Fournier & Irene Herbert By: Merrimack Engineering Services Dated: July 30, 2002 Approved By No. Andover Planning Board on 8/29/02 Dear Mr. Nicetta: I appreciate the opportunity�you afforded I m e on Novern ber 261 to . discuss several particular issues I have with regard to the proposed sub -division plan referenced above. In addition to the concerns I expressed in my letter dated November 26"h, 2002 regarding the proposed sub- division, I would also like to include the following concerning Lot #3 showno.n the proposed plan (excerpt of plan attached), which became evident subsequent to our conversation. According to the Town's Zoning Bylaws dated 1972 and amended May 2001, lot #3 is also a non- conforming lot for the following reasons: In consideration of section 7.2 Street Frontage, the second paragraph stipulates that no portion of the minimum lot area or lot frontage shall be included within the limits of a street. A sliver of land 2.5'wide by approximately 55' long must be discounted in the lot area and dimension calculations. Further, the remaining width of the rectangular western segment of Lot #3 becomes 47.5'. Applying consideration of section 7.1.3 Restrictions, this narrow rectangular segment must be further discounted in the area calculation since a 50' straight line can be drawn to divide the lot into two with the perimeter of the narrow segment exceeding 200'. By excluding said portion of land, the remaining area of lot #3 is approximately 10,100 sf, thus does not, meet the minimum lot size requirement of 12,500 sif. I understand that a request for'a building permit for the subject parcel has not'been made and that once a request is made, then at that time, the proposed plan will be closely reviewed by yourtle rtment. As I expressed in my previous letter, as an abutting property owner to this rming development proposal, I have serious concerns that this proposal will have a JAN 14 20037 BOARD OF APPEALS 1 of 2 detrimental effect on my property value and others within the neighborhood. I respectfully request to be informed of any special permits or variances under consideration for this site. I trust public meetings to discuss the variances or special permits will be held, for which, I, along with other abutters, will receive appropriate notification.
