A public hearing was held by the Board of Appeals on '111 12, 1950 upon application
of Alfred R. & Bary Boeglin who requested a variation of Sec. 7.3 and Table 2 of
the Zoning By -Law so as to permit one (1) foot relief from side setback requirement
as shown on a plan dated April d,, 1980 on the premises located at 48 5laverly Rd.
The following members were present and voting: Frank Serio, Jr., Chairman; Alfred E.
Frizelle, Esq., Vice -Chairman; Richard J. Trepanier, Esq..; Nilliam J..Sullivan; and
Assoc. 1.ember, Augustine W. Nickerson.
The hearing was advertised in the N. A. Citizen on April 24 a id IiajT 1, 1980 and all
abutters were duly notified by regular mail.
After hearing testimony given by counsel for the petitioner, J. Philip Arsenault,
the Board voted unanimously to GFAI' T the variance. roti or_ made by ^ri7.elle and
seconded by Nickerson. There was no opposition.to the petition.

Due to error, there is a slight side line violation on
garage . Owing
to circumstances especially relating to this structure and lo't, a literal
enforcement of the provisions of the By -Law would involve substantial
hardship, financial or otherwise, to the petitioner, and the.desirable
relief may be granted caithout substantial detriment to the public good
and -without nullif inq or substantially derogating from the intent or
purpose of the By -Law.
