i ppeals has been petitioned by Mr. Benjamin Barnum
to extend a Specol Permit granted by the Board in 1957 for land
on Boston Hill and to change the name on the permit .
The Special Permit was issued to M. I .T. to extend the heivht of
; D a $esearch tower beyond the requirements of the Zoning By Law.
1 At the time of the approval , the tower was an allowed use in the
II residential district .

A copy of the Board' s decision is enclosed for your review .
Since i!. I .T . no lonner wishes to utilize the premises and a commer-
cial use is proposed , our question is whether or not the use , no
longer allowed in the residential district , is grandfathered in ,
or could it be extended by Special Permit .
Since this request is on our agenda for January 11 , 1982 , your
prompt reply will be greatly appreciated .

Dear Mr. Long :
The Board of Appeals held a public hearing on Monday evening ,
December 14 , 1981 upon the application of Benjamin Farnum . The
hearing was duly advertised in the North Andover Citizen on
November 25 and December 3 , 1981 and all abutters were notified
by regular mail . The following Board members were present and
voting : Frank Serio , Jr. , Chairman ; Alfred E , Frizelle , Esq . ,
Vice Chairman ; Augustine V1. Nickerson ; Maurice S . Foulds and
Raymond A . Vivenzio , Esq .
The petitioner seeks an extension of a Special Permit granted
by the Board of Appeals in 1957 and wishes to change the name
of the petitioner from Mass . Institute of Technology to Benjamin
Farnum. The land affected is off Boston Street .
The petitioner testified through counsel that in 1957 the Board
of Appeals granted a Special Permit to M. I .T . to extend the height
of a. tower , an allowed use at that time , beyond the requirements
of the Zoning By Law .
M. I . T . no longer wishes to utilize the structure , which is no
longer an allowed use in a residential district , and Mr . Farnum
is requesting that the Special Permit be extended and written in
his name in order that he may lease the property . He did not ,
however , provide the Board with the name of a new tenant . He
further testified that if the request is denied , the U . S . Government
will raze the structure (tower) .
Upon a motion made by Mr . Frizelle and seconded by Mr. Vivenzio ,
the Board voted unanimously to deny the request for an extension
of the Special Permit .

Sec . 1 APPLICATI FORM
Every application for action by the Board shall be made on a form
i approved by the Board. Thes.e 'forms shall be furnished by the clerk
upon request . Any communication purporting to be an application
1 shall be treated as mere notice of intention to seek relief until
such time as it is made on the official application form. All in-
formation called for by the form shall be furnished by the applicant
in the manner therein prescribed.
Every application shall be submitted with a list of "Parties in
Interest" which list shall include the petitioner , abutters , owners
of land directly opposite on any public or private street or way ,
and abutters to the abutters within three hundred feet of the property
line of the petitioner as they appear on the most recent applicable
tax list , notwithstanding that the land of any such owner is located
in another city or town , the Planning Board of the city or town ,= and
the Planning Board of every abutting city or town .
* Every application shall be submitted with an application charge cost
in the amount of $25 . 00 . In addition , the petitioner shall be respon -
sible for any and all costs involved in bringing the petition before
the Board. Such costs shall include mailing and publication , but
are not necessarily limited to these .

Re: Petition of Benjamin Farnum
Gentlemen:
Mr. Benjamin Farnum and his attorney, James McInnis,
requested information from me as Zoning Officer, regarding a
special permit issued to Massachusetts Institute of Technology
in 1957 on Boston Hill, off Turnpike Street.
Mr. Farnum's lease with M.I.T. is expiring and he
wished to know what uses could be made of the property, as
opposed to razing the buildings. After carefully reviewing the
special permit and consulting with Town Counsel, it is my opinion
that the special permit was granted for research by the petitioner,
M.I.T. , and that any other use of the property, other than the
allowed residential uses, could be authorized only by approval from
the Board of Appeals or by re—zoning.
