Petitioner is requesting a finding from Section 9.3 in order to demolish an existing non-conforming structure. Petitioner is requesting a Special Permit from Section 9,Paragraph 9.1, 9.2&9,3 to allow the new construction of a structure on the pre-existing non-conforming lot. The following members were present: Walter F. Soule,Raymond Vivenzio,Robert Ford, Scott Karpinski and George Earley. Upon a motion made Scott Karpinski `� p byand 2 Walter F. Soule the Board voted to GRANT a dimensional variance for relief of a front setback of 20',side setback of 22' and rear setback of 32',and that the proposed building doesn't extended higher than 30'on the condition and basis that the petitioner has satisfied the provisions of Section 10,paragraph 10.4 of the Zoning Bylaw and that the granting of these variances will not adversely affect the neighborhood or derogate from the intent and purpose of the Zoning Bylaw. The Board voted to GRANT a Special Permit for a finding from Section 9.2 in order to demolish an existing non-conforming structure on a non-conforming lot,and GRANT a Special Permit from Section 9,9.1,8.2&9.3 to allow the new construction of a structure on a pre-existing non- conforming lot. The Board finds that the applicant has satisfied the provision of Section 9,paragraph 9.1 of the Zoning Bylaw and that such change,extension or alteration shall not be substantially more detrimental than the existing non-conforming structure to the neighborhood In accordance with the Plan of Land by: Hans-Georg A.Mertsch,Jr.#33941, Civil Engineers,21A Street,Burlington,MA,dated: 3/10/2000. The new building will be located 23 feet off the edge of the traveled way on Chickering Road, approximately 110 feet north of the traffic lights at Main Street. With the building at this location,neither the sight distance along Chickering Road nor the visibility of the traffic signals will be affected. The proposed sign will be located 19 feet off the edge of pavement on Main Street and will be a maximum of eight feet in height. By placing the sign at this location, existing sight distances and signal visibility will be maintained for drivers in all directions. This property is the site of the former Dairy Queen ice cream shop,which has since been converted to a office and consumer service facility, last being used some years ago as hair dressing salon. 2. The size,structure and location of the existing building(which was built in 1965)on the lot is not conducive to current commercial uses as evidenced by the prolonged vacancy. 3. Applicant is the owner of the adjacent building(Says Pizza),and substantially rehabilitated the greater part of this-island"formed by the intersection of three streets,namely Ch ickering Road(Rt. 125), Park Street and Main Street. 4. Applicant proposes to complete the process of rehabilitating the appearance of this gateway "ishuid"by demolishing the existing two story dutch colonial design building and replacing the same with a one story building, compatible in architecture to the building which Applicant placed on the adjacent property some years ago(Sal's Pizza). 5. As can be seen from the enclosed Plans, the Applicant's lot places a hardship on Applicant owing to circumstances relating to the soil conditions,shape and topography of the lot,which especially affect the Applicant's lot but which does not generally affect the Zoning District in which Applicant's lot is located. 6. A literal enforcement of the provisions of the Zoning By-Law would involve a substantial hardship,financial and otherwise to the Applicant,which hardship(as noted above)is owing to circumstances relating to the soil conditions,shape or topography of the Property which especially affects the Property but does not generally affect the Zoning District in which the Property is located. The size,structure and location of the existing building(which was built in 1965)on the lot is not conducive to current commercial uses as evidenced by the prolonged vacancy. 3. Applicant is the owner of the adjacent building(Sal's Pizza),and substantially rehabilitated the greater part of this"island"formed by the intersection of three streets,namely Chickering Road(Rt. 125),Park Street and Main Street. 4. Applicant proposes to complete the process of rehabilitating the appearance of this gateway "island"by demolishing the existing two story dutch colonial design building and replacing the same with a one story building, compatible in architecture to the building which Applicant placed on the adjacent property some years ago (Sal's Pizza). 5. As can be seen from the enclosed Plans, the Applicant's lot places a hardship on Applicant owing to circumstances re latingto the soil conditions,shape and topography ofthe lot,which especially affect the Applicant's lot but which does not generally affect the Zoning District in which Applicant's lot is located. 6. A literal enforcement of the provisions of the Zoning By-Law would involve a substantial hardship,financial and otherwise to the Applicant,which hardship(as noted above)is owing to circumstances relating to the soil conditions, shape or topography of the Property which especially affects the Property but does not generally affect the Zoning District in which the Property is located. The new building will be located 23 feet off the edge of the traveled way on Chickering Road, approximately 110 feet north of the traffic lights at Main Street. With the building at this location, neither the sight distance along Chickering Road nor the visibility of the traffic signals will be affected. I The proposed sign will be located 19 feet off the edge of pavement on Main Street and will be a maximum of eight feet in height. By placing the sign at this location, existing sight distances and signal visibility will be maintained for drivers in all directions. In summary,this proposal for a new building at 478 Chickering Road will not interfere with the traffic signals at Main Street and will maintain safe stopping sight distances for traffic on both roads.
