In their response to my previous Comment#4, Atlantic Engineering references the hydrologic calculations that were submitted with the application as demonstrating that the proposed project provides adequate compensatory recharge for the added impervious surface. I'd like to point out that the HydroCAD analysis really only demonstrates that the peak rate of surface runoff would be mitigated during design storm events, it does not address the loss of groundwater recharge on an average annual basis from the added impervious cover on the site. It has not been demonstrated that the two proposed rain gardens are sized to retain and infiltrate the first inch or so of runoff from the added impervious cover, nor does all of the added impervious cover even drain to the rain gardens. And while the proposed pool will not add to the surface runoff from the site, it will capture and retain all of the rainfall onto the pool surface, with none of that rainfall being recharged. I encourage the applicants to consider using porous pavers or another more pervious surface for the new patio and walkway areas, and/or providing compensatory recharge elsewhere on the site, to reduce the overall impact of the proposed project. 2. The pool maintenance plan outlines appropriate measures for dechlorinating the pool water before it is drained at the end of the season; what about when the pool is drawn down in advance of a major storm event, as is called for in the plan to prevent overflow? Wetland Boundary Confirmation by Conservation Commission. a. The Wetland boundary was previously delineated in 2006 and the line depicted on the plan represents the 2006 line. We understand that since the delineation occurred over 3 years ago, a re-confirmation of the line is required by the Conservation Commission. We have been in contact with the Conservation Agent and have been n working with her to gain access to the abutting property (see below) b. The Wetlands are located on abutting property owned by North Andover Country Club and permission is needed to access the property to identify the wetland boundaries. We have contacted Steve Kohr, general manager of the North Andover Country Club and on March 8t1'as of this letter we have not received permission to enter the property. 2. Identify DEP Zone A a. The portion of the Zone A which is 400 feet from the bank of Lake Cochichewick is not with the limits of the property. This is presently noted in notation#9 of the General Notes on the plan. 1 b. The Zone A line which is 200 feet from the upper edge of the wetland has been noted on the plan. 3. Identify Limit of Work\Work to be outside 100 foot wetland buffer zone or NOI or ANRAD is required. a. The plan currently depicts the location of a siltation barrier which is also represents the maximum limit of work. The siltation barrier notation has been expanded to also identify it as the limit of work. b. Subject to the confirmation of the wetland line, Conservation, as proposed, all work is located outside the 100 foot buffer zone. 4. Clarify that the rain gardens will provide the compensatory groundwater recharge as require by Zoning. Questioned is run-off flow will reach the rain gardens. a. Hydraulic calculations provided the calculations that indicate that the proposed rain gardens provide sufficient recharge of impervious surface run-off to equal pre-development conditions thereby successfully mitigating the effect of the added impervious surfaces. b. Additional spot grades have been added to the plans to clarify that the proposed grading directs impervious surface run-off to the rain gardens as demonstrated in the hydraulic calculations 5. DEP Water Regulations require Impervious Cover limitations. a. The regulation cited 310 CMR 22.02(C) is a regulation that regulates the "Protection of Surface Water Supplies for New and Expanded Class A Water Supplies". This section of 310 CMR 22 it is not for existing supplies. The applicable regulation for existing supplies is 310 CMR 22.002(B) which does not have any impervious area limitations. This was confirmed via a conversation with Mr. Jim Persky of DEP NERO Drinking Water Section of Thursday March 9, 2017. Mr. Persky also indicated that such"land use restrictions must be incorporated into the communities zoning regulations". As North Andover's Zoning By-Law does not include such impervious limitations, no impervious percentage limitations exist. 6. Establish best management practices for maintenance of pool within the watershed a. A Pool and Rain Garden Maintenance plan is attached. 7. Add requirement to use low-phosphorus fertilizers and expand use of restricted fertilizes to future maintenance of lawn. Provide landscape plan. a. The Fertilizer notation has been expanded to include the use of low-phosphorus fertilizers and to restrict fertilizer use for routine lawn maintenance. 2 b. As of this letter the requested landscape plan has not been completed by the Landscape Architect. The plan will be submitted as soon as completed. 8. Restrict use of coal tar based pavement sealants a. A notation has been added to the plans restricting the use of coal tar based pavement sealants proposed. 9. The revisions depict the relocation of the proposed poll outside of the Watersheds Non-Disturb Zone, as requested by the Zoning Board of Appeals, and the elimination of the rain gardens. In lieu of the rain gardens a stoned infiltration trench is now being proposed to capture and infiltrate runoff from the added impervious surfaces. The change from rain gardens to an infiltration trench is to address the concerns indicated in the email review comments prepared by Lisa Eggleston of Eggleston Environmental dated March 21, 2017. Below please find a summary of my response to the review comments prepared by Lisa Eggleston of Eggleston Environmental dated March 21, 2017. 1. As indicated above, to mitigate for the loss of annual recharge resulting from the added impervious surfaces the proposed improvements now incorporate the use of stoned infiltration trenches rather than the rain gardens. The stoned trenches are proposed along the perimeter of the pool and pool deck to eliminate the concern that that of receiving suitable run-off from the impervious surfaces. The trenches have been sized to capture and provide infiltration in excess of the required 1"volume from the added impervious surface area. The calculations indicating the required infiltration volume and supporting trench volume calculations are attached to this memo. 2. The intent of the methods of de-chlorination of the pool water section of the Pool Maintenance Plan was to cover the discharge of pool water for any purposes. 1 Additional wording has been added to the attached modified Pool Maintenance Plan to clarify that de-chlorination is required for discharges that occur during pool maintenance, end of the season draw down and drawn down for major storm events. The proposed project calls for construction of a retaining wall, pool, spa, walkway and patio in the rear yard of an existing single-family home, as well as grading associated with the work. The proposed work is located within the Non-Disturbance and Non-Discharge Zones of the Watershed Protection District. My comments on the application are outlined below: 1. The boundaries of the Watershed zones are based on the horizontal setback from the edge of wetland resource areas, as defined by the Wetlands Protection Act and the North Andover Wetland Bylaw. It should be confirmed that the wetland boundary shown on the plan has been confirmed by the Conservation Commission, e.g. through an ANRAD or NOI. 2. The Plan should also show the Zone A for the Lake Cochichewick public water supply, defined by the Massachusetts Drinking Water Regulations (310 CMR 22.02) as including the land area within a the land area within a 400 foot lateral distance from the upper boundary of the bank of a Class A surface water source and 200 foot lateral distance from the upper boundary of the bank of a tributary or associated surface water body(including wetands). 3. The Plan should clearly show the proposed edge of vegetation clearing/limit of work and, unless an NOI or ANRAD has been filed with the Conservation Commission, all work should be kept outside of the 100-foot buffer zone to the Bordering Vegetated Wetland. 4. The proposed project calls for an increase in impervious surface on the lot of 2,708 sf and a net decrease in wooded cover on the site of 2,974 sf, but it provides very little in terms of compensatory groundwater recharge as is required by the Zoning Bylaw for work within the Watershed Protection District. While the Watershed Protection District regulations do not specifically limit the total impervious area on a property, the Planning Board should be aware that for new and expanded Class A Surface Water Sources the Massachusetts Drinking Water Regulations (3 10 CMR 22.20C) restrict land uses that result in rendering impervious more than 15% (or more than 20% with artificial recharge) or 2500 square feet of any lot, whichever is greater. It appears that the total impervious area on the project site already exceeds that that threshold. The plan should enumerate the total impervious area on the property and, if the Board permits the proposed project, I recommend that any further increase in impervious cover be restricted. 6. Best Management Practices to protect the watershed from contamination with swimming pool chemicals used on the property should also be identified and employed. Such measures would include proper dechlorination and discharge of pool water when it is drained for maintenance, storage of chemicals, spill prevention and the like. 7. The plan calls for any fertilizers used to establish vegetation to be organic or slow release nitrogen. I would add that the fertilizers should also be low-phosphorus, and that the restriction should apply to ongoing maintenance of the property, not just in establishing vegetation. Any new lawn and landscaped areas should be constructed in such a manner as to minimize the maintenance that is required, e.g. the soil should be well aerated, it should have a minimum of 6-inches of topsoil and, where possible,native vegetation should be planted to minimize the need for fertilizer and watering. The Planning Board may also want'to request a planting or landscape plan for the property. 8. I also recommend that the use of coal tar-based pavement sealants be prohibited on the property, as they have been determined to contribute high levels of polycyclic aromatic hydrocarbons (PAHs)to stormwater runoff. 9. As with similar projects permitted within the Watershed Protection District, the limits of approved clearing and the Board's restrictions on landscaping products should be permanently recorded on the deed to the property. Within a taxonomic class there are precisely defined limits for the properties of the soils. On the landscape, however, the soils are natural phenomena, and they have the characteristic variability of all natural phenomena. Thus, the range of some observed properties may extend beyond the limits defined for a taxonomic class. Areas of soils of a single taxonomic class rarely, if ever, can be mapped without including areas of other taxonomic classes. Consequently, every map unit is made up of the soils or miscellaneous areas for which it is named and some minor components that belong to taxonomic classes other than those of the major soils. Most minor soils have properties similar to those of the dominant soil or soils in the map unit, and thus they do not affect use and management. These are called noncontrasting, or similar, components. They may or may not be mentioned in a particular map unit description. Other minor components, however, have properties and behavioral characteristics divergent enough to affect use or to require different management. These are called contrasting, or dissimilar, components.They generally are in small areas and could not be mapped separately because of the scale used. Some small areas of strongly contrasting soils or miscellaneous areas are identified by a special symbol on the maps. If included in the database for a given area, the contrasting minor components are identified in the map unit descriptions along with some characteristics of each. A few areas of minor components may not have been observed, and consequently they are not mentioned in the descriptions, especially where the pattern was so complex that it was impractical to make enough observations to identify all the soils and miscellaneous areas on the landscape. The presence of minor components in a map unit in no way diminishes the usefulness or accuracy of the data. The objective of mapping is not to delineate pure taxonomic classes but rather to separate the landscape into landforms or landform segments that have similar use and management requirements. The delineation of such segments on the map provides sufficient information for the development of resource plans. If intensive use of small areas is planned, however, 8 Custom Soil Resource Report onsite investigation is needed to define and locate the soils and miscellaneous areas. An identifying symbol precedes the map unit name in the map unit descriptions. Each description includes general facts about the unit and gives important soil properties and qualities. Soils that have profiles that are almost alike make up a soil series. Except for differences in texture of the surface layer, all the soils of a series have major horizons that are similar in composition, thickness, and arrangement. Soils of one series can differ in texture of the surface layer, slope, stoniness, salinity, degree of erosion, and other characteristics that affect their use. On the basis of such differences, a soil series is divided into soil phases. Most of the areas shown on the detailed soil maps are phases of soil series. The name of a soil phase commonly indicates a feature that affects use or management. For example, Alpha silt loam, 0 to 2 percent slopes, is a phase of the Alpha series. Some map units are made up of two or more major soils or miscellaneous areas. These map units are complexes, associations, or undifferentiated groups. A complex consists of two or more soils or miscellaneous areas in such an intricate pattern or in such small areas that they cannot be shown separately on the maps. The pattern and proportion of the soils or miscellaneous areas are somewhat similar in all areas. Alpha-Beta complex, 0 to 6 percent slopes, is an example. An association is made up of two or more geographically associated soils or miscellaneous areas that are shown as one unit on the maps. Because of present or anticipated uses of the map units in the survey area, it was not considered practical or necessary to map the soils or miscellaneous areas separately. Below please find supporting documentation of the Application Points A through F which identify the particular site conditions that exist on the subject property for which the literal enforcement of the zoning law would cause hardship to the Applicant, and would be contrary to the public good and intent of the law. A. The parcel is a single family residential house lot located in the Residence 1 District(RI) and within the Watershed Protection Overlay District. The specific variance request is for the construction of new permanent structures within the Non-Disturb Buffer Zone which extends between 75' and 150' from the edge of a wetland resource area located within the Watershed Protection District. The new permanent structures proposed to be constructed under this variance request are residential accessory use structures consisting of; an in-ground swimming pool and its associated patio and enclosure fencing; and a segmented retaining wall to facilitate grading and the construction of the pool.No change in the proposed use of the property is proposed under this request. B. The parcel is a two(2)acre parcel located entirely within the Watershed Protection l Overlay District of which approximately 48%of the lot lies within the Non-Disturb Buffer Zone and Conservation Zone of the District. The parcel is hammer shaped with the bulk of the parcel, or the head of the hammer,being the northerly and westerly portion of the lot that fronts on Country Club Circle. The handle portion comprises the balance of the lot and is located on the easterly and southerly portion of the parcel. The handle portion of the lot consists of approximately 0.75 acres and is at a substantially lower elevation than the remainder of the parcel. The majority of this portion of the property is located in the Non-Disturb Buffer Zone and Conservation Zone of the District. Due to the differences in topography and the extent of the Non-Disturb Buffer Zone and Conservation Zone areas within this portion of the parcel,the construction of the pool and accessory structures is not feasible within this portion of the site. Additionally if the parcel was shaped as a traditional rectangular parcel rather than a hammer, additional area would be available for the construction of the pool. The hammer portion of the parcel,the bulk of which was previously disturbed during the development of the parcel, affords the only area of the lot where construction of the proposed structures is possible. The westerly 2/3 of the this area is where the existing dwelling and driveway are located thereby leaving the easterly third of the hammer portion,to the rear of the dwelling,the only feasible location for the swimming pool and the associated fencing and wall structures.A natural knoll exists along the northerly portion of this area which is suspected to be the result of shallow ledge. The placement of the pool within this area was avoided due to the possibility of ledge which is further explained below. The balance of the easterly portion to the rear of the dwelling was filled during the construction of the dwelling and is presently lawn area. This area presents the only viable location within the entire parcel for the placement of the pool and accessory structures. The topography in this area slopes down to the rear property line resulting in a grade differential of 12 feet. Due to this grade differential a retaining wall is necessary to support the pool construction. The site's geology further restricts the possible locations for the proposed pool and associated structures. Soils within the site are defined by NRCS as those being of the Chatfield-Hollis-Rock outcrop complex,(Refer to attached hydraulic report summary). Chatfield-Hollis-Rock complex soils are comprised of fine to gravelly sandy loams with underlying unweathered bedrock. The presence of bedrock within the site is evident as a large bedrock outcrop exists within front of the yard between the driveway and Country Club Circle.Along the northerly and northeastern portion of the parcel a natural knoll exists,which was primarily left at its natural grade during the development of the parcel and is suspected to be the result of the shallow bedrock. Due to the presence of the underlying bedrock,the placement of the pool towards this knoll area will most likely result in the necessity to remove ledge. This will result in a financial hardship for ledge removal; cause a substantial disruption of the property and the surrounding area; necessitate increased levels of construction and increase the potential for the transportation of dust and sediments to resource areas during construction, all of which are detrimental to the intent or purpose of the Zoning Bylaw. 2 As such the odd shape,topology and geologic conditions which exist on the parcel afford limited alternatives for the pool and associated structures without causing additional financial hardships all of which are not affected by the zoning district. C. As a result of the parcels shape,topology and geological features indicated above the placement of the pool and supporting structures is limited to three alternatives: • The first alternative: being the proposed area identified on the plans will require a variance. This area was previously altered by fill during the development of the property and will result in minimal disruption of additional natural land which supports the intent of the Watershed Protection District. This area also affords the most economical location for the pool,wall and associated structures. • The second alternative: is to locate the pool northerly from the planned location a sufficient distance to eliminate the necessity of constructing the pool,retaining wall within the Non-Disturb Buffer Zone. A plan depicting this alternative is attached to these supporting documents and is identified as Alternative 2. This alternative requires the pool to be located partially within the natural knoll adjacent to the northeast corner of the dwelling. This location would result in an increased of impervious patio area and most likely require the removal of bedrock for the installation of the pool. This alterative would increase the amount of activity required for construction within the Watershed Protection District and increase the extent of impervious area, each of which is contrary to the intent of the Overlay District. This location would also result in a substantial financial hardship resulting from the increased construction cost associated with the removal of the ledge. • As no other viable alternatives exist or are possible within the site for the location of the pool, wall and supporting structures,the third alternative is a no-build alternative. As the intent of the planned improvements is to increase the usable area of the rear yard within the limits previously disturbed, improve the aesthetics of the rear yard and to increase the value of the property. This alternative would result in the loss of improved aesthetics of the property and loss in the future resale value of the property. D. The relief sought is for the construction the new permanent structures consisting of a pool, retaining wall and fence which are typical and normal accessory structures located in residential districts and are allowed by right in the underlying Residential District. The construction of these structures will not result in an increase of density;will not add to traffic congestion or deter from providing adequate light or air;will not result in an increase of hazards; will not affect water quality and will not result in a substantial detriment to the public good. E. The Watershed Protection Overlay District is to provide protection to the Town's sole water supply Lake Cochichewick through the preservation and purity of the ground water, the lake and its tributaries; and to maintain the ground water table; filtration and purification functions of the land;while conserving the natural environment. As proposed the construction of the swimming pool,retaining wall and fence enclosure is located in an area,the majority of which has been previously disturbed during the 3 development of the parcel therefore minimal new undeveloped areas of the environment will be disturbed. Additionally two Bioretention Areas(Rain Gardens) are proposed to capture run-off from impervious surfaces which will provide for the treatment of stormwater run-off and enable recharge of stormwater to pre-development levels. The incorporation of these Bioretention Areas insures the protection of the town's water supply through the preservation and purity of the ground water. Additionally during construction Best Management Practices(BMP)will be instituted to ensure the protection of adjacent resources areas. The BMP's proposed are: • Installation of a siltation barrier to capture and prevent the transportation of sediments during construction. • Maintenance and repair of the erosion barrier throughout construction and until a vigorous growth of vegetation has re-established. • Prompt loam and seeding of disturbed areas. • Proper storage and protection of stored materials. Post construction BMP's will consist of restricting the use of fertilizers to organic or slow release nitrogen products and ensuring the periodic discharge of pool water is performed in accordance with DEP standards. The measures identified above proposed to be employed to recharge groundwater, preserve ground water and maintain water quality and quantity support a finding that the relief sought may be given without nullifying or substantially derogating from the intent or purpose of the Zoning Bylaw. F. This application is not for a variance from (7.1.1) Contiguous Buildable Area therefore a RDA from the Conservation Commission is not required. NRCS SOIL REPORT 2 INTRODUCTION: This report describes the pre and post hydraulic analysis and stormwater management measures proposed to be implemented to mitigate the potential impacts to the Watershed Protection District resulting from the proposed site improvements to the residential property located at 58 Country Club Circle,North Andover, Massachusetts 01845. The design of the stormwater system's components and the computation of pre and post development runoff rates and volumes are based on a hydraulic analysis performed utilizing "HydroCAD Storm water Modeling Software" for storm events of 2, 10 and 100-year storm frequencies. EXISTING CONDITIONS: The project site is located on the northeasterly end of the Country Club Circle cul-de-sac and is bounded by residential properties to the north, south and east; and westerly by the North Andover Country Club. The site is comprised of a 2 acre and developed residential lot. The parcel is within the Watershed Protection District and is located in excess of 400 feet from the mean annual high water mark of Lake Cochichewick,the Town's public drinking water supply. A bordering vegetated wetland(BVW) which is tributary to Lake Cochichewick is located to the east of the site. As a result of the sites proximity to the BVW the site is located within the Non-Discharge Zone and Non-Disturbance Zone of the Watershed Protection District. PROPOSED IMPROVEMENTS: The improvements proposed for the site consist of the following items: • Replacement of existing walkways • Replacement and enlargement of existing patio • Installation of a pool with spa and associated deck • Installation of protective fencing • Installation of a retaining wall • Expansion of lawn area, landscaping and associated fill and grading • Rain Gardens The retaining wall; portions of the pool and pool deck; and portions of the fill, lawn and landscape areas are located within the Non-Disturbance Zone. All other proposed improvements are located within the Non-Discharge Zone. The installation of the rain gardens are proposed to mitigate the increases of post run-off rates and volumes to levels equal to or below pre-development rates and volumes. 3 SITE SOILS: No soil tests were performed and the hydraulic analysis provided herein is based on site soils as classification by NRCS. The NRCS soils report, which is appended to this hydraulic analysis, classifies site soils as those being of the Chatfield-Hollis-Rock outcrop complex. Chatfield-Hollis-Rock complex soils are comprised of fine to gravelly sandy loams with underlying unweathered bedrock. The Chatfield soils are soils belonging to the hydrologic soil group A and Hollis soils are of the D hydrologic soil group. To take a conservative approach in establishing a comparison of pre and post run-off rates and volumes the site was modeled as HSG B soils in the hydraulic analysis. Additionally the corresponding Rawls infiltration rate of 1.02 inches per hour for HSB B sandy loams is utilized in modeling the infiltration rates for the proposed rain gardens. SIL TATIONAND EORSION CONTROL: To effectively manage the impacts to the environment, to the surrounding properties and to the Watershed Protection District during construction of the of the proposed site improvements the following ENT's are proposed. ➢ Siltation barrier-A siltation barrier will be installed and maintained at the proposed limit of work during construction to control and prevent erosion and transportation of sediments to the resource area and Watershed District. This barrier shall be maintained until suitable growth of vegetation has been established in all disturbed areas. ➢ A Construction entrance will be installed and maintained to prevent erosion and transportation of sediments during construction. ➢ A protected concrete washout area shall be established for collection and for the proper disposal of spent concrete products. ➢ During construction materials will be properly stored and disposed of. ➢ Other construction BMP's shall be utilized as deemed necessary during contraction to ensure the protection of the resource area and Watershed District. 4 SUMMARY: As indicated in the summary below, with the incorporation of the proposed rain gardens, the post-development run-off rates and volumes equal or result a reduction of the pre-development run-off rates and volumes for the 2, 10 and 100-year storm events.
