Parts of a very large tree has been cut up,the brush piled up on the front lawn for the past several years. The set back from the roadway is very narrow. Given the unusual warm winter, lack of rain,anticipated drought, I believe that this issue on the property poses a potential fire hazard. Additionally,this property is on a main roadway which is heavily traveled all day long. It is near an elementary school where the temptation of curious children setting fire could be realized. Realizing that this is private property and the town may not be in a position to make the property owner responsible for clearing the front of his property of this danger, I feel it is worth the effort to approach the owner in order to request that he remove the debris from the front of his yard. If need be,to make arrangements with the DPW to remove the brush at least. I know DPW makes every effort to remove storm debris if it is moved to the side of the road. However, in this situation it would not be possible to move the large amount of brush without considerable obstruction to the side walk, Mass Ave, (the heavy road traffic conditions during the day and evening)and to students walking to school etc. This tree may be a town tree since it is clearly on the edge of the property. Therefore,worth to note the safety concerns of the diseased tree so close to this well traveled roadway. I am sending this information to you as a concerned citizen of North Andover in pointing out to you,as Fire Chief,the potential fire safety.Additionally,the danger of this diseased tree falling onto the roadway,on the home as well as blocking the front exists from the home or entrance for the Firefighters,who so ably protect the safety of the community. While I am not a direct abutter to this property,I drive by everyday as do you and many other people. I wanted to let you know that staff members have been out#514 Massachusetts Avenue and have met with Mr. Ippolito to discuss his property conditions. My staff is working with Mr. Ippolito to address some of the concerns in your email. Areas that are out of our jurisdiction or authority cannot be addressed legally but we have asked Mr. Ippolito to be cooperative. The fire department, although not under my authority, has also been to the property to inspect the conditions. It is my understanding that Mr. Ippolito is working with the fire department to address any of their concerns. I hope that you will see a difference over the next few weeks. Michele and I walked the property with the owner,Tom Ippolito. We observed the following in relation to the complaint: 1) Many bags of trash and various debris through out the property. Only 2 bags of trash near two new trash cans with lids. No health issue. 2) Discarded bottles and containers. We also do not know what might be in the containers. Some of them appear to be bleach containers, and who knows what potential hazardous liquids could be in them. 2 (1) gallon containers of old oil from an oil change that he will properly dispose of. 3) An unregistered and abandoned car that has been there for nearly 15 years. It's leaking. 1 registered and 2 cars unregistered. Not causing a health issue. 4) An unregistered and abandoned pickup truck. It is leaking, too. No leaks observed 5) Both vehicles are filled with junk and there is also junk piled up on top of them as well. No excessive junk that would be considered a health issue observed 6) Additional junk and debris is piled up on the porch, and in the yard, and there is now a tarp partially concealing the door where more junk is piled up. No violations observed on the porch. No hanging tarp observed 7) 1 am also told that there is junk on top of the roof that connects the house and the barn. Tarps are likely for roof leaks. These are not health issues 8) Also concerning me are the truck tires and other open containers on the property. As you know, these tend to be a great breeding ground for mosquitoes and other insects and could become a hazard. No containers observed. Discussed swimming pool. He plans to open it this summer. 9) We are also concerned about wild animals loving under his barn and more than one cat inside the home.Wildlife is not considered a heath issue, however, None was observed. Note, there is no limit in NA for the number of cats one might own. 10) There is also wood and fencing piled on the property, which would pose insect infestation issues. In addition, there is a tree that fell on his front yard that looks like it hit his house, but he has not done anything about it yet, although he hung some nice aluminum foil balls on it. The tree is not causing a hazard. It appears to have fallen mostly on his property and missed the house by inches. The fence condition is not a health issue. In conclusion, current conditions observed at this property do not violate any sanitary or health codes at this time. The Health Dept will not be issuing any violations in this matter. The Town did require him to make some changes to the condition of the property in the recent past but since then it appears that he has lost his job and the situation is worse than ever. His house is jammed full of clutter which presents a health issue and a hazardous situation for Tom and for safety personnel. Please do something about this situation. Perhaps the Board of Health can get involved, as well as the Building Commissioner to deal with Zoning Enforcement.
