The Sellers Andras Hamori and dela Hamori understand that Buyers, Michael
Bower and Rita Bower agree to be responsible for connecting to town sewer at
49 Salem Street in case the proposed sewer line is not completed before the
closing of the house sale at 49 Salem Street.
According to a letter from the Town of North Andover Division of Public Works,
dated June 1, 2000 (copy attached), the installation of the sewer line by Gray
Excavation for a subdivision off Salem Street called Heritage Estates will start in
late June. This sewer line will also provide sewer service to several homes on
Salem Street, including house#49. According to the letter, the construction
could take one to two months to complete. This schedule will closely coincide
with the proposed closing of the sale of the 49 Salem Street residence.
We are, therefore, requesting for a waiver of Title V. in case the connection is not
completed before the proposed closing date. The Sellers will place 1.5x
estimated cost in escrow to be available in case the Buyers need to complete the
hook-up to town sewer.

Dear Ms.Starr:
Please be advised that a new sewer main is proposed for Salem Street starting at the intersection with Stevens Street
and ending at#121 Salem Street. The proposed sewer main is intended to service anew subdivision called Heritage
Estates. .After the sewer is installed,several homes on Salem Street will have access to sewerage,including house
#l49.
The developer is David Kindred (Flintlock Inc.). As you know, Mr. Kindred is a local developer who has built
several recent subdivisions in town including Lost Pond Lane and Brookview Drive. He.has hired Gray
Construction to install the sewer on Salem Sneer.
Heritage Estates is an approved 12-lot subdivision,and some on-site work has already begun. We have had a pre-
construction meeting with representatives from Police, Fire, Gray Constniction, and Flintlock Inc. Gray
Construction intends to start work in late June,after school is finished. It could take a couple of months to complete
the work on Salem Street. The presence of ledge and groundwater can slow down construction considerably.
While we expect this project to go forward as planned, it a private venture, and therefore we cannot absolutely
guarantee its completion.

Dear Mr. Hamori:
The Health Department has been supplied with a list of all residences, currently on
septic, which have access to the municipal sewer system. Your property was listed
as having access as of November 2000 due to the completion of the new sewer in
your area. This office was notified that you were sent information from. the
Department of Public Works informing you of your status and the tie-in regulation.
As previously published at a Public Hearing on March 17, 1994, the Board of
Health has adopted regulations concerning the required sewer tie-in. The
following timetable concerning your property status was adopted:
4.1 All establishments that currently do not have municipal sewer available
to them must connect to the sewer as soon as it becomes available, with a
maximum time limit of six months.
The purpose of these regulations is to safeguard North Andover's drinking water,
surface waters, groundwater and surrounding environment. Sanitary sewer is
believed to be the most effective form of wastewater treatment. A copy of the
entire regulation can be obtained at our office.

TO RESIDENTS OF SALEM STREET:
Please be advised that the recently installed sewer main on Salem Street has passed all required testing
and inspections. Consequently, it is now ready for public use. This affects the following houses on
Salem Street: #39, #40, #49, #58, #59, #69, #70, #79, #99, and#120.
You may now begin the process of connecting to the sewer. A sewer connection permit must be taken
out from this office. The fee for the permit is.$1,000.00. You must hire your own contractor to make
the connection. A list of contractors is available at this office. Contractors not on the list may also be
hired.
The permit requires"sign-offs"from the Health Agent and Conservation Agent at 27 Charles Street.
Once the permit has been paid, and has been signed by the Conservation and Health Agents, your
contractor may proceed to connect your house to the sewer line.
The Board of Health has a regulation in place stating that all homes that have access to town sewerage
must connect within six months after a line becomes ready for connections.
