Long: The Board of Appeals held a public hearing on Monday evening, July 9 , 1984 upon the application of Robert Bennett and Linda Jeffrey. The hearing was advertised in the North Andover Citizen on June 14 and 21 , 1984 and all abutters were notified by regular mail . The following member-s were present and voting: Frank Serio, Jr . , Chairman; Alfred E. Frizelle, Esq. , Vice- Chairman; Richard J. Trepanier , Esq. ; Clerk; William J. _-Sullivan; and Augustine 11. Nickerson. -_-The--petitioners seek a variance from--th-e -provisions of Section 7 , Paragraph 7 . 3 and Table 2 of the Zoning - By Law so as to permit relief from the side yard-=setback requirement to allow the Continued existence of- a single family dwelling -located at S2 Heml-ock- Street- --in -the Residential 4 (R-4)=Distr-ict . - - Mr,--Benn-ett --testified- that that- through-- an- engineering error , a portion of his dwelling does not meet the -side - setback re- quirement of 15 feet , but rather it is set back 13 . 4 feet from the lot line. A plot plan recently drawn revealed the slight violation. Upon a motion made by Mr . Trepanier and seconded by Mr . Frizelle, the Board voted unanimously to grant the variance as requested. The Board finds that Section 10 . 4 of the Zoning By Law. has been satisfied. In particular , the Board finds tha.t denial of the variance would create a hardship to the petitioner and that desirable relief may be granted without creating, a detriment to the- publ-ic good and without nullifying or substantially derogating from- the- intent and purpose of the Zoning -By Law.
