Dear Mr. Long:
The' Board of Appeals held a public hearing on Monday evening,
January 10 , 1983 upon the application of James P. Hurrell . The
hearing was advertised in the North Andover- Citizen on December
23 and 30 , 1982 and all abutters were notified by regular mail.
The following members were present and voting : Frank Serio, Jr. ,
Chairman; Richard. J. Trepanier, Esq . , Clerk- Augustine W. Nickerson=
Raymond A. Vivenzio, Esq. ; and Walter F. Soule.
The Board rendered their decision at a Special Meeting held on
Tuesday evening, January 18, 1983 with members Serio, Trepanier,
Nickerson, Vivenzio, and Soule again present and voting.
The petitioner seeks a variance from the provisions of Section 7 ,
Paragraphs 7. 1, 7. 2 , 7. 3, and Table 2-'--of the Zoning By Lair so as
to permit relief from the side line requirements to allow the con-
struction of an addition and relief from the area and frontage re-
quirements tD allow the existing building to comply with present
zoning on the premises located at 522 Chickering Road.
The petitioner testified through counsel that the existing structure
does not meet the area and frontage requirements for the B-4 district.
In addition, the petitioner wishes to construct an addition to the
dwelling which will not meet the set back requirements of the Zoning
By Law. The use of the premises as a professional office will not
change . The,-addition is necessary to accomodate the current tenants
who are in- need pf additional office space .

Upon a motion made by Mr. Trepanier and seconded by Mr. Soule,
the Board voted unanimously to grant the variance subject to the
following conditions :
l. . That the plan be revised to show the removal of the stairwell
from the rear of the proposed addition;
2. That the parking area be as shown on the plan and that it be
paved in all areas as indicated on the plan.
The Board finds that the size of the dwelling and the lot creates
a hardship to the petitioner and that the relief requested will
not derogate from the intent and purpose of the Zoning By Law.
Further, the Board finds that each of the provisions of Section
10::4 of the Zoning By Law have been satisfied.

To the Board of Appeals,
Mr. Hurrell 's lot is 8,928 sq. ft. which is a very small piece
of land for what he proposes. The proposed plan shows existing
parking on Franklin Street, which is town property and not Mr. Hurrell 's
land. Mr. Hurrell does not own the 11,529 sq. ft. of usable land, but
only 8,928 sq. ft. as stated.
Franklin Street also has a water main with valves existing at
the intersection of Franklin Street and Chickering Road. This water
main services two houses on Franklin Street and one house on Allen
Street, with a. water hydrant on Franklin Street.
Making the building larger and increasing the number of tenants
will create a greater traffic problem for cars entering and exiting
onto Chicl�ering Hoad.
My :mother 's estate owns the land next to Pyr. Hurrell, and has to
put the house on a 12,500 sq. ft. lot and has to keen a rear set bac'_
of 20-30 feet, i,,here he is asking for a 15 foot set back.
Where is Mr. Hurrell going to put the sno•.v from plo-o!ing? iJill
it go next to my mother 's lot line, where the water run off will go
onto her and Louise R<;ndone 's land? The proposed plans shows no
catch basins.
Why were not all the people who live within 300 feet of 'Ir.
Hurrell 's land notified?
Weask the Board of Appeals not to grant this variance.

Road, I have observed the particular location and it is my opinion
that it should not cause any increased traffic problem in the.
area. The number of parking spaces seem ample for the amount of
business that will take place there. I have no objections whatso-
ever.
