The Commission expressed their concern with the on-going stabilization and erosion problems at the above referenced site and felt that the most recent Enforcement Order did not properly address all meastires of mitigation for site stabilization, monitoring, assessment, and clean-up. In as such, the Commission voted unanimously to ratify this new Enforcement Order, which shall be immediately adhered to and complied with. On a continual basis, heavy rainstorms have created significant run-off and siltation into downstream resource areas. Heavily silt-laden water has been observed to be flowing down Chestnut Street with the source of the siltation problem arising from your lots, especially the driveway currently servicing the lots. The erosion controls in place are not satisfactory for handling the severe erosion problems on the site. The driveway is contributing to a significant amount of silt, as it is unstable and on a slope. These lots have been an ongoing continuous problem and have continuously been the source of significant sedimentation to Mosquito Brook. ORDER: Acting as an Agent of the Commission under MGL C.40, S.211) and the Act (310 CMR 10.08(3)), enclosed please find an Enforcement Order mandating the following. • Immediately Cease& Desist from any and all work activities until the site is stabilized and.all accumulated sedimentation has been satisfactorily cleaned and mitigated per the Conservation Department and/or the Environmental Monitor. The only activity to occur during the Cease&Desist are the following: BOARD OF APPEALS 688-9541 BUILDING 688-9545 CONSERVATION 688-9530 HEALTH 688-9540 PLANNING 688-9535 • Immediately stone the entire driveway between the houses to help prevent silt runoff; • Immediately clean all accumulated silt from Chestnut Street to Salem Street,which was a result of the referenced property. • Remove,replace, and add erosion controls were necessary; In addition to the Cease&Desist Order,this Enforcement Order also mandates the following. • The applicant must immediately hire the services of Epsilon Associates to develop and implement a long-term stabilization plan, conduct weekly monitoring reports until complete site stabilization, and to assess and report on resource area impacts; • Retainment of such services, as noted above, must be confirmed by contractual agreement and proof of such contract shall be submitted to the Conservation Department; • Implementation of additional BMP practices were necessary; The violations as documented herein are subject to a$300 per day penalty' until such time as the impacted resource areas have been mitigated. Each day or portion thereof during which this violation continues shall constitute a separate offense. At this time, the Department has elected to levy a fine in the amount of $300 per day from the date of which the subsequent Enforcement Order had been issued(8/4/03),until the measures as stated above have been fully and successfully implemented. Failure to comply with this Order and the deadlines referenced herein will result in the issuance of additional penalties. MGL C.131 S.40 and the North Andover Wetland Bylaw, C.178 authorizes the Conservation Commission to seek injunctive relief and civil penalties per day of violation. In addition, a violation of the Massachusetts Wetland Protection Act and the North Andover Wetland Bylaw constitutes a criminal act, which is subject to prosecution and the imposition of criminal fines,also per day.
