located on the Past side of Carlton Lane and known as Lot 26D, a

Tho.petitioner te9tifie6'thresijh his engineer that the dwelling is
not completed and that the petitioner would like to construct a
i 121 n 241 open deck on the rear of the dwelling, which would not
i satisfy the rear setback requirement of 30 feet. The sliding -Soots
to the proposed dock are already'placed in the dwelling.
Upon a motion mage by Mr. FriZelle and secondee by ter. Sullivan, the.
I ?hoard voted four to one, with fieYaber Sullivan in opposition, to grant
4 the variance as requested for an open deck only.
The:Po4rd,.fiends. that a literal enforcement of the Zoning By,Law would
cac+at3 a hardship to the petitioner and thatthe variance can be-granted
without detriment to the public good and without nulliying or dero-
