Petition No . 53- ' 83 Dear Mr. Long : The Board of Appeals held a public hearing on Monday evening , August. 8, 1983 upon the application of M . Ann Bush . The hearing was advertised in the North Andover Citizen on July 21 and 28, 1983 and' all abutters were notified. by regular mail . The following members .were present. and voting : Frank Serio , Jr . , Chairman ; Alfred E . Frize'lle , Esq . , Vice Chairman ; Richard J . Trepanier, Esq,. , Clerk ; William J . Sullivan ; and Augustine W . Nickerson . The petitioner seeks a variance from the provisions of Section 7 , Paragraph 7. 3 and Table 2 of the Zoning By Law so as to permit relief from the front setback requirement to allow the continued existence of a dwelling on premises located at 49-51 Brewster St. The petitioner testified through counsel that the' dwelling was constructed fn May of 1983 and due to an' engineering error , the dwelling was placed 29 .6 feet from the front property line . A 30 foot setback is required in the R-4 zoning district. It would be a hardship, to the petitioner is the variance were to be denied. Upon a motion made. by Mr.. Frizelle and seconded by Mr . Trepanier , the Board voted . four to one to grant the variance as requested ,. with . members Serio , Frizelle , Trepanier , and Nickerson voting in favor and member Sullivan voting in opposition . The Board finds that Section 10. 4 of the Zoning By Law has been satis fi ed .. . . Book Page The principal points upon which _I base my application are as follows : ' (Must be stated in detail ) The building was erected with due care, but due to the size of the i __ _building with reaard to the lot an error was made in placement foundation which would require an inordinate financial hardship to reconstruct in accordance with the by=law. These -forms shall be furnished by the clerk upon request .
