The permit in question is for the construction of an addition to an existing, single family dwelling for the purpose of converting the single family into a two family dwelling, as indicated on the applicant's building permit application. The application also indicates that the parcel (#0035, located on Map #044) consists of 15,089 square feet and is located in a Residential 4 District. Upon examination of Map #044, the location of the proposed addition is more accurately described as located on Parcel# 0035 consisting of+/-4800 square feet and Parcel # 0009 consisting of+/-10,200 square feet. Both lots are on file and have been recorded with the Essex County Registry of Deeds, and have existed as separate lots according to the subdivision plan on file. A check with Zoning Bylaws Section 4, Subsection 4.122 Building and Uses Permitted,Residence 4 District,Paragraph 14 provides for One or two-family dwellings, including the right to convert any existing dwelling to accommodate not more than five(5)family units by Special Permit from the Zoning Board of Appeals after a public hearing with due notice given provided: a. No major exterior structural changes shall be made which alter the character of the existing neighborhood The right to convert shall apply to any dwelling under the ownership of one single person, partnership or corporation to be converted as a dwelling of not more than five (5) family units, and meeting all requirements of the State and Town Statutes and Bylaws, including the Health Codes, Building Codes,Zoning Laws,and Zoning Bylaws. Additionally, an exception to Zoning Bylaws Section 7, Subsection 7.8 exists specifically to lots in a Residential 4 District. Paragraph 2 states: I In Residential 4 (R4) Districts only, two or more vacant lots, mutually adjoining, may with a Special Permit from the Board of Appeals be permitted to be combined into a new lot or lots of not less than 10,000 square feet each, and with not less than 100 feet street frontage, provided it be shown to the Board of Appeals that each such lot was lawfully laid out and duly recorded by plan or deed prior to January 9, 1957 and the Building Inspector shall permit the construction of one single family dwelling on each such 10,000 square foot lot. We believe that Building Permit # 59 seeks to alter an existing single family dwelling, currently located at#51 Parker Street,North Andover, MA. an R4 District and is in conflict with Section 4 of the Zoning Bylaws governing the Right to convert such a dwelling, as provided for in Paragraph 14 without a Special Permit after a public hearing. We fiuther believe that Building Permit # 59, indicating the parcel as only Parcel # 0035 located on Map #0044 of the Assessor's map seeks to combine two lots, (Parcel # 009 and Parcel#0035) in an R4 District. Such a combination of the above separate lots is in conflict with Section 7 of the Zoning Bylaws paragraph#2,pertaining to Exceptions specific to the R- 4 lot and further,Permit#59 seeks to construct an addition to construct a two family dwelling. Additionally, any exception under this section must be granted a Special Permit form the Board of Appeals,and such an exception is for the construction of a single family dwelling on the combined lot. In order to accomplish the construction, as requested on the application for Permit #59, and existing structure,a one and one-half story two stall garage, located on parcel#0035, must be demolished on the parcel identified on the Assessors map and recorded as lot # 0035 at the Essex County Registry of Deeds consisting of+/- 4800 square feet, and an addition must be constructed to alter the existing single family structure located entirely on parcel #009 of the Assessor's Map#044, and recorded with the Registry of Deeds of Essex County, said parcel consisting of+/- 10,000 square feet. The Zoning Bylaws required a Special Permit,granted by the Board of Appeals for the right to convert an existing structure, located in an R-4 District to a maximum of five family units. The Bylaws also require a Special Permit, granted by the Board of Appeals to combine lots in an R-4 District,and speak directly to said lots being vacant and said construction to be limited to single family dwellings per 10,000 square feet Since the Zoning Bylaws speak to the right to convert dwelling in the R4 District and to combining separate lots in the R4 District and both actions require the necessity of a special permit issued after a public hearing, we believe Building Permit #59 is in conflict with the applicable Zoning Bylaws,and should be investigated. Page 2 of 3 Additionally, since Building Permit # 59 has already been issued, we would request an immediate response to include the suspension of any construction authorized by Permit #59 for a reasonable time,and until completion of an investigation with written findings. A check with Zoning Bylaws Section 4, Subsection 4.122 Building and Uses Permitted,Residence 4 District,Paragraph 14 provides for One or two-family dwellings, including the right to convert any existing dwelling to accommodate not more than five (5) family units by Speciia1eP nnit from the Zoning Board of Appeals after a public hearing with due notice given provided: a. No major exterior structural changes shall be made which alter the character of the existing neighborhood The right to convert rt shall apply to any dwelling ,under the own-ership of one single person, partnership corporation p p or ration rpo to be converted as a dwelling of not more than five (5) family units, and meeting alt requirements of the State and Town Statutes and Bylaws, including the Health Codes, Building Codes,Zoning Laws,and Zoning Bylaws. Additionally, an exception to Zoning Bylaws Section 7, Subsection 7.8 exists specifically to lots in a.Residential 4 District. Paragraph 2 states: In Residential 4 (R-4) Districts only, two or more vacant lots, mutually adjoining, may with a Special Permit from the Board of Appeals be permitted to be combined into a new lot or lots of not less than 10,000 square feet each, and with not less than 100 feet street frontage, provided it be shown to the Board of Appeals that each such lot was lawfully laid out and duly recorded by plan or deed prior to January 9, 1957 and the Building Inspector shall permit the construction of one single family dwelling on each such 10,000 square foot lot We believe that Building Permit # 59 seeks to alter an existing single family dwelling, currently located at#51 Parker Street, North Andover, MA an R-4 District and is in conflict with Section 4 of the Zoning Bylaws governing the Right to convert such a dwelling, as provided for in Paragraph 14 without a Special Permit after a public hearing. We further believe that Building Permit # 59, indicating the parcel as only Parcel # 0035 located on Map #0044 of the Assessor's map seeks to combine two lots, (Parcel # 009 and Parcel #0035) in an R-4 District. Such a combination of the above separate lots is in conflict with Section 7 of the Zoning Bylaws paragraph#2,pertaining to Exceptions specific to the R- 4 lot and further,Permit#59 seeks to construct an addition to construct a two family dwelling. Additionally, any exception under this section must be granted a Special Permit form the Board of Appeals,and such an exception is for the construction of a single family dwelling on the combined lot. In order to accomplish the construction, as requested on the application for Permit #59, and existing structure, a one and one-half story two stall garage, located on parcel#0035, must be demolished on the parcel identified on the Assessors map and recorded as lot # 0035 at the Essex County Registry of Deeds consisting of+/- 4800 square feet, and an addition must be constructed to alter the existing single family structure located entirely on parcel #009 of the Assessors Map#044, and recorded with the Registry of Deeds of Essex County, said parcel consisting of+/- 10,000 square feet. The Zoning Bylaws required a Special Permit,granted by the Board of Appeals for the right to convert an existing structure, located in an R-4 District to a maximum of five family units. The Bylaws B 1 also require equine a Special Permit, granted b the Board of Appeals Y to combine lots PPe in an R-4 District, and speak directly to said lots being vacant and said construction to be limited to single family dwellings per 10,000 square feet. Since the Zoning Bylaws speak to the right to convert dwelling in the R4 District and to combining separate lots in the R4 District and both actions require the necessity a Pe of special permit issued after a public hearing, we believe Building Permit #59 is in conflict with the applicable Zoning Bylaws,and should be investigated.
