as the six month temporary basis has expired. The matter will be discussed at the
next Zoning Board of Appeals meeting scheduled for July 14th, at Steven's Memorial
Library. As Fisted abutters to the property located at 550 Turnpike St., we thought it
best to advise you of this matter should you have any comments or concerns.
Enclosed is a copy of the decision should you wish to submit. your comments relative to

The Board of Appeals held a regular meeting on Tuesday evening, November 18, 1997 upon the
application of PBJ Development, Corp. 565 Tumpike St., North Andover, MA., for property located at:
550 Tumpike St., North Andover, MA., requesting a modification of a decision dated 1995, petition
#063-94, requesting entrance onto Hillside Rd., be gated and that said gate be allowed to be open from
8:30 AM to 9:00 PM, Monday through Friday, and open all day on Saturday and Sunday, of the Zoning
Bylaws which is in the G -B Zoning District.
The following members were present: William J. Sullivan, Robert Fond, Raymond Vivenzio, Ellen
McIntyre.
The hearing was advertised in the Lawrence Tribune on 11/4/97 and 11/10/97 and all abutters were
notified by regular mail.
Upon a motion made by Raymond Vivenzio and seconded by Ellen McIntyre, the Board of Appeals
unanimously voted to modify the original conditions of decision #063-94, item 6, on a six month
temporary basis for analysis of traffic and neighborhood comfort level, so that the gate on Hillside Road
be closed and locked at all times, except 9AM to 9PM, 7 days a week. A stop sign be installed facing
' traffic exiting on Hillside Road. A sign placed indicating no trucks over 21/2 tons be allowed to exit onto
• Hillside Road. The entire matter be reviewed again at the June 9, 1998 Zoning Board of Appeals
meeting. Voting in favor: William J. Sullivan, Raymond Vivenzio, Robert Ford, Ellen McIntyre.
The petitioner has satisfied the provision of Section 10, paragraph 10.4 of the Zoning Bylaw and that the
granting of these variances will not adversely affect the neighborhood or derogate from the intent and
purpose of the Zoning Bylaw.
Note: The granting of the Variance and/or Special Permit as requested by the applicant does not
necessarily ensure the granting of a Building permit as the applicant must abide by all applicable
local, state and federal and building codes and regulations, prior to the issuance of a building
permit as requested by the Building Commission. ,

I believe Mr. Peter Shaheen has applied to the Zoning Board for a modification to the decision
rendered on the Crossroads shopping center; and that you will be conducting the public hearing
on November 18th. As you may know, Mr. Shaheen is also before the Planning Board to review
the addition of a small medical building located at the rear of the site in an area currently
designated for parking.
As we discussed at the "Selectman's Vision" meeting in July, the issue of the gate onto Chestnut
Street is one that really ought to be addressed, and, perhaps, this is the best opportunity to do so.
Specifically, we believe that the gate should be open during normal business hours for the
shopping center, normally 9:00am to 9:00pm. The concern is that we've created a hazardous
situation for traffic exiting the shopping center and trying to utilize Chestnut to return to local
neighborhoods. When the gate is closed, traffic must exit left onto Rt. 114 against oncoming
traffic, then immediately cross the oncoming traffic a second time to turn left onto Chestnut.
Chief Stanley supports having the gate open as stated in his letter (attached). Also, Mr. Paul
Hajec a traffic consultant frequently utilized by Planning to advise us on traffic safety matters
recognizes the benefits of the open gate in a review he did for us, specifically for this issue. At
their October 21, 1997 meeting, the Planning Board voted unanimously to request the ZBA to
modify their decision for the Crossroads to allow the gate to be open during normal business
hours.
Bill, I hope your Board will seriously consider this request, as I believe we've allowed a safety
issue to go unaddresed for too long.
If you have any questions, please let me or Kathleen Colwell know. Unfortunately, we will be
unable to attend your hearing on this matter as we will be meeting ourselves on Tuesday.

SUBJECT: 550 Turnpike St. - The Crossing
Originally, this Department suggested that a gate be erected to potentially control the flow
of traffic into the Crossing if it was found to be needed. Shortly after, residents petitioned to
not have a curb cut onto Hillside. This Department did not oppose the petition nor did we
support the petition. As a cooperative effort the police department did not object to their
request.
At this time there has been no incidents of traffic accidents on Hillside Road that have been
associated with that curb cut. There have been numerous accidents"on Route 114. It appears
that the curb cut on Hillside alleviates some of the traffic on Hillside by diverting it into the
strip mall. Closing the entrance on Hillside is not supported by any adverse traffic data. It is
therefore the recommendation of this Department to leave the gate open to allow for
entrance and egress.

Dear Ms. Colwell:
Hajec Associates, Inc. has conducted further review regarding the
impacts of the use of the Hillside Road driveway at Crossroads
Plaza. Based on this review, the following positive impacts have
been identified for site access with this driveway open:
* reduced traffic on Route 114;
* reduced traffic at. Route 114/Crossroads Plaza North Drive and
Route 114/Crossroads Plaza South Drive intersections;
* reduced conflicts and accident potential at the aforementioned
driveway intersections with Route 114;
* improved operations (level of service) at these driveway
intersections; and
* reduced turning -movements at Route 114/Hillside Road.
These positive impacts are significant and should be given
appropriate consideration in determining the future status -of the
Hillside Road driveway.
As outlined in previous correspondence, there are also positive
impacts associated with closure of the driveway. Specifically,.
closure would likely result in reduced traffic along Hillside koad.
Thus, a decision on the future status of the Hillside Road driveway
should basically be a choice among local officials and residents as

DECISION
Petition #063-94
The Board of Appeals held a regular meeting on Tuesday evening
December 13, 1994 continued to January 10,n 1995 and a Special
Meeting on January 18, 1995 upon the --application of PBJ
Development Corp. requesting a VARIATION of Section 7, Paragraph
7.3, Table 2 of the Zoning Bylaw so as to permit a variation from
the front and rear setback requirements on the premises located
at 550 Turnpike Street. The following members were present and
voting: Walter Soule, Raymond Vivenzio, Scott Karpinski and
Joseph F. Faris. The hearing was advertised in the North Andover
Citizen on November 23 and 301 1994 and all abutters were
notified by regular mail.
Upon a Motion by Mr. Karpinski and seconded by Mr. Vivenzio, the
Board voted unanimously to GRANT the VARIANCE as requested with
the following conditions:
1. The parking lot, of 148 spaces shall be constructed as
shown on the plan; 24 spaces reserved for future use as may be
required by the Building Inspector.
2. A stockade fence 8 feet high shall be constructed on
all sides of the property with the exception of Rte. 114 and the
abutting property next door which is John McGarry's property.
3. The fence shall be 8 feet high with., landscaping of 4
foot to 5 foot high arborvitaes, five feet on center and saw
tooth pattern.
4. The eight foot high fence shall be set 15 feet in from
the property line where the land abuts the lots fronting on
HIllside Road and the arborvitaes shall be planted on the side of
the fence facing Hillside Road._
5. The fence abutting Royal Crest, Netti and Piessens
shall be 8 feet high and shall be located on the property line._
6. The entrance on Hillside Road shall be closed off with
fence and arborvitae.
7. The. applicant is to submit an 11"x17" sketch with
landscaping shown and stamped by a landscape engineer.
8. The plan is to be revised to reflect these conditions

A written complaint has been received by the Zoning Enforcement Officer
alleging a violation of the North Andover Zoning Board of Appeals Decision on
Petition No. 057-94 and No. 063-94 which requires the closing of the gate
(ingress/egress) on Hillside Road.
Investigation of the site reveals a true complaint.
Enclosed, for your review, is a copy of the Decision with Item #6 (highlighted)
which states the following - "The entrance on Hillside Road shall be closed off
with fence and arborvitae". As such, upon receipt of this notice you are to close
the entrance immediately.
Pursuant to Section 10.13 of the North Andover Zoning By -Law, "Whoever
continues to violate the provisions of this By-law after written notice from the
Building Inspector demanding an abatement of a Zoning violation within a
reasonable time, shall be subject to a fine of Three Hundred Dollars ($300.00).
Each day that such violation continues shall be considered a separate offense."

Re: The Crossroads - Site Plan Review
I am writing on behalf of the Planning Board to ask that you reconsider your decision regarding
access onto Hillside Road at The Crossroads. As part of its annual review of traffic issues at the
site, the Planning Board solicited the opinion of the Police and Fire Departments on this issue.
The Planning Board's decision for this project requires the Board to review the traffic situation
from time to time and if, in the Board's opinion, public safety and traffic concerns warrant, access
to Hillside Road should be opened.
The Police Department recommends that the access to Hillside be opened as there have been
numerous accident on Rt. 114. The access on Hillside will relieve the traffic pressures on Rt. 114.
The Fire Department also has no objections to opening the gate as it will provide them with a
secondary access point. The Planning Board also recommends that the gate be left open to
facilitate the traffic flow in and out of the site. The gate could be closed in the morning to prevent
"cut through" traffic by commuters if this is a concern.
If you have any questions please do not hesitate to call me at 688-9535. I have attached the letter
from the Police Department and will forward any correspondence from the Fire Department in the
future.

550 Turnpike St. - The Crossing
Originally, this Department suggested that a gate be erected to potentially control the flow
of traffic into the Crossing if it was found to be needed. Shortly after, residents petitioned to
not have a curb cut onto Hillside. This Department did not oppose the petition nor did we
support the petition. As a cooperative effort the police department did not object to their
request.
At this time there has been no incidents of traffic accidents on Hillside Road that have been
associated with that curb cut. There have been numerous accidents on Route 114. It appears
that the curb cut on Hillside alleviates some of the traffic on Hillside by diverting it into the
strip mall. Closing the entrance on Hillside is not supported by any adverse traffic data. It is
therefore the recommendation of this Department to leave the gate open to allow for
entrance and egress.

The Fire Department would support the opening of the access from Hillside Road to the Crossroads
Plaza.
By removing the gate the department has better access to the rear of the building and can also access the
front without negotiating the Rte. 114/Hillside Road intersection. Frequently fire apparatus must go
around vehicles stopped at the stop sign on Hillside Road which presents a safety hazard to responding
fire personnel.
I appreciate your consideration of our response needs in evaluating this situation.

Dear Sir:
A written complaint has been received by the Zoning Enforcement Officer
alleging a violation of the North Andover Zoning Board of Appeals Decision on
Petition No. 057-94 and No. -063-94 which requires the closing of the gate
(ingress.'-gress) on Hillside Road.
Investigation of the site reveals a true complaint.
Enclosed, for your review, is a copy of the Decision with Item #6 (highlighted)
which states the following - "The entrance on Hillside Road shall be closed off
with fence and arborvitae". As such, upon receipt of this notice you are to close
the entrance immediately.
Pursuant to Section 10.13 of the North Andover Zoning By -Law, "Whoever
continues to violate the provisions of this By-law after written notice from the
Building Inspector demanding an abatement of a Zoning violation within a
reasonable time, shall be subject to a fine of Three Hundred Dollars ($300.00).
Each day that such violation continues shall be considered a separate offense."
