In the event there is more than one principal, it is understood that both parties are jointly and severally responsible for all obligations under this lease. 1. PREMISES The address is known as 52 Water Street, county of Essex, city/ state of North Andover, MA 01845. The space to be rented includes the following area(s): a first floor unit consisting of retail space identified as 52 Water Street, North Andover. The space is rented in good working condition. We made the necessary repairs to the walls, replaced ceiling tiles, updated the smoke detector and installed a new floor. Per our verbal agreement, we will prove two gallons of Benjamin Moore White Dove paint for you to paint the walls. Should additional retrofitting need to be done, the tenant is responsible for the expense and execution of the work only upon the approval of the Landlord. Changes to the unit must be requested in writing and approved by the Landlord prior to the commencement of the work. The space must be returned to its original design and finished with the same quality of workmanship consistent with the building within fourteen days of terminating the lease or moving. Any work not returned to its original state after thirty days will be completed by the Landlord at the tenant's expense. 2. TERMS OF THE LEASE The leased Premises may be used only for the operation of a Retail space and its associated office. The term will begin on February 1, 2017 and end on January 31, 2018. The rent will be paid in monthly installments of $750.00 ($9000.00 annually), without any deductions. Payments are due and payable no later than the first of each month during the term of the lease. Payments received after the 10h of the month will be assessed a $ 35.00 late fee. The Leasee will have the option to renew the lease for (2) one year options with an increase of an additional 3% after the second year. If the Tenant remains in possession of the Leased Premises with the written consent of the Landlord after the lease expiration date stated above, without exercising the renewal option, the Lease will be converted to a month-to-month Lease at an increase of 10% cost escalator per month under the same terms and conditions set forth herein, and each party shall have the right to terminate the Lease by giving at least two month's prior written notice to the other party. n 12. ATTORNEY'S FEES If we are compelled to incur any expenses including reasonable attorney's fees in instituting and prosecuting any action or proceeding by reason of default of yours, the sum or sums so paid by us with all interests, costs, and damages shall be deemed to be additional rent and shall be due from you to us on the 1St day of the month following the incurring of such respective expenses. A request for a Special Permit under Section 9, Paragraph 9.1, & 9.2 to allow expansion of office space to a non -conforming structure. The following members were present and voting: William Sullivan, Walter Soule, Raymond Vivenzio, and Robert Ford, John Pallone. Upon a motion by Raymond Vivenzio seconded by Walter Soule the vote was unanimous to Grant the Variances as to provide relief from lot dimension area of 20,997 square feet, the street frontage relief of 84.051, front setback relief of 16.31, side setback relief of 22.08' rear setback relief of 30' and lot coverage relief of 12 percent. A Special Permit Granted to allow for the expansion of office space to a non -conforming structure as shown on the plot plan for Robert & Claire Daigle dated February 12, 1996. Voting Members were: William Sullivan, Walter Soule, Raymond Vivenzio, Robert Ford and John Pallone. The hearing was advertised in the North Andover Citizen on 4.23.97 & 4.30.97 all abutters were notified by regular mail. 4 a7 l The petitioner has satisfied the provisions of Section 10, Paragraph 10.4 of the Zoning Bylaw and that the granting of these variances will not adversely affect the neighborhood or derogate from the intent and purpose of the Zoning By law. The Board finds that the applicant has satisfied the provisions of Section 9, para. 9.1 of the Zoning Bylaw and that such change,•extension or alteration shall not be substantially more detrimental than the existing non- conforming structure to the neighborhood. Notes The granting of the variance and Special Permit as requested by the applicant does not necessarily ensure the granting of a Building permit as the applicant must abide by all applicable local, state and federal building codes and regulations, prior to the issuance of a building permit as required by the Building Commissioner.
