The North Andover Board of Appeals held a public hearing at its regular meeting on Tuesday,November 13,2001 at
7:30 PM upon the application of Judith Brasseur,5 Longwood Avenue,North Andover,MA requesting a
dimensional Variance from Section 7,Paragraph 7.3 for front,side,and rear setbacks,and for a Special Permit from
Section 9,Paragraph 9.2 to allow for a proposed addition of a 2ad floor with 3 bedrooms and 1 bathroom on a pre-
existing non-conforming structure within the R-3 zoning district.
The following members were present:William L Sullivan,Walter F. Soule,John Pallone,Ellen McIntyre,George M.

Earley.
Upon a motion made by Walter F. Soule and 2nd by John Pallone,the Board voted to GRANT a dimensional
Variance for relief of 1.1' front setback,7.6'right side setback,and 2.9'rear setback in accordance with the Plan of
Land of Bradford Engineering Co.,3 Washington Sq.,Haverhill,MA 01830 dated 7/31/01,revised;with the following
conditions:
1. The tractor trailer will be moved within six months of the issuance of the building permit;
2. . The tree branches and scrap wood,including the railroad ties shall be removed during the first quarter of year
2002;
3. The excess material,presently under tarps,used for the construction of an addition shall be removed within
six months of the issuance of a building permit;
4. No recreational vehicles shall be parked or stored beyond the front line of the house;
5. Storage of trash barrels shall be shielded by shrubbery or behind the front line of the house;
6. This residential property shall be kept free of construction yard material within six months of the issuance of
a building permit.Voting in favor: WJS/WFS/JP/EM/GN1E.
The Board finds that the applicant has satisfied the provisions of Section 7 Paragraph 7.3 of the zoning bylaw and that
such change,extension or alteration shall not be substantially more detrimental than the existing structure to the
neighborhood. .
Upon a motion by Walter F. Soule and 2ud by John Pallone,the applicant was allowed to withdraw without prejudice

Dear Sir or Madam,
The occupant of 5 Longwood Ave. has continued to cut down trees and vegetation on
town owned land(Maplewood Avenue, a paper street running parallel to Hewitt Ave. ).
Additionally,the occupant of 5 Longwood Avenue has filled in areas on this paper street
that were described as wetland by the North Andover Conservation Commission Agent.
The land filling involved construction debris and household trash that was bull dozed,
covered and graded. It appears that unregistered vehicles (a truck and camper) are also
stored on the town property. Additionally,yard waste,brush and branches, discarded
household fixtures and other debris have been dumped on this public property.
The occupants of 5 Longwood Ave. received a zoning variance with conditions to which
they have not fully complied. Information about non-compliance has been conveyed on
previous occasions to the Building Inspector.
I would appreciate your attention to this situation as it is my understanding that said paper
street(Maplewood Ave.) is town property and is 40 ft. in width and parallel to Hewitt
Ave. as shown on plot plans on file with the Town of North Andover. The destruction of
wetlands and the cutting of trees and vegetation on public lands is a violation of town by-
laws and should be investigated and appropriate enforcement carried out. I would
appreciate hearing from you concerning any actions taken.

RE: Request for Variance: 5 Longwood Avenue,North Andover,MA
A. The particular use proposed for the land and structure.
We are requesting a variance for the front set-back for purpose of adding a second floor for 3
bedrooms and 1 bathroom. The right side and rear set-backs are less than the current required set-
backs due to pre-existing conditions.
B. The circumstances relating to soil conditions,shape or topography of such land or
structures especially affecting the property for which the variance is sought which do not
affect generally the zoning district in which the property is located.
The only construction we are proposing relative to soil and topography is to the left side of the
house, which is a one story addition and falls within the zoning set-backs.
C. Facts which make up the substantial hardship,financial or otherwise,which results from
literal enforcement of the applicable zoning restrictions with respect to the land or building
for which the variance is sought.
The existing house is in violation of current zoning due to right side and rear set-backs. The dept
of the remainder of the house is only 18 ft. We are proposing to add a 2"d floor to this area and to
accommodate a hallway, 22 ft. is needed. The building department told us that no more than a 2
ft. overhang is acceptable for front and back.
D. Facts relied upon to support a finding that relief sought will be desirable and without
substantial detriment to the public good.
The required front set-back is 30 ft. Our front overhang on our proposed plan is 28.9 ft., which is
1.1ft over this set-back. This 1.1 ft will not cause any substantial detriment to the public good.
E. Facts relied upon to support a finding that relief sought may be given without nullifying or
substantially derogating from the intent or purpose of the zoning bylaw.
Where the original house sits is 30.9 ft. from the front property line. It will certainly not be
noticed that the house is 1.1 ft. closer than the zoning by-law. The intent of the by-law as we
understand it is too keep sufficient distances at the front,rear and sides of the buildings. The
right side and rear are pre-existing conditions we had no control over.
F. Submit RDA from Conservation Commission when Continuous Buildable Area is applied
for in ZBA application.
