As you know, the Zoning Board of Appeals has granted a variance and/or special permit for
premises located at: ?
Once the 20 day appeal period has passed, please pick up your signed mylar (if one was required) .
at the Town Clerk's office, and pick up your certified copy of the Zoning Board of Appeal's decision
which must be obtained from the Town Clerk's office at that time. The Town Clerk's office is
located at 120 Main Street, North Andover, MA.
Please bring the mylar along with the certified copy of the Zoning Board of Appeal's decision to the
North Essex Repistry of Deeds which is located at 381 Common Street Lawrence MA as the
decision and mylar must be filed at the Registry of Deeds as soon as possible
Once this is completed, please bring a copy of the certified decision and a copy of the signed plan
along with the receipt/recording information and submit same to the Building Department, which is
located at 27 Charles Street, North Andover, MA.

Dear John and Reg:
Concerning the above -captioned matter, this letter will confirm that we appeared before
the North Andover Zoning Board of Appeals on Tuesday, July 13, 1999 regarding your request
fora variance from the sideline setback to the deck steps and front setback to the house as well as
a special permit to do construction on a legal pre-existing non -
confirming structure.
The Board listened to our presentation, accepted the favorable letters from some of your
neighbors and heard the unfavorable comments of Mrs. Bailey and her son. The Board then voted
unanimously to allow the variance and special permit as you requested.
The Board must now prepare and sign a written decision and file it with the town clerk,
whereupon the twenty (20) day appeal period must run before an attested copy of the decision
and plan can be obtained from the Town Clerk and recorded at the North Essex Registry of
Deeds. If you have any questions regarding this matter please contact me.
I have enclosed herewith my bill for legal services rendered and expenses incurred.

The Board of Appeals held a regular meeting on Tuesday evening, July 13, 1999 upon the application of John R. &
Margaret V. Sutton, 487 Waverly Road, North Andover requesting a Variance from the requirements of Section 7,
P7.3 of Table 2, for relief of front setback and side setback, and for a Special•Permit from the requirement of Section
9, 9.1 & 9.2 in order to replace a deck, on a pre-existing non -conforming lot. Property is located in the R4 Zoning
District.
The hearing was advertised in the Lawrence Tribune on 6129/99 & 716199 and all abutters were notified by regular
mail.
The following members were present: William J. Sullivan, Raymond Vivenzio, John Pallone, Scott Karpinski, & Ellen
McIntyre.
Upon a motion made by John Pallone, and 2n' by Robert Ford, the Board voted to GRANT a Variance from the
requirements of section 7, P7.3 for relief of front setback of 13', and side setback of 7', and to GRANT a Special
Permit from the requirements of section 9, P9.1& 9.2 to allow construction of a wooden deck 14'x12' ( which is a
second means of egress) to a pre-existing non -conforming structure, in accordance with the revised Plan of Land by:
Scott Giles, Registered Land Surveyor, #13972, dated: 612199. Voting in favor: William J. Sullivan, Raymond
Vivenzio, John Pallone, Scott Karpinski & Ellen McIntyre.
10.4 Variances and Appeals The Zoning Board of Appeals shall have power upon appeal to grant variances from the terms
of this Zoning Bylaw where the Board finds that owing to circumstances relating to soil conditions, shape, or typography of the land
or structure and especially affecting such land or structures but not affecting generally the zoning district in general, a literal
enforcement of the provisions of this Bylaw will involve substantial hardship, financial or otherwise, to the petitioner or applicant,
and that desirable relief may be granted without substantial detriment to the pubiic good and without nullifying or substantially
derogating ton the intent or purpose of this Bylaw.
Note: The granting of the Variance and/or Special Permit as requested by the applicant does not necessarily ensure
the granting of a Building Permit as the applicant must abide by all applicable local, state and federal and building
codes and regulations, prior to the issuance of a building permit as requested by the Building Commission.
