Maureen Heinze, 55 Brightwood Ave. North Andover, requesting a Variance from the requirements of Section 7,
P7.1 &7.2&7.3 for relief of lot area,street frontage,front setback and side setbacks,of Table 2 in order to construct
a proposed deck to the rear of the existing house. And for a Special Permit from the requirements of Section 9, P9.1
&9.2 to construct said deck on a non-conforming lot to a non-conforming structure,within the R4 Zoning District.
The following members were present: William J. Sullivan, Walter F. Soule, Raymond Vivenzio, Robert Ford and John
Pallone.
The hearing was advertised in the Lawrence Tribune on 5125199&6/1/99 and all abutters were notified by regular
mail. No persons appeared in opposition to the petition.
Upon a motion made by Walter F. Soule and 21 by Raymond Vivenzio, the Board voted to GRANT a Variance from
the requirements of Section 7, P7.1 &7.3 for relief of area lot dimension, street frontage of 55',front setback of 20',
left side setback of 3',and right side setback of 7.5'in order to construct a deck according to the Plan of Land by:
Scott Giles, Registered Land Surveyor,#13972,dated 4112/99,and to GRANT a Special Permit from the
requirement of Section 9, P9.1 &9.2 to construct said deck on a non-conforming structure due to the unusual shape
of the lot. Voting in favor. William J. Sullivan,Walter F. Soule, Raymond Vivenzio, Robert Ford,and John Pallone.
Variance
The Board finds that the petitioner has satisfied the provisions of Section 10,paragraph 10.4 of the Zoning Bylaw and that the
granting of these variances will not adversely affect the,neighborhood or derogate from the intent and purpose of the Zoning Bylaw.
10.4 Variances and Appeals
The Zoning Board of Appeals shall have power upon appeal to grant variances from the terms of this Zoning Bylaw where the
Board finds that owing to circumstances relating to soil conditions,shape,or typography of the land or structure and especially
affecting such land or structures but not affecting generally the zoning district in general,a literal enforcement of the provisions of
this Bylaw will involve substantial hardship,financial or otherwise,to the petitioner or applicant,and that desirable relief may be
granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent or purpose
of this Bylaw.
