voted unanimously by those present. On April 25 , 1991 the Planning Board held a regular meeting . Christian Huntress, Town Planner, stated that he was waiting for an easement from the applicant. He asked that the Board continue the hearing to the May 16 , 1991 meeting . A motion was made by Joseph Mahoney and seconded by Richard Nardella to continue the public hearing to May 16 , 1991 . The vote was unanimous of those present. On May 16 , 1991 , the Planning Board continued both public hearings for the Special Permits for the Lake Cochickewick Watershed Protection District and for a common driveway. Page 3 : Copies of draft decisions were given to the Board members . John Simons expressed his feelings about being consistent with Special Permits within the Watershed District. He stated that in this case there would not be any building within the Watershed, only grading which is for a future sewer. Members of the Planning Board were in agreement and expressed the need for sewers within the Watershed Protection District. Mr. Nieburger is trying to obtain an easement from his neighbor. A motion was made by John Simons to approve the Special Permit for regrading within the Watershed Protection District for the property at 476 Great Pond Road, Lots 5 and 6 . The motion was seconded by Joseph Mahoney and voted unanimous by those present. A motion was made by John Simons to approve the common driveway special permit for Lots 5 and 6 at 476 Great Pond Road. Christian Huntress brought the Board' s attention to the Fire Chief ' s recommendations on the size of the stone bounds being 8"x8" and not 12"x12" . ZONING BYLAW, SECTION 4.135 FINDINGS OF FACT: The Planning Board makes the following findings regarding this Special Permit as required by section 4. 135 of the Zoning Bylaws: 1. The proposed use and site design for this lot are appropriate, due to it's location in Town. 2 . Adequate vehicular and pedestrian access into the surrounding site has been provided. 3 . The applicant has met the requirements of the Town for a Special Permit as stated in Section 4 . 135 of the Zoning Bylaw. 4 . Adequate and appropriate facilities will be provided for the proper operation of the proposed use. 5. This application for construction within the Watershed Protection District, Section 4 . 135 of the North Andover Zoning Bylaw, was specifically granted for regrading within the Non-disturbance Zone to Lake Cochichiwick. The Planning Board has determined that the regrading and sewer improvements associated with this Special Permit will reduce the potential for contamination to the town's drinking water supply. The Planning Board finds under Section 4 . 135 of the Zoning Bylaw that the proposed site plan generally complies with the Town Bylaw requirements but requires minor conditions in order to be completely in compliance with Town Bylaws. Upon reaching the above findings, the Planning Board approves this Special Permit based upon the following conditions which shall be submitted to the Board prior to signing the documents to be filed with the North Essex Registry of Deeds. SPECIAL CONDITIONS: 1. This decision shall be filed with the North Essex Registry of Deeds. The provisions of this conditional approval shall apply to and be binding upon the applicant, it's employees and all successors and assigns in interest or control. 11. This Special Permit is hereby granted with the understanding that this property will tie into the Town's sewer system located within Great Pond Road. Any alteration to the approved plans as referenced in condition one (1) shall be submitted to the Planning Board as a modification to this approval. 12 . Prior to a Certificate of Occupancy being issued for the proposed structure the applicant shall complete the • II construction of the proposed sewer line connection. 13. The applicant shall secure a written easement agreement for any and all work being done on other property, specifically the installation of the sewer tie-in. The Planning Board makes the following findings regarding the Special Permit Application cited above: FINDINGS OF FACT: 1. The application adheres to the bylaw restriction that no more than two (2) lots be serviced by this common drive. 2 . The specific location of the common driveway is appropriate due to its location. 3 . The design and location will not adversely affect the neighborhood. 4. Adequate standards have been placed on the design which will meet public health and safety concerns. 5. The purpose and intent of the regulations contained in the Zoning Bylaw are met with the Special Permit Application before us. Upon reaching the above findings, the Planning Board approves this Special Permit based upon the following conditions which shall be submitted to the Board prior to signing the documents to be filed with the North Essex Registry of Deeds. SPECIAL CONDITIONS: 1. The Applicant shall place a stone bollard at the entry to the common drive off Great Pond Road. This stone bollard shall have the street numbers of both dwellings engraved on all four sides of the stone. The dimensions of the stone shall be as follows: 8" x 8" x 72" . The stone shall have 48" exposed and 24" buried, and all numbering on the stone shall be 4" in height. This condition is placed upon theapplicant for the purpose of public safety. 2 . Perkins & Assoc. , Inc. , on behalf of the Potter Estate, has conducted deep test pits for the determination of maximum groundwater elevation and also percolation testing at the above-captioned site. A copy of these tests and plans showing their location with ground elevations has been previously submitted to your office. Based on this testing, there is enough available area to accomodate the sewage flow from two separate new dwelling units. The area is large enough for a prime area for subsurface sewage disposal and also a reserve area for each dwelling unit. Deep test pits and percolation tests have been conducted in both the prime and reserve areas for each proposed dwelling unit. Our client has incurred substantial expenses in order to conduct these deep test pits and percolation tests at this site. It is our understanding, based on conversations with Mr. Michael Rossati, that deep test pits for groundwater determination are acceptable to the town as official tests for a period of two years after the date upon which they were conducted. It is also our understanding that percolation test results are good for an unlimited period of time. Before design plans are finalized for the proposed subsurface sewage disposal systems at the above-captioned site, Dana F. Perkins & Assoc. , Inc. would like to meet with the Board of Health in order to discuss the families' wishes for the property as it relates to the Board of Health regulations.
