Center, 120R Main Street, North Andover, MA on Tuesday the 14'h of December, 2004
at 7:30 PM to all parties interested in the appeal of Robert G. &Betty Jane Dawe,

You requested my comments on the petitioners' application for a variance.
(a) Circumstances relating to the soil conditions, shape or topography.
In Broderick v. Board of Appeal of Boston, 361 Mass. 472, 479 (1972), the Supreme
Judicial Court said:
We have.repeatedly stated that "[n]o person has a legal right to a variance
and they are to be'granted sparingly." Damaskos v. Board of Appeal of
Boston, 359 Mass.55,'61 and cited cases.
M.G.L. c. 40A, § 10 provides that a variance may be granted only where the permitting
authority,
"specifically finds that owing to circumstances relating to the soil
conditions, shape, or topography of such land or structures and especially
affecting such land or structures but not affecting generally the zoning
district in which it is located, a literal enforcement of the provisions of the
ordinance or by-law would involve substantial hardship, financial or
otherwise, to the petitioner or appellant, and that desirable relief may be
granted without substantial detriment to the public good and without
.nullifying or substantially derogating from the intent or purpose of such
ordiriarice.or_by-law. ;

The Supreme Judicial Court"has repeatedly held that no variance can be granted unless
all of the requirements of the statute are met." Warren v. Board of Appeals ofAmherst, 383
Mass. 1, 9-10 (1981), citations omitted.
In this case, the petitioners must show there is something about the soil condition, size,
shape or topography of the property in question that affects this property and not the district so as
to make enforcement of the by-law a hardship.
The mere fact that lots have insufficient frontage is not sufficient to satisfy that statutory
requirement. Warren, supra. at 11. As the Supreme Judicial Court stated in Warren, supra at 11:
If the Legislature intended the mere fact of a deficiency in the required
frontage of a lot to be sufficient, without more, to satisfy this particular
prerequisite for a variance, it is difficult to believe that they would not
have said so in this statute. They did not do so, and we believe that they
did not intend that result.
In Warren, the fact that frontage of one lot was insufficient as a result of the earlier
conveyance of an adjoining lot by a prior owner of both parcels was held insufficient grounds for
granting of a variance to a subsequent owner.
(b) Substantial Hardship.
Mass. Gen. L. ch. 4OA, g 10 requires a variance peti1,ioner to uc�m,onstrate that"a]iteral
enforcement of the provisions of the ordinance or by-law would involve substantial hardship,
financial or otherwise." The hardship must relate to the premises for which the variance is
sought.
A nexus must exist between"a circumstance" set forth in the statute and
the hardship claimed by the petitioner. In Guiragossian v. Board of Appeals of
Watertown, 21 Mass. App. Ct. 111 (1985) the court reviewed a petition for a use

variance for a lot of allegedly unique shape. The court termed the relationship
between the statutory circumstances and hardship to be "symbiotic."
"[T]he hardship alleged must arise from the shape of the locus or one of
the other factors specifically referred to in § 10. An applicant for a
variance must show that the land's shape, alone or in combination with
other features of the land,prohibits development consistent with the
ordinance. When the applicant makes such a showing, hardship can be
found to exist."
Personal hardship is not a proper factor for consideration. Nor is personal financial
hardship because of lost profits,prior expenditures or resale value. Where the hardship alleged
by a petitioner has been self-created, the courts have been consistently hostile to relief through
the variance procedure. See Bobrowski, Massachusetts Land Use and Planning Law. § 8.03(B).
See also Karet v. Zoning Board of Appeals of Worcester, 27 Mass. App. Ct. 439, 440 (1989) ("It
is . . . clear that a lot cannot qualify for a variance if the circumstance creating the hardship is
itself the result of a transfer that violates in some respects applicable zoning requirements for
buildable lots."

I
This letter is to express my oposition to the request for dimensional variances made by
Robert and Betty Jane Dowe on the subdivision of their lot located at 49 Longwood
Avenue in North Andover.
My opposition is based on multiple reasons, but the very basic one is the compliance with
what it is stated in the"Zoning Bylaw, Town of North Andover, 1972, Section 1,
Purposes":
"...The purpose of this Bylaw is the promotion of the health, safety, convenience, morals
and welfare of the inhabitants of the Town of North Andover.... by regulating and
restricting the use of land and buildings,thereby: ...encouraging the most appropriate use
of land...preventing overcrowding of land...lessening congestion of traffic...". The
request made by Robert and Betty Jane Dowe goes clearly against the purposes of the
bylaw.
Exceptions to the requirements expressed in the bylaw must only be considered under
extraordinary circunstances; and when those exceptions are considered the benefits for
the town and all its habitants must be clearly identified. It is clear to me that the only ones
that will benefit from an approval of the request for dimensional variances will'be the
requesters,who will not be living in the neighbourhood. In addition we also need to
remember that the exception to the bylaw requested is the first one in a series of
exceptions that will follow afterwards.
I'm in general concerned about the town's situation; how much it is being built and the
long-term benefits of this:action.
I'm also concerned about the way a variance would affect the neighbourhood: it is
already overcrowded and there is much traffic congestion, especially during school days;
it is already difficult -and dangerous for the children- to drive during snow days in streets
like Rosedale Av., Hewitt and Longwood Av.

Attached is a one-page draft of two proposed voluntary conditions which the Dawes feel help address concerns of
the last two remaining abutters who have not yet signed on board in support of the variance. One of the abutters
was very pleased to hear the lot considered a house on the Longwood Avenue side only. The other abutter we
have not spoken with as of yet, but,we have been told that they had their own concerns of the location of the
building as well.
As such, my attached proposed conditions is a work in progress, but is believed to address the only concerns
remaining of statutory abutters.
Please extend apologies for not being able to get this to the Board sooner. I hope they(at least most)will be able
to review before the meeting on Tuesday.

PROPOSED VOLUNTARY CONDITIONS TO VARIANCE
Robert and Betty Jane Dawe, hereby propose voluntary conditions relating to their
request for dimensional variances on the subdivision of their lot located at 49 Longwood
Avenue,North Andover:
1. Any accessory structure building on the newly created lot, as such building is
defined by the zoning bylaws, shall not be constructed on the premises any
further back into the lot than 100 feet from the frontage access line along
Longwood Avenue,while continuing to maintain all other front, side and rear
yard dimensional setback distances under zoning. Such condition is not
contemplated to restrict the installation of other types of recreational
accessory structures such as, but limited to a pool,pool pump house,tool shed
not to exceed 100 square feet, swing set, fences or other ordinary single
family backyard recreational structures.
2. There shall be no vehicular access to the newly created lot via the private way
paper street of Maplewood Avenue from Rosedale Avenue to the corner of the
current assessor's parcel 23 furthest from Rosedale Avenue, so long as
Maplewood Avenue shall remain a private way. This condition shall not be
deemed an abandonment of property rights within said Maplewood Avenue,
but merely a covenant to reduce uses over a paper street for a determined
period of time.

Section 9—Variance Application, points A-F:
A. Our particular Variance request for parcel 23 found on map 60C is to subdivided
the parcel into lots each having less area than required under section 7 &Table 2
of the zoning bylaws. Each new lot would require a 5 foot frontage variance and
the existing lot would require a 5 foot side variance.
B. The particular circumstances of our lot relating to soil conditions are unchanged
by the requested variance.
The particular circumstances of our lot relating to shape is that the parcel would
be split into two lots. Each lot,though less than 25,000 sq.ft. would still be
larger than any other lot in the neighborhood as seen on the enclosed map 60C.
As seen on the photo sheet of recently built homes in the neighborhood, the
approval of this variance would not affect the rest of this zoning district. All of
the homes in this neighborhood are built on lots smaller than the proposed lot
size of either of the divided lots.
C. We are both aging and find the upkeep and tax requirements on this size property
a burden and would be exposed to substantial hardship if the literal enforcement
of the Zoning Bylaw sections 7.1, 7.2 & 7.3 on this land or use if this Variance
relief is not granted.

D. Cost of living and tax increases will support a finding that the relief sought will

And I'm also concerned about my own property and the leaving conditions of my family;
the impact that it could cause to build additional houses around and how my lot will be
affected: a section of my backyard -that seems to be located in the lowest part of the
block- gets flodded due to water coming down from different lots in the block to a drain
pipe located less than one foot away from my lot. Modifying the level of the lot located at
49 Longwood Avenue will worsen the situation.
