described in the ORDER LETTER have been corrected and that there

Dear Mrs. Kollen:
The compliance date for the order letter sent to you by this
department on your property was October 6, 1992 .
A reinspection of the property was conducted on October 23,
1992 and revealed that the smoke detector has been installed in
the unit, however, all other violations, although noncritical in
nature, have not been corrected.
As you are aware, in response to your request, the Board of
Health, at their meeting on September 17, 1992, agreed not to
take legal action against you for noncompliance with the order
letter dated August 18, 1992 but rather to allow you an
additional thirty days to correct the violations before further
action will be initiated.
During the reinspection of October 23, 1992 , it was brought
to my attention by the tenant of the unit that the gas stove in
the kitchen has been red tagged by the gas company. In response,
I called you on October 23rd and informed you of the matter and
advised you to have the violation corrected as soon as possible
and notify this office when the stove has been repaired. I
called your home once again on October 26th and was informed by
someone other then yourself that G & G Appliance had repaired the
stove.
Please notify me of any work which has been done on the
stove. Your date for compliance is December 7, 1992 . Please
contact me to arrange a reinspection at that time. Please feel
free to contact me with any questions you may have.

Ms. Conboy stated that 56 Church Street, the complaint was
received August 17, 1992 and a housing inspection was conducted
on August 18th. The violations are noted on the order letter and
Mrs. Kollen was given thirty (30) days to comply with the order
letter. Since that time, Ms. Conboy has had a number of
communications with Mrs. Kollen and the tenant regarding the
lease and if the tenant is there legally. Ms. Conboy stated
that whether or not the tenant is there legally, she has to
insure that violations are corrected. Ms. Conboy stated that
there are no critical violations in the unit at this time. Mrs.
Kollen is present to request additional time for compliance. Ms.
Conboy stated that she has suggested to her if it is a matter
having problems gaining access to the unit because of the tenant,
that she document that by certified letters and copy the Board of
Health. Ms. Conboy stated that if there is a case where if she
is denied access by the tenant and she has given reasonable
notice and the Board is aware of the that, then the Board has the
right to close the case.
Dr. MacMillan asked what were the original violations? Mr.
Osgood stated that isn't this the case where the tenant was asked
to leave. Attorney Willis was present and stated that the tenant
said she was going to leave and informed Mrs. Kollen that she
would utilize her security deposit for that purpose, and that was
in July. Attorney Willis stated that the police had to go to the
premises because the tenant was verbally abusive to his client.
The Attorney stated that he sent the tenant a letter on August
3rd confirming that she will use her security deposit and will be
out the first of September. Attorney Willis stated that the 1st
of September has come and gone and the tenant is still on the
premises and she has not paid any additional rent. Attorney
Willis has served her a notice for non-payment for August and
September.
Attorney Willis stated that his client, Mrs. Kollen, is not going
to avoid any of these violations but just needed additional time.
Attorney Willis requested that his client be granted an

additional sixty (60) days, hopefully, his client will be in
compliance before that but wanted a time limit that they feel
comfortable to deal with. Attorney Willis stated that he
believes that the tenant was notified of this meeting also and
she had the opportunity to be here but is not here.
Ms. Conboy stated that one of the things that she would like to
clarify is that she mentioned there were no critical violations
but she thinks there was a problem with the refrigerator and if
it was keeping the proper temperature. Ms. Conboy stated that it
is good that it has been replaced. Ms. Conboy is concerned about
the smoke detector issue. Mrs. Kollen stated that she gave her a
smoke detector. Ms. Conboy stated that she does not have a
problem with allowing additional time but wants to make it clear
that the Board can not get involved in landlord tenant disputes.
Ms. Conboy stated that she is only allowed to grant thirty (30)
days and in speaking with the State you are only allowed to grant
thirty (30) days for correction of these violations, however, you
can formally state that you do not intend to pursue it for
another thirty (30) days and that you will not go ahead with any
legal action.
Ms. Conboy's stated that her only concern is the smoke detector.
Ms. Conboy suggested to bring the smoke detector in and she will
gain access to install the detector. Ms. Conboy stated that if
the tenant denies access to see if a violation is corrected - it
is another grounds for closing the case.
Ms. Conboy told Attorney Willis to take care of the smoke
detector and she will be willing to write a letter stating that
Mrs. Kollen is not in violation after thirty (30) days and that
an additional thirty (30) days was granted.
The Board agreed with Ms. Conboy's recommendation.

Chapter II, Order Letter issued to your client Virginia Kollen,
on the above mentioned property. The Board of Health has placed
the matter on the agenda for the next meeting, September 17, 1992
at 9: 00pm.
The meeting is to be held at Town Hall in the Selectman's
meeting room. As required by law, the complainant and current
tenant in this case is being notified of the hearing.

Gentlemen:
Please be advised that this office has been retained by
Virginia Kollen in connection with some tenancy problems she is
currently having at 58 Church Street, North Andover, MA. Over the
last several months, Mrs. Kollen has had a great deal of difficulty
with her tenant, Kimberly Harding who occupies Apartment 2 in her
building. Mrs. Kollen lives on the first floor. Because of the
noise, disturbance of the peace and actions of Kimberly Harding,
the tenant in Apartment 1, notified Mrs. Kollen that she was going
to find another apartment and did so leaving Apartment 1 vacant.
In July of 1992, Mrs. Kollen was informed by Kimberly Harding
that she was going to vacate her apartment effective September 1,
1992 and that she would not pay the rent due for August relying
upon her Security Deposit. Mrs. Kollen was not given any option in
this regard. Kimberly Harding when she would talk with Mrs. Kollen
was verbally abusive and would physically intrude herself into Mrs.
Kollen home. Mrs. Kollen informed her not to do so in the future
and I on her behalf sent a letter to Kimberly Harding, a copy of
which you will find enclosed, memorializing their agreement that
she would be out on the first of September and also advising her
officially in writing that if she were to set foot on Mrs. Kollen's
side of the building in the future we would consider it to be a
trespass. I sent a letter advising the North Andover Police
Department of this warning also.

In spite of this understanding and the statements of Kimberly
Harding, the first of September, 1992 has come and gone, and
Kimberly Harding has not vacated the premises. She also has not
paid any additional rent.
Mrs. Kollen is retired and her husband is in a nursing home
suffering from Alzheimer's disease. Her income is extremely
limited and she is to a great extent dependant upon the rental
income from her property to live and pay her expenses. As a direct
result of the actions of her tenant, Kimberly Harding she is
currently ;without rent from either apartment and therefore in an
extremely precarious financial position. I have instituted formal
eviction proceedings against Mrs. Harding for Non-payment of rent
and will with all due diligence proceed towards reobtaining
possession of the premises for Mrs. Kollen.
Because of the difficulties Mrs. Harding has created and the
beligerent attitude she has taken towards Mrs. Kollen, Mrs. Kollen
feels very intimidated when it comes to entering upon the premises
occupied by Mrs. Harding. Due to this fear and the lack of income
also caused by Mrs. Harding, Mrs. Kollen feels that it is
impossible at the present time for her to complete the list of
repairs which have been ordered in the time given to her.
Request is herewith made that the time for performance of the
repairs as ordered by the Board of Health be extended for a period
of 60 days. I would appreciate your putting this matter on the
agenda for your next available meeting at which both I and Mrs.
Kollen will attend if you feel such a meeting would be prudent or
if you are in need of any additional information. I remain,

Dear Ms. Harding:
Please be advised that this, office has been retained by
Virginia Kollen to represent her in recovering possession to the
above-captioned apartment. Virginia Kollen informed you to vacate
the apartment in September of 1992 and agreed and informed her that
you would relinquish the apartment by September 1, 1992 . You
further informed her that she should apply the Security Deposit to
your last months' rental which she has done.
If in the future you have any need to discuss anything further
.concerning your tenancy, please be - advised that you are to do so
through this office and not contact Virginia Kollen in person. In
the past some disputes have arisen between the two of you and you
have taken it upon yourself to intrude into Mrs. Kollen's home at
58 Church Street.
You are hereby notified that if you set foot or. Virginia Kollen's
premises again after this notice you will be considered to be a
trespasser and the North Andover Police Department have been
informed of this fact. Any further trespass of you on Mrs.
Kollen's property will be treated accordingly.
