DECISION
Petition #005-94
The Board of Appeals held a regular meeting on Tuesday, January
11, 1994 upon the application of First Street Development, Inc.
requesting a variation of Section 8, Paragraph 8.1(2) of the
Zoning Bylaw so as to permit a reduction of the required parking
spaces from 151 to 105 spaces on the premises located at 525
Turnpike Street. The following members were present and voting:
Frank Serio, Jr., Chairman, Walter Soule, Clerk, Raymond
Vivenzio, Robert Ford and John Pallone.
The hearing was advertised in the Eagle Tribune on December 28,
1993 and January 4, 1994 and all abutters were notified by
regular mail.
Upon a motion by Mr. Ford and second by Mr.Vivenzio, the Board
voted unanimously to ALLOW THE PETITIONER TO WITHDRAW WITHOUT
PREJUDICE.

Every application for action by the Board shall be made on a form
approved by the Board. These forms shall be furnished by the
Clerk upon request. Any communication purporting to be an
application shall be treated as mere notice of intention to seek
relief until such time as it is made on the official application
form. All information called for by the form shall be furnished
by the applicant in the manner therein prescribed.
Every application shall be submitted with a list of "Parties of
Interest" which list shall include the petitioner, abutters,
owners of land directly opposite on any public or private street
or way, and abutters to the abutters within three hundred feet
(3001) of the property line of the petitioner as they appear on
the most recent applicable tax list, notwithstanding that the
land of any such owner is located in another city or town, the
Planning Board of the city or town, and the Planning Board of
every abutting city or town.
*Every application shall be submitted with an application charge
cost in the amount of $25.00. In addition, the petitioner shall
be responsible for any and all costs involved in bringing the
petition before the Board. Such costs shall include mailing and
publication, but are not necessarily limited to these.
Every application shall be submitted with a plan of land approved
by the Board. No petition will be brought before the Board
unless said plan has been submitted. Copies of the Board's
requirements regarding plans are attached hereto or are available
from the Board of Appeals upon request.

The principal points upon which I base my application are as
follows: In order to retain the aesthetic beauty of the church,
comply with the fifty (50) foot setback requirement for parking on
Route 114 and to conform with Osco Drug Stores standard building
size requirement, the balance of the site allows for only 105
parking spaces. Osco Drug and Boston Chicken have stated that 105
parking spaces is more than adequate for the following reasons:
(1) the type of businesses that they operate lends itself to a
quick turnover of parking, (2) one combined parking lot for both
businesses, and (3) different peak hours of operation. Combining
those factors with the fact that 4,000 square feet in Osco is used
for storage and Boston Chicken does not need 3,400 square feet, but
to alter the size and shape of the church would take away from its
aesthetic beauty are factors that should be considered when
factoring in the parking requirements.

T'he principal points upon which I base my application are as
fol.lowe: In order to retain the aesthetic beauty of the church,
comply with the fifty (50) loot setback requirement for parking on
Route 114 and to conform With Osco Drug Store, standard hulloing
size t equi rerment , the ba 1aZce of the Five a,_ laws for ozily 105
parking spaces. Osco Drug and Boston Chicken have stated that 105
parking spaces is more than adequate. for the following reasons:
(1) the type of businesses that they operate lends itself to a
quick turnover of parking, (2) one combined parking lot for both
businesses, and (3) different peak hours of operation. Combining
those factors wi'� h the fact that 4,000 sq are feet .in Osco is used
for storage and Boston Chicken does not need 3,400 square feet, but
to alter ;:he sine ai.d s'jape of the
aesthetic beauty church would take away, from its
fcict ,ri; c are factors that should be considered when
in the parking requirements.
