Got Complaint January 8t'about Ramp complaint at the end of the plaza.
Researched plaza building Permits and determined plaza was built prior to 1975 therefore ADA has no
jurisdiction and faxed info to Architectural Access Board.
Called owners of plaza and explained situation Anne Marino @horizons Management 781 407 7799 x202
Anne scheduled an engineer to evaluate problem and asked for the Boards complaint.
Due to weather conditions a correction will be completed early spring. Tentative correction will be to
remove ramp and create a new ramp in a better location to serve all businesses in plaza. Rocky's is
accessible but other stores are not.

Before the complaint is rocessed we would like to obtain co ies of all the building permits

since June of 1975. The Board needs the permits to determine whether or,not we have
jurisdiction under Section 3.3.

Please be advised the Plaza and Burger King at 50 Peters Street was constructed right around 1970 according to
assessors records attached. The Building department has gone through several moves and floods and our files
don't show the actual building permit information. However I eon the owner of the playa North Andover
Ventures Limited Partnership,and advised them of the situation. The owners were extremely sympathetic of the
complaint and will be addressing the situation ASAP. The curb cut in question is extremely steep and due to
limited space and topography and roadway need to be reconfigured by an engineer. The matter is going forward
and should be revised by springtime.

25.6 Each Ramp shall have level platforms for turning and resting, which
shall be forty-eight (48) inches minimum, unob*ucted by door swings,
entrances, or other Projections. Such platforms shall occur at inter
(32) feet, wherever a ramp changes
direction, and at top and bottom of ramp.

25.4 Handrails shall be set on both sides of ramps in pairs, one at a height
U? thirty-four (34) inches, and a lower one at a height of nineteen
(19) inches, measured vertically from the surface of the ramp. Hand-
rails shall extend at least twelve (12) inches beyond the top and
bottom of the ramp, but need not so extend if it would cause a safety
hazard. The handarip portion of the handrails shall not be less than
one and one-quarter 0 14) inches nor more than two. (2) inches in
outside diameter, shall be round or oval in cross-section, and shall
have a smooth surface with no-sharp corners. A clearance of one and

25.5 Ramps shall have a surface that is non-slip and shall not be carpeted
except with carpeting specified as high density, low pile, non-ab-
sorbant, stretched tautly, securely anchored, and without padding.
Carpet ending in the path of travel must be secured with an amino
strip no higher than three-eighths (3/8) of an inch.

26.4 The accessible entrance(s) shall be on a level which permit access to

26.6 Obstacles shall not impede the path of travel. Objects which protrude
into entranceways, (suspended lights, signs, fixtures, door closers,
etc.) shall be at a height of not less than eighty (80) inches above
the floor.
26.7 Identification: Any entrance of a facility not accessible by persons in
wheelchairs shall have a sign clearly indicating the location of the
accessible entrance.

ENTRANCES 26
26.1 The primary public entrance(s) of a building shall be accessible by
persons in wheelchairs.
26.2 The approach to such entrance(s) shall be a paved walk or ramp with
a non-slip surface, uninterrupted by steps; and such entrance(s)
shall have a level space sixty (60) inches from the door, on the interior
and exterior of the entrance doors. Eighteen (18) inches clear floor
area shall also be provided on the latch, pull side of the doors:
26.3 Vestibules: Between any two hinged or pivoted doors, there shall be
a minimum of forty-eight (48) inches plus the width of any door swing-
ing into the space.

Per our conversation this morning,the proposed re-paving project at the above referenced
site does not require the filing of a Notice of Intent provided the paved area is not
expanded and the grades stay the same. This includes the existing paved area behind the
building that lies within the 100-foot buffer zone of wetlands.
