RE: Design Analysis for Siting Subsurface Sewage Disposal System on 500 Boxford Street-Lot 1
& 2 (Map 105C, Lot 42)
Dear Mr. LaGrasse:
The following discussion intended to illustrate our analysis in siting the proposed subsurface
sewage disposal systems and buildings on Lot 1 and 2 at 500 Boxford Street.
310 CMR 15.232 (6), states, "Absorption trenches should be used whenever possible." It is
our opinion that alternative systems have their place where absorption trenches are not practical or
possible, such as replacement of failed systems. With this in mind, the houses and septic systems
were moved around the lots and resized to accommodate the Tide V setbacks and to the maximum
extent possible, the North Andover Board of Health and Conservation setbacks. Specifically,
Lot 1
The house was designed to accommodate the building setback requirements. As shown, the
footprint of the dwelling minus the garage is approximately 1,300 s.f. The septic system was
placed at the rear of the building and approximately 63 feet from the wetlands. Moving the
septic system to the front of the lot as close to the lot line setbacks as possible, still required
a variance for the setback to the wetlands. Another problem is that the building will not fit
within the building setbacks as shown on the accompanying sketch. Additionally,
construction of the driveway to the building would require work within the Conservation
"25 foot no disturb zone".
Lot 2
A similar analysis was performed on Lot 2. Moving the septic system in front of the
proposed dwelling, would require the house to be set back 44 feet from the front lot line in
order to meet the Tide V setback requirements. This would move the building within the 50
foot building setback from the wetlands. Also, the system would be within 100 feet of the
existing well. However, we were able to move the system closer to the front lot line
providing a greater setback from the wetlands of approximately 74 feet.

The septic systems shown on these two lots meet all the requirements of Tide V as required.
The relief requested is for the setback to the wetlands. We believe the building and septic
system configurations provide the least environmental impact to the area.
Accompanying this letter, please find the revised Subsurface Sewage Disposal Plan for Lot 2
dated August 17, 2016. As stated above, the system was moved closer to the front lot line to
provide more of a separation from the wetlands. Since the system on Lot 1 as shown on the plans
dated July 7, 2016 remained the same, the plans were not resubmitted.

The following is in response to the review comment as outlined in your letter dated June 27,
2016:
Response: The Assessor's Map and Lot numbers have been added to the title block and on
sheet 2.
1. The existing and proposed lot lines should be depicted on the design plan. On page two of three,please depict the oyzginal
three lots and overlay the proposed two lots being created with the proposed dwellings,proposed ystems and all lot line
setbacks, the 100'wetland buffer done, 50'no build done and 25'no disturbance Zone.
Response: Sheet two of three has been updated with the information requested.
2. Note 7 is repeated as note 17.
Response: Note 17 has been removed.
3. Lot 1 asproposed does not have a benchmark and the benchmark on Lot 2 in not within 50-75'from the proposed ystem
(310 CMR 15.220(4)(q).
Response: A new benchmark has been added t
p o the plan.
4. Indicate why the soil absorption gstem cannot be proposedgreater than 100 feet from the wetland resource area and whyyou
cannot comply with section 3.9 of the North Andover Septic Regulations. There is an area in the southeast corner of the
proposed lot that isgreater than 100,feet from the wetland resource area. Please research alternative designs and site layouts
that keep the ystems out of the 100'buffer done or designs that achieve maximum feasible compliance. Please also note that
Section 3.8 of the North Andover Septic Regulations state that a DEP approved device or alternative technology which
reduces wastewater to levels below 30 mg/L BOD and 30mg1 L TSS can be approved by the department without a hearing
before the Board of Health. I have attached a rough sketch that shows 100 linear feet of primary and reserve trenches that
me out of the 100'as a rough demonstration.
Response: The layout of the trenches provided is not feasible. 310 CMR 15.232 (1) states "For
all gravity flow distribution systems, a water tight distribution box designed to
provide equal distribution of septic tank effluent to the distribution lines of the soil

Dear Mr. Koravos,
The proposed wastewater system design plan for the above site dated May 24, 2016, Revised on
June 15, 2016 and received on June 21, 2016 has been reviewed. Unfortunately, the plan cannot
be approved until the following items are corrected. The specific section in Title 5: 310 CMR
15.000, or North Andover regulation that is not met by this design follows each item where
applicable.
1. The existing and proposed lot lines should be depicted on the design plan. On page two
of three,please depict the original three lots and overlay the proposed two lots being
created with the proposed dwellings,proposed systems and all lot line setbacks, the 100'
wetland buffer zone, 50' no build zone and 25' no disturbance zone.
2. Note 7 is repeated as note 17.
3. Lot 1 as proposed does not have a benchmark and the benchmark on Lot 2 in not within
50 - 75' from the proposed system (3 10 CMR 15.220(4)(q).

which reduces wastewater to levels below 30 mg/L BOD and 30mg/L TSS can be
approved by the department without a hearing before the Board of Health. I have
attached a rough sketch that shows 100 linear feet of primary and reserve trenches that
are out of the 100' as a rough demonstration.
5. The wetland lines have not been confirmed or approved by the North Andover
Conservation Commission and may be subject to change. A preliminary site walk by the
Conservation Department may be beneficial and reduce additional revisions.
6. To ensure compliance with 310 CMR 15.211, please add a note stating that there is no
septic system on the easterly abutting property (Map 105.0 Block 0040) within 100' of
the proposed well or increase the area depicted on the plan and add 100' circumference
around the subject well.
7. On sheet 3 of 3, remove the "untreated building paper" above the peastone layer in the
soil absorption system. You may change this and use permeable landscaping fabric. The
use of the untreated building paper is not in compliance with Title 5 regulations and will
deteriorate rapidly once installed. This does not appear to accomplish the intended
outcome stated in your letter dated June 15, 2016.
8. Please submit an additional review fee of$125 with revised plans.

absorption system shall be provided between the septic tank and soil absorption
system." With the varying lengths of the trenches as shown on the sketch, the
trenches will not receive equal distribution per linear feet of trench.
5. The wetland lines have not been confirmed or approved by the North Andover Conservation Commission and may be subject
to change.A preliminary site walk by the Conservation Department may be beneficial and reduce additional revisions.
Response: The variance requested is required to file with the Conservation Commission. The
Notice of Intent filing will verify the wetland lines.
6. To ensure compliance with 310 CMK 15.291,please add a note stating that there is no septic ystem on the easterly
abutting property (Map 105.C Block 0040)within 100'of the proposed well or increase the area depicted on the plan and
add 700'circumference around the subject well.
Response: A 100 foot arc centered on the proposed well was added as requested.
7. On sheet 3 of 3, remove the "untreated building paper"above the peastone layer in the soil absorption ystem. You may
change this and use permeable landscaping fabric. The use of the untreated building paper is not in compliance with Title 5
regulations and will deteriorate rapidly once installed. This does not appear to accomplish the intended outcome stated in your

Response: TP-5 has been added to the design plan (sheet 1).
/ 4. The percolation test results should indicate a percolation rate of<2 minsl inch.
Response: The less than symbol has been added to the percolation rates.
5. On sheet 1 of 3, the graphical representation of the test pits should be shown as they were excavated instead of circles as
depicted in the site plan view.
Response: The rectangular test pit symbols have been added to the plan.
6. Indicate why the soil absorption ystem cannot be proposed greater than 100 feet from the wetland resource area and
maintain compliance with section 3.9 of the North Andover regulation. There is an area in the southeast corner of the
proposed lot that isgreater than 100 feel from the wetland resource area.
Response: Considering the required setbacks from the property lines and the required size of
the proposed septic system, the area outside the 100 foot wetland buffer zone in the
southeast corner of the lot is insufficient to contain the system.
7. No benchmarks were depicted on the design plan (3 10 CMB 220(4)(8)).

Response: A benchmark has been added to the plan and a.note stating additional benchmarks
will be set prior to construction.
8. The foundation drain location and elevation were not depicted on the de ign plan (NA 3.2).
Response: The foundation drain has been added to the plan on sheet 1. Also on sheet 1 note
17 was added indicating the setback requirements.
9. Depict the setback distance from the proposed well to abutting soil absorption ystems to ensure compliance with 310 CMR
fj 15.211.
Response: To the south of the proposed well, a 100 foot offset is within the right-of-way of
Boxford Street. The westerly property line is within 28 feet of the wetland on the
abutting property. The 100 foot offset from the proposed well is approxunately
twelve feet from the lot line and 18 feet from the wetlands. The easterly lot line of
the property is approximately 125 feet from the proposed well.
V 10. On sheet 3 of 3, the loading (H-10 or H-20) of the septic tank was not depicted on the design plan (3 10 CMR
15.226(3)).
Response: Note 3 on sheet 3 has been added stating that the septic tank shall meet H10
loading requirements.
11. 6"of crushed stone is required beneath the distribution box(310 CMR 15.221(2)).
Response: In the "Concrete Distribution Box" on sheet 3, note 3 was added stating that 6
inches of crushed store is required beneath the distribution box.
12. On sheet 3 of 3, explain the purpose for the "untreatedbuilding paper" above the peastone layer in the soil absorption
ystem. Also explain how the use of the untreated building paper is in compliance with Title 5 regulations.
• Response: The "untreated building paper" is provided to assistin preventing fines from
entering the stone trenches and help minimize surface water from inundating the

I reviewed the four test pits proposed at 500 Boxford Street. All are within fairly level, open areas of the lot and appear
to be more than 50'from the BVW. I ask that when you access test pit#1 (the farthest in on the property)that you

Dear Mr. LaGrasse:
The following discussion intended to illustrate our analysis in siting the proposed subsurface
sewage disposal systems and buildings on Lot 1 and 2 at 500 Boxford Street.
310 CMR 15.232 (6), states, "Absorption trenches should be used whenever possible." It is
our opinion that alternative systems have their place where absorption trenches are not practical or
possible, such as replacement of failed systems. With this in mind, the houses and septic systems
were moved around the lots and resized to accommodate the Title V setbacks and to the maximum
extent possible, the North Andover Board of Health and Conservation setbacks. Specifically,
Lot 1
The house was designed to accommodate the building acrequirements.uirements. As shown, the
footprint of the dwelling minus the garage is approximately 1,300 s.f. The septic system was
placed at the rear of the building and approximately 63 feet from the wetlands. Moving the
septic system to the front of the lot as close to the lot line setbacks as possible, still required
a variance for the setback to the wetlands. Another problem is that the building will not fit
within the building setbacks as shown on the accompanying sketch. Additionally,
construction of the driveway to the building would require work within the Conservation
"25 foot no disturb zone".
Lot 2
A similar analysis was performed on Lot 2. Moving the septic system in front of the
proposed dwelling, would require the house to be set back 44 feet from the front lot line in
order to meet the Title V setback requirements. This would move the building within the 50
foot building setback from the wetlands. Also, the system would be within 100 feet of the
existing well. However, we were able to move the system closer to the front lot line
providing a greater setback from the wetlands of approximately 74 feet.

The septic systems shown on these two lots meet all the requirements of Title V as required.
The relief requested is for the setback to the wetlands. We believe the building and septic
system configurations provide the least environmental impact to the area.
Accompanying this letter, please find the revised Subsurface Sewage Disposal Plan for Lot 2
dated August 17, 2016. As stated above, the system was moved closer to the front lot line to
provide more of a separation from the wetlands. Since the system on Lot 1 as shown on the plans
dated July 7, 2016 remained the same, the plans were not resubmitted.

The property in question has been in the Donovan family since 1946, when
Cornelius and Catherine Donovan, parents of the current owners, purchased
this site containing 5.24 Acres, more or less.
In December of 1970, Catherine Donovan hired Stowers Associates to
survey the land and subdivide it into 4 lots. The subdivision plan was endorsed
by the Planning Board on April 4, 1977 and recorded at the Registry of Deeds
on April 8, 1977. The plan showed Lots A, B, C and D and a copy of the plan is
attached.

On January 5, 1992, Catherine Donovan conveyed the lots to her children.
Her daughter, Kathleen Garon, was deeded Lot A. Her sons, Michael Donovan,
Thomas Donovan and Cornelius Donovan were deeded Lots B, C and D
respectively. Each child had expectations of building a house on each of the
lots. In fact, Kathleen built a house on Lot A.
Over the years, since the land was subdivided in 1970, regulations have
changed and become more restrictive. It is now impossible for any of the three
brothers to build on their lot, primarily due to the North Andover Minimum
Requirements for Onsite Wastewater Disposal Systems.
Michael, Thomas and Cornelius Donovan are proposing to reconfigure their
three individually owned lots into two new lots. Based on this new configuration
we have completed percolation tests and test pits for the two lots and have
designed subsurface sewage disposal systems. The designs comply with all of
the requirements of Title 5 and also comply with the North Andover Minimum
Requirements with the exception of the distance to a wetland resource area.
Title 5 requires a 50 ft. setback from a wetland, for which we comply, but North
Andover requires 100 ft. It is this section of the regulations that we request a
variance.
The applicants believe they qualify as seriously aggrieved parties and are
eligible for a variance.
Enforcement of the setback distance provisions in the local requirements
would be manifestly unjust since it would render lot B, owned by Michael
Donovan, and lot D, owned by Cornelius Donovan unbuildable. Lot C contains
an abandoned dwelling and is owned by Thomas Donovan.
Testing has been completed for two newly configured lots. During our field
surveys and testing no soils or site conditions were noted that would be unique
to the Town of North Andover. The conditions observed are similar to those we
have seen in surrounding towns in the Merrimack Valley. Two systems have
been designed to comply with Title 5 and all of the provisions of the North
Andover Requirements with the exception of the distance to wetlands. On lot 1
we can provide 63 ft. and on lot 2 we can provide 65 ft.
Enforcement of the 100 ft. setback distance would render lots B and D
unbuildable and deprive Michael Donovan and Cornelius Donovan of all
beneficial use of their property.

By allowing the variance, the brothers can eliminate the existing abandoned
house and it ancient septic system and only two dwellings will be built, with
modern sewage disposal systems.

To Whom It May Concern:
- The proposed wastewater system design plan for the above site dated May 24, 2016 with a final
revision date of August 17, 2016 and received on August 18, 2016 has been approved subsequent
to the Public Hearing on September 13, 2016. Your variance request from the North Andover
Septic Regulations, Section 3.9 has been approved and the setback from the soil absorption
system has been reduced from 100' to 73.7'.
The design has been approved for use in the construction of a new on-site septic system for a 4-
bedroom (maximum of 9 total rooms) home utilizing a gravity leach field system. This design
plan approval is valid until October 7, 2019.
During this time, a licensed septic system installer must obtain a permit and complete this work,
and a Certificate of Compliance be endorsed by the installer, designer and the Town of North
Andover.
This approval is also subject to the following conditions:
1. Prior to the issuance of the Disposal Works Construction Permit,the applicant must
submit a foundation as-built at the same scale as the approved plan

2. Prior to the issuance of the Disposal Works Construction Permit,the applicant must
submit the floor plans of the proposed dwelling showing no greater than 4 bedrooms
or a total of 9 rooms.
3. If site conditions are found in the field to be different from those indicated on the
design plan and/or soil evaluation, the originally issued Disposal System Construction
Permit is void, installation shall stop, and the applicant shall reapply for a new
Disposal Systems Construction Permit(3 10 CMR 15.020(1)).
4. It is the responsibility of the applicant and/or the applicant's septic system designer,
septic system installer or other representative to ensure that all other state and
municipal requirements are met. These may include review by the Conservation
Commission, Zoning Board, Planning Board, Building Inspector, Plumbing Inspector
and/or Electrical Inspector. The issuance of a Disposal System Construction Permit
shall not construe and/or imply compliance with any of the aforementioned
requirements.

Hi Jim, I took a look at the test pit applications and believe that there is ephemeral pool habitat in this area,which will
require the test pits to be at least 75'from the wetland. Please revise the sketch to show that the test pits are at least

reviewed?

Per your telephone conversation with Bill MacLeod on Tuesday June 30, 2015, I have attached a
concept plan for your review. The plan depicts three existing lots at and adjacent to 500 Boxford
Street and a plan depicting a proposal to reconfigure the parcels into just two lots. In the
proposed condition, the existing dwelling will be demolished and two new dwellings
constructed. The proposal will require a variance from the Board of Health to permit
construction of the two soil absorption systems fifty feet from a wetland where 100 feet is
required. Mr. MacLeod wishes to meet with you to discuss the concept and to obtain your
opinion as to how the Board will react to the proposal.

As per our conversation regarding 500 Boxford street. Its 3 lots. One lot has a house on it. They are reconfiguring down
to 2 lots and 2 houses.They want to put the systems 50 ft from the wetland. They don't want to spend any money if

AND PUBLIC HEARING AT NORTH ANDOVER
BOARD OF HEALTH
Notice is hereby given that the North Andover Board of Health will hold a Public hearing on
June 28, 2016, at 7:00 p.m. in the Community Room of the North Andover Police Dept.,
1475 Osgood Street,North Andover,Mass. upon the petition of Michael Donovan,
Thomas Donovan and Cornelius J. Donovan.
The applicants have requested a variance from the North Andover"Minimum Requirements
For The Design, Construction And Maintenance Of Onsite Wastewater Treatment And Disposal
Systems"
Plans have been prepared for the design of sewage disposal systems for 2 lots.
The designs comply with all of the requirements of Title 5 and also comply with the North
Andover Minimum Requirements with the exception of the distance to a wetland resource area.
Title 5 requires a 50 ft. setback from a wetland, for which the plans comply, but North Andover
requires 100 ft. It is this section of the regulations that a variance is requested.
The applicants believe they qualify as seriously aggrieved parties and are eligible for a
variance.
Enforcement of the setback distance provisions in the local requirements would be
manifestly unjust since it would render land owned by Michael Donovan and land owned by
Cornelius Donovan unbuildable and deprive Michael Donovan and Cornelius Donovan of all
beneficial use of their property.
Plans and forms submitted may be viewed at the Health Department office at 1600
Osgood Street,North Andover, MA during regular business hours.
