NELSON p °n Town Of 120 Main Street, 01845 n`'E``°' NORTH ANDOVER (508) 682 6483 BUILDING ; ......... y CONSERVATION SS^cwusEt DIVISION OF HEALTH PLAN- ING PLANNING & COMMUNITY DEVELOPMENT July 28 , 1993 Mr. Daniel Long, Town Clerk Town Building 120 Main Street North Andover, MA 01845 Re: Site Plan Review 485 Andover Street Dear Mr. Long: The North Andover Planning Board held a public hearing on June 15, 1993 in the Senior Center behind the Town Building, upon the application of DaMe Realty Trust, 485 Andover Street, North Andover, MA. , requesting site plan approval under Section 8 . 3 of the North Andover Zoning Bylaw. The legal notice was advertised in the Lawrence Eagle Tribune on May 29 and June 5, 1993 and all parties of interest were properly notified. The following members were present: Richard Nardella, Chairman, Richard Rowen and George Perna. The petitioner was requesting site plan approval for the change in use and the required parking. The premises affected is located in a Business-4 (B-4) Zoning District, known as 485 Andover Street. Mr. Rowen read the legal notice to open the public hearing. Attorney Peter Caruso presented the Board with the following: 1. More than 5 parking spaces required. 2 . Prior use as residence 3 . Want to use for office a. MacDonald Levers — Condo Management b. 5 employees - 3 part time 4 . Zoned Business-4 (B-4) 5. Currently 15 ' driveway 6. Abuts residential zone in Andover 7 . Want to keep commercial use away from residents. 8. There is 15 ' available for driveway between existing garage and Pediatric Medical Office (abutting property) 9. Lights to be on a timer a. 6 ' colonial post b. 150 watts 10. Wants to keep as many trees as possible 11. Sign at front, same size as the existing signs 12 . Will landscape, will not change exterior of house. 13 . Screening of parking Page 2: 485 Andover Street The applicant needs to go to the Building Inspector to get a sign permit. The Planning Board will want to see what the light posts will look like. There will be 15 sparking spaces created, do not need more than 8 for employees but applicant may expand the number of employees or lease spaces The Board expressed concerns with the 15 ' driveway may not be adequate for access. The Board asked that the developer keep pavement in front of garage so that two cars could turn in. The Board asked about a "Right Turn Only" sign. A site visit will be schedule for Saturday, June 19, 1993 at 8: 00 a.m. Staff needs to calculate the number of parking space with aid from the Building Inspector. On a motion by Mr. Rowen, seconded by Mr. Perna, the Board voted to continue the public hearing to the next meeting. Full discussion to take place at next meeting. On June 29, 1993 the Planning Board held a regular meeting. The following members were present: John Simons, Acting Chairman, Joseph Mahoney, Clerk, Richard Rowen John Draper and George Perna, Associate Member. Mr. Simons asked why the Board should allow a B-4 use where there is a substandard size lot. Eight parking spaces are needed for actual business use. May need other spaces during high levels of use. The applicant wants to leave green space around border. The proposed project: 1. leave garage 2 . reduce number of spaces 3 . keep 50 ' green buffer for parking The applicant needs: 1. To show 50 ' green space on the plans 2 . To show the extent of pavement on the plan 3 . To show size and dimension of parking spaces 4 . To show dimensions of green space around the parking lot 1 Page 3 : 485 Andover Street Staff to draft letter in favor of keeping garage to Zoning Board of Appeals. Applicant concerned as to where clients will go to park. Drainage calculations will be needed. A letter will be sent to the Building Inspector that the applicant can move into the building without final approval from the Planning Board as long as off site parking can be provided. On a motion by Mr. Rowen, seconded by Mr. Draper, the Board voted to continue the public hearing until the next meeting. Staff to draft a decision for review at next meeting. On July 20, 1993 the Planning Board held a regular meeting. The following members were present: Richard Nardella, Chairman, Joseph Mahoney, Clerk, Richard Rowen and John Draper. Mr. Joseph LaGrasso presented the site plan to the Board. 1. Need for additional parking other than just their day to day employees 2 . crushed stone parking area 3 . Lantern pole lights to be used 4 . Wall mounted lights to be used. 5. Will leave existing curb cut - 12 ' driveway 6. Low level lighting on sign On a motion by Mr. Mahoney, seconded by Mr. Draper the Board voted to close the public hearing. On a motion by Mr. Mahoney, seconded by Mr. Rowen, the Board voted to approve the draft decision with amendments. Attached are those conditions the Board approved. The Planning Board makes the following findings regarding this Site Plan Review for the change in use of an existing structure from residential to business use and for the construction of a parking lot behind the existing building as required by section 8 . 3 of the North Andover Zoning Bylaws: FINDINGS OF FACT: 1. The proposed use of the existing building as an office and site design for this lot are appropriate as the site is in a Business-4 District. 2 . Adequate vehicular and pedestrian access into the surrounding site has been provided with the adherence to the approved plans. 3 . The landscaping plan as shown and revised, meets the requirements of section 8 .4 of the Zoning Bylaws, with the addition of the enclosed conditions. 4 . The site drainage system is designed in accordance with the Town Bylaw requirements. 5. The applicant has met the requirements of the Town for Site Plan Review as stated in Section 8. 3 of the Zoning Bylaw. 6. Adequate and appropriate facilities will be provided for the proper operation of the proposed use. Finally, the Planning Board finds that this modification generally complies with the Town of North Andover Zoning Bylaw requirements as listed in section 8. 35 but requires conditions in order to be fully in compliance. Therefore, in order to fully comply with the approval necessary to construct the facility as specified in the Site Plan Review application before us, the Planning Board hereby grants an approval to the applicant provided the following conditions are met: SPECIAL CONDITIONS: 1. This approval is for the use of the existing building as an office. Any other use will require review by the Planning Staff and may require site plan review by the Planning Board. 1 r 2 . Prior to any construction: a. The applicant, in conjunction with the Town Planner and/or the Tree Warden, shall mark all trees to be preserved prior to any construction on site. b. a bond in the amount of $5000. 00 shall be posted for the purpose of insuring that a final As-Built plan showing location of all on site utilities, structures, curb cuts, parking spaces and drainage facilities be submitted. This bond shall be in the form of a check made out to the Town Of North Andover. This check will then be deposited into an interest bearing escrow account. C. the North Andover Division of Public Works shall review and approve all plans, including storm water drainage. 3 . Prior to FORM U verification (Building Permit Issuance) : a. This decision shall be recorded at the Essex North Registry of Deeds and a recorded copy delivered to the Planning Staff. 4 . Prior to verification of the Certificate of Occupancy: a. The site shall be reviewed by the Planning Staff. Any screening as may be reasonably required by the Planning Staff and/or Tree Warden will be added at the applicant' s expense. b. A final as-built showing the location of all on site utilities, structures, curb cuts, parking spaces and drainage facilities must be submitted to and approved by the Division of Public Works. C. Six Parking Spaces must be specifically designated for use by the employees only. d. If the Zoning Board of Appeals should require the removal of the garage, that area must be covered with crushed stone to blend in with the parking area created behind the building. 5. All artificial lighting used to illuminate the site shall be as shown on the Site Improvement Plan approved as part of this decision. 6. Any Plants, Trees or Shrubs that have been incorporated into the Site Improvement Plan approved in this decision, that die within one year from the date of this approval, shall be replaced by the owner. 2 r 7. The contractor shall contact Dig Safe at least 72 hours prior to commencing any excavation. 8. Gas, Telephone, Cable and Electric utilities shall be installed as specified by the respective utility companies. 9 . All catch basins shall be protected and maintained with hay bales to prevent siltation into the drain lines during construction. 10. No open burning shall be done except as is permitted during burning season under the Fire Department regulations. 11. No underground fuel storage shall be installed except as may be allowed by Town Regulations. 12 . All signs within the project shall be of wood or stone, with uniform lettering and design. The signs shall in no way be interior illuminated. (Neon or other means) . 13. Any changes to the plans approved by the Planning Board shall be reviewed by the Town Planner. Any changes which the Town Planner may deem as major must be submitted to the Planning Board for approval. 14 . The provisions of this conditional approval shall apply to and be binding upon the applicant, it' s employees and all successors and assigns in interest or control.
