The Health Department has no objections to the project per se;however, before any permits are issued or construction begins, the property must be tied into the municipal sewer and the existing septic system abandoned. Specifically, since the property is in the Lake Cochiewick Watershed: • the septic tank must be pumped and removed from the property; • the pipes of the leaching facility must be found and removed from the property; and the contaminated soil in the leach area must be removed and disposed of at an appropriate site. o SYSr2-( oLD 72) SQF 44-W o✓ dlsos cD w 'i R.#A- I 11 1 lil IIliinn1111n1111111111111 !11!ii1111n1I11®1111111111111 III l111111111®111111111111111 sY , 11 _ 1111111111►IIIIIIIIIIIIIiI I1ii11111111111n11111111111111 11111111I11111111111I11111ME 1111.,n./1I1111n111I111111111I kI►IIIIIIIIIIo/1®111/IIIIIIII111 11111I11/i.1III®1111111111111 1In1IIIe111I11!IIIIIIIIIIIIII ME111In111111i1®11111111111111 p,1 !! 111®11111111111111 1•e1.11®11111II1II11I11 :a IIAn1111l1111111111111111111 . I1I11111!Iinitl111111111I1I 11A1111 I1 111111 III1111i 11►11111111II11111i 11!I111oii111111111`1®I111111111I1 - 11111>E1111®Ii'I1'111i1111111111111 1111111 MEN 111 11111111ii1i1®I1111111111i11 IIi 1111b 111_131I111111111111i111 r 111111111HIIi11111111111111111i11 r'w r IIIIIIIMIIIIe11111e111111I111 111111111 i 1111111Ie11111eI1iMEN 1 1ling 111111111®11111111111111Ie HIM 111111111111111111111111111 1.1111 11111111111'1111111111111111 1111111111®1111' i11 1 1111111,11111 11 IIIIIe®11111111111111 1111Ie111111111111111111111 111. 111111111®11111111111L.E_ IIII11111I111Jim III11 11111 IIIA .:,11111111111®11111111111111 s 11,1IIIIIIIIIIIII1111111III 111(1 11Wsei1111111111®111111e11111111 X1111111111111 1111111WINE V V , . 1 11111111 11111 I,1►1®1111IN IN;"11PI s 111111111111111111111111l111 j - 1 II111ir1111111111®11111111101111 .- - Fo_VNIN74-W- 11,W11 -14 ' a1111®i1®111111111111 - _ , " • - Yi 1e1111 - - ulee s Town of North Andover14ORTN a Of ,`10 >141 OFFICE OF COMMUNITY DEVELOPMENT AND SERVICES p i X . 27 Charles Street « North Andover, Massachusetts 01845 9SsgcHuS WILLIAM J. As previously published at a Public Hearing on March 17, 1994, the Board of Health has adopted regulations concerning the required sewer tie-in. The following timetable concerning your property status was adopted: 4.1 All establishments that currently do not have municipal sewer available to them must connect to the sewer as soon as it becomes available, with a maximum time limit of six months. The purpose of these regulations is to safeguard North Andover's drinking water, surface waters, groundwater and surrounding environment. Sanitary sewer is believed to be the most effective form of wastewater treatment. A copy of the entire regulation can be obtained at our office. Your property is in violation of this Board of Health regulation. Please contact the Health Department regarding this matter immediately. If we do not hear from you by May 10, 2000 your name will be placed on the regularly scheduled Board of Health meeting agenda and placed on public notice. The meeting will be held on May 25, 2000 for discussion of legal action including court hearings. i BOARD OF APPEALS 688-9541 BUILDING 688-9545 CONSERVATION 688-9530 HEALTH 688-9540 PLANNING 688-9535 JL Sewer Tie-In 55 South Bradford Street Page 2 Any questions concerning this regulation should be directed to the Board of Health at (978) 688-9540. So as to allow: the construction of a 35' x 70' sport court and a 20' x 40' inground swimming pool within the Non-Discharge Zone of the Watershed Protection District. After a public hearing given on the above date, the Planning Board voted to APPROVE, the Special Permit for Watershed Protection District, based upon the following conditions: Signed4erto n Si ons, ChairmanCc: Applicant Angles, Vice Chairman Engineer Richard Nardella, Clerk Abutters Richard Rowen DPW Building Department Conservation Department Health Department ZBA BoA® e14 LI i 1 altJ► ID'Or ASG 2001 BOARD OF APPEALS 688-9541 BUILDING 688 9545 CONSERVATION 688-9530 HEALTH 658-9540 PLANNING 688-9535 r 55 South Bradford Street Special Permit - Watershed Protection District The Planning Board makes the following findings regarding the application of Sudarshan and Kalpana Chatterjee, 55 South Bradford Street, North Andover, MA, 01845, submitted on June 8, 2001, requesting a Special Permit under Section 4.136 of the Zoning By-Law to allow the construction of a 35' x 70' sport court and a 20' x 40' inground swimming pool within the Non-Discharge Zone of the Watershed Protection District. FINDINGS OF FACT: In accordance with 4.133 the Planning Board makes the finding that the intent of the Bylaw, as well as its specific criteria, are met. Specifically the Planning Board finds: 1. That as a result of the proposed construction in conjunction with other uses nearby, there will not be any significant degradation of the quality or quantity of water in or entering Lake Cochichewick. The Planning Board bases its findings on the following facts: a) The existing dwelling is NOT connected to the Town sewer system; however, as part of this proposal the connection will need to be completed prior to the issuance of any building permits. b) A deed restriction will be placed limiting the types of fertilizers that can be used on the site. I c) The topography of the site will not be altered substantially. d) The limit of clearing is restricted to the minimum necessary to construct the proposed sport court and must not extend beyond property line. e) Certification has been provided by a registered professional engineer that the installation of the sport court and the pool will not have an effect on the quality or quantity of runoff entering the watershed protection district. f) The construction of the sport court and the pool has been reviewed by the town's outside engineering consultant, VBB, and with the application of the erosion control, and connection of the dwelling to the municipal sewer, there will be no degradation to the quality of quanity of water in or entering Lake Cochichewick. 2. There is no reasonable alternative location outside the Non-Discharge Buffer Zone for any discharge, structure or activity, associated with the proposed project as almost the entire lot is located within the Non-Discharge Zone. In accordance with Section 10.31 of the North Andover Zoning Bylaw, the Planning Board makes the following findings: z a) The specific site is an appropriate location for thero osed use as a P p 11 feasible storm water and erosion controls have beenlaced on the r site; b) The use will not adversely affect the neighborhood as the lot is located in a residential zone; c) There will be no nuisance or serious hazard to vehicles or pedestrians; d) Adequate and appropriate facilities areprovided for the proper operation of the proposed use; j e) The Planning Board also makes a specific finding that the use is in harmony with the general purpose and intent of the North Andover Zoning Bylaw. Upon reaching the above findings, the Planning Board approves this Special Permit based upon the following conditions: SPECIAL CONDITIONS: 1) This decision must be filed with the North Essex Registry of Deeds. Dear Mr. &Mrs. Sudarshan Chatterjee, This letter is being sent regarding the proposal to pave a portion of your driveway entrance. The affected area will consist of creating a 12' wide paved driveway extending 40' from South Bradford Street. As detailed in the Enforcement Order letter dated May 17,2006 from Pam Merrill, Conservation Department, we conducted several site inspections to determine the extent of the proposal and its and impact on the adjacent wetlands. The project as described will not expand the existing footprint of a structure, will not disturb the existing topography, and will have a negligible impact on the adjacent BVW. Further, the Conservation Department an Enforcement Order issued by the Conservation Department placed several conditions to further prevent erosion during construction and treat stormwater runoff. (See attached May 17, 2006 Enforcement Order) In accordance with Section 4.136(8) of the Town Bylaw, I am administratively approving your request to pave 40' x 12' of the driveway entrance.
