Complaint: Terrible odor from Kittredge Farm. Second year in a rowt they have done this. Please ask them not to spread the fertilizer when it is hot and humid. Neighbors have

The Senior Operator did a tour of the plant
and the neighborhood after receiving the \
complaint.His report states:"Plant has very
low odors if any"and he also states that he
did not smell odors at the neighborhood
location. 1 t
That having been said,wind direction last
night was from the NNW which would seem
to indicate us as the most likely source of any
odors and not the farm.
Mr.Card indicated that the odor he smelled
seemed like it had an odor masking agent in
it.However,we no longer use masking

Since Mr.Card talks about smelling the
"odor control",I'm assuming that the odor he
smelled was not a sludge or sewer odor.

woman is way down the hill on Court Street,
and the smell was foul. Worked as an

Dear Mr. Davidowicz,
This correspondence is in response to your recent letter received at the Health Office on July 24,
2008. This letter was a follow-up to a meeting attended by myself, you and Ms. Michele Grant,
Health Inspector, to discuss the spreading of bone meal fertilizer by you, at Kittredge Farm, over
the past year. It is agreed by all parties that the odor problems which occurred were created by a
lack of a good standard practice in the fertilizing process at this farm. Without consideration of
specific environmental factors the bone meal can and did cause distasteful odors. With this
assumption it is also agreed that agreed upon improvements can be made to minimize the
possibly of a repeat odor event.
Your letter stated the following,
"Prior to any application of fertilizer by Crescent Farms',in the Town of North
Andover on the Kittredge Farm,your office will be notified." "The intended time
frame will be, approximately, between March 15th to May 20th or the September 15th to
November 1st. Weather conditions will be the determining criteria to the actual
application of the fertilizer. Criteria such as rain in the forecast, the temperature below
eighty degrees Fahrenheit, and other weather variable will be used to determine the
actual dates.Any changes will be agreed upon by the Health Department, Kittredge
Farm Manager, and Crescent Farms."
The Health Department agrees with your statements; however,the health staff has several
additions to further define the fertilizer application process. Please review the below items which
incorporate these items.

Re: Fertilizer Use at Kittredge Farm

Pursuant to our conversation earlier this week and the recurrence of the
stench problem from the property, we agreed o11 several things for
tuture applications, significantly regarding; timing and temperature,
It is our understanding;that the fertilizer materials call be applied at any
time of elle year and certainly,whether it's early spring or mid-winter,
snow conditions etc., it is understood that application will be done in
those periods least subject to severe high temperatures; under any
circumstance it will not be applied when the ambient temperature is 80
degrees or above. You and I did not discuss the specific temperature
level, but I think 80 degrees is an appropriate and reasonable level.
It's in.y understanding that a meeting is scheduled or to be scheduled
within the next few weeks between you and the North Andover town
officials that have caught the brunt of the severe '07 problems and to a
lesser extent the recent reoccurrence; the purpose of this is to reach a
mutual understanding of how best to handle the problem for the future,
hopefully the lack of a problem for the future. It would be illy
suggestion regarding timing that you and our property manager, Dana
Adam,agree on any future scheduling in advance with the recognition
that if weather conditions should change, that date might have to be
changed also. Likewise, this precludes any suspicion of the job done in
the middle of the night and nobody knew about it.

You want the good corn that can be grown and harvested firom
Kittredge Farm property; Kittredge Farm is highly interested in keeping
up the pi-operty to its good use, appearance, and posterity, along with
the$1040 per year land-lease that we have utilized for several years
now. The comn.iunity is not much interested in either ofthe foregoing,
but very interested in a co.nipatible long-term neighbor-not providing a
significant stench.
Good luck on a good crop this year and be assured of our intent:to stem
the stench in a practical matter,

My answers to both question is"no".
The Senior Operator did a tour of the plant
and the neighborhood after receiving the
complaint.His report states:"Plant has very
low odors if any"and he also states that he
did not smell odors at the neighborhood
location.
That having been said,wind direction last
night was from the NNW which would seem
to indicate us as the most likely source of any
odors and not the farm.
Mr.Card indicated that the odor he smelled
seemed like it had an odor masking agent in
it.However,we no longer use masking

Re: Fertilizer Use at Kittredge Farm
Dear Mike:
Pursuant to our conversation earlier this week and the recurrence of the
stench problem from the property, we agreed on several things for
future applications, significantly regarding timing and temperature.
It is our understanding that the fertilizer materials can be applied at any
time of the year and certainly, whether it's early spring or mid-winter,
snow conditions etc., it is understood that application will be done in
those periods least subject to severe high temperatures; under any
circumstance it will not be applied when the ambient temperature is 80
degrees or above. You and I did not discuss the specific temperature
level,but I think 80 degrees is an appropriate and reasonable level.
It's my understanding that a meeting is scheduled or to be scheduled
within the next few weeks between you and the North Andover town
officials that have caught the brunt of the severe '07 problems and to a
lesser extent the recent reoccurrence;the purpose of this is to reach a
mutual understanding of how best to handle the problem for the future,
hopefully the lack of a problem for the future. It would be my
suggestion regarding timing that you and our property manager, Dana
Adam, agree on any future scheduling in advance with the recognition
that if weather conditions should change,that date might have to be
changed also. Likewise, this precludes any suspicion of the job done in
the middle of the night and nobody knew about it.

You want the good com that can be grown and harvested from
Kittredge Farm property; Kittredge Farm is highly interested in keeping
up the property to its good use, appearance, and posterity, along with
the $1000 per year land-lease that we have utilized for several years
now. The community is not much interested in either of the foregoing,
but vM interested in a compatible long-term neighbor not providing a
significant stench.
Good luck on a good crop this year and be assured of our intent to stem
the stench in a practical matter.

In connection with the above and your letter of September 12, in my annual visit to our
property in the fall, I had occasion to visit extensively with Dana Adams and Michael
Davidowicz,the people who literally operate Kittredge Farm as well as to directly
communicate with Mrs. Laura Howell who left her phone number and letter regarding the
event.
Obviously, the root cause of the stench remains a bit of a mystery in that it would appear
a combination of weather, ground conditions, as well as the nature of the ingredients
utilized created a very unusual and very obvious contamination for the air around
Kittredge Farm.
Since it's not been recurring, and we don't expect it to,I simply want to express to you
particular compliments on the features of your letter and how you handled the community
stir that neither of us want to see again.The letter was extremely well presented and I
think the handling by you and the other parties in this situation are all to be highly
complimented.
Kittredge Farm is legally Kitco Farm LTD, a Michigan-corporation, and has been for a
good many years. You are well aware that the Kittredge family has been in residence
there since 1784. We'd like to think we could stay there and you can count on our
interest to be very"green"in our approach to keeping our thirty acres as real farm land
and a place for lots more Kittredges in the future in North Andover's wonderful
community.

Dear Mr., Kittredge,
This correspondence is a follow up to the foul odor occurrences that have been attributed to fertilizing
activities at the Kittredge Farm over the past few weeks. As you know, the North Andover Health
Department has been working with Dana Adam of Kittredge Farm and Mike Davidowicz, of Crescent
Farms to resolve this issue as quickly as possible since our first citizen complaint was received on
8/27/07. You may not be aware that the Health Department has fielded complaints from dozens of
neighbors and interested parties in the past three weeks.
During these past three weeks we have become educated on the fertilization process at Kittredge Farm.
Michele Grant, The Health Inspector, has tirelessly attempted to communicate this information to the
public.As has been explained to us, "Bone Meal"has been used in this process many times before
without the negative feedback. We are also well aware of the agricultural statutory right to conduct regular
farm practices, (MGL 111 sec. 125(a)stating that Boards of Health may not designate odors from farms
a nuisance; however, as was also communicated to you,the citizens right to a quality of life, including air
quality, is an expected part of our purview.
What became evident to the Health Office from this experience is that some agricultural practices may
have limitations. We suggested then, and still do today,that although it may be legal, there may be times
that options to a certain regular practice may be prudent. For example: environmental factors such as:
high heat, low winds or high humidity, etc. may determine when there is a better time to apply fertilizer.
Mr. Davidowicz was encouraged to contact his supplier, Agra Source,to discuss whether these
environmental conditions, or whether changes in the process may have played a role in the resulting
odors. We continue to urge you to look into those options in the future_
In closing, I would like to express our appreciation to Dana Adam and Mike Davidowicz for working with
us daily to answer our numerous questions and to formulate daily plans. Their cooperation to our
requests to halt and resume work on a particular day or weekend assisted us with our daily complaints
and inquiries from the public and local and state officials.

According to the,N. Andover Board of Health, the unbearable stench our
neighborhood has been subject to aver the past day and a half is due to some Find of
"problem,,,with the fertilizer Kittredge Fa to (on Academy Rd.) is putting on their
fields. 'No one k ows how many days (or weeks?) it will. take for this sickening
smell to go away.
During one of our many phone calls to the Board of Health, we were told that
Y,ittaredge Farms may be fertilizing again on Tuesday with more of the same stuf.
This is despite many complaints that people, especially chif dren and elderly, are
experiencing nausea and are stuck. inside their homes with windows shut tight
during these 85 degree s anmer days.

My inspector just confirmed that Kitteridge Farm fertilized their fields on Sunday and Monday. They used
Bone Meal for the first time. The odor has all but disappeared. They apologized for the problem. Michele
has been in contact with one complainant, Mrs. Rosenberg, 70 Court Street.
That takes care of that side of town.

I listened again to the voicemail from our Senior Operator who responded to the Pleasant Street
complaint. The voicemail was received at approximately 5:48PM yesterday.
The Senior Operator stated that he took a ride"up there"with the NAPD. He said that it appeared
to him that they—Kittredge Farm—were either spreading manure on the field or putting fertilizer
down.
Our weather station records wind direction on an hourly basis. The readings for that time were as
follows:
4 PM—145 degrees(i.e. —from the southeast)
5 PM—156 degrees (from the south southeast)
6 PM—159 degrees(from the south southeast)
Today at around 12:30PM I drove around that area. I noticed a manure-like smell at the corner of
Court Street and Academy Road. I came back a few minutes later and still noticed the odor.

2)3 separate calls from around court St.,at 411 Pleasant Rd and Kitteridge Farm.Likely the one below is one of those citizens.Anyway,Rick's operator made a
passing comment that possibly Kitteridge was spreading manure for fertilizer.I don't know if this is accurate.The wind direction for these complaints confirm that it
was not likely caused by GLSD rather another source.

Anyway,please call Ms.Rosenburg and see if you can establish the type of odor and whether it is on going.See if she is anywhere near the farm.We can do a drive
by if it is still there. Then document the call and send the info to Pam to log.I wonder if anyone in our office knows a contact at Kitteridge Farm,or we can just
drive up in the town car I suppose.

3. Fee of$275.00 per lot for new construction. This covers the minimum two deep holes and
two percolation tests required for each disposal area. Fee of$75.00 per lot for repairs or upgrades.
GENERAL INFORMATION
1. Only Certified Soil Evaluators may perform deep hole inspections.
2. Only Mass. Registered Sanitarians and Professional Engineers can design septic plans.
3. At least two deep holes and two percolation tests are required for each septic system disposal area.
4. Repairs require at least two deep holes and at least one percolation test,at the discretion of the
BOH representative.
5. Full payment will be required for all additional tests within two weeks of testing.
6. Within 45 days of testing, a scaled plan(no smaller than 1"-100') shall be submitted to the Board
of Health showing the location of all tests(including aborted tests).
7. Within 60 days of testing soil evaluation forms shall be submitted.

The North Andover Board of Appeals held a public hearing at its regular meeting on Tuesday,January 9,
2001 at 7:30 PM upon the application of Robert Kittredge, principal of KITCO Farm, LTD, 56 Academy
Road, North Andover, MA for a Special Permit(within the Watershed)from Section 9, Paragraph 9.2 to
allow for the altering/rebuilding of a caretakers residence and garage,therefore, having 2 dwellings on one
parcel, on a pre-existing, non-conforming lot within the R-3 Zoning District.
The following members were present: Walter F. Soule, Raymond Vivenzio, Robert Ford, Ellen McIntyre and
George Earley.
Upon a motion made by George Earley and 2nd by Ellen McIntyre,the Board voted to GRANT a Special
Permit from Section 9, Paragraph 9.2 to allow for the construction of a new care takers residence and
garage on the site of the previously existing dwelling, in accordance with the Plan of Land by: Graig A.
Vancura, PLS,#36127, Hancock Survey Associates, Inc., 235 Newbury Street, Danvers, MA 01923, dated:
(revision) 1/8/2001. Voting in favor: WFS/RWRF/EM/GE.
The Board finds that the applicant has satisfied the provision of Section 9,Paragraph 9.2 of the zoning bylaw and that
such change, extension or alteration shall not be substantially more detrimental than the existing non-conforming structure
to the neighborhood..
Furthermore,if the rights authorized by the Variance are not exercised within one(1)year of the date of the grant,they
shall lapse,and may be re-established only after notice,and a new hearing. Furthermore,if a Special Permit granted
under the provisions contained herein shall be deemed to have lapsed after a two(2)year period from the date on which
the Special Permit was granted unless substantial use or construction has commenced,they shall lapse and may be re-
established only after notice,and a new hearing.
