The North Andover Board of Appeals held a public hearing at The Senior Center,at 120R Main Street,
North Andover, MA on Tuesday,June 19, 2012 at 7:30 PM on the application of Donna Taylor for
property located at 59 Bonny Lane(Map 62,Parcel 56),North Andover, MA 01845. Petitioner is
requesting a Variance and Special from Section 9,Non-Conforming Uses and Sections 9.1, 9.2,and 9.2.1
and also Table 2 of the Zoning Bylaws within the R-I Zoning District to construct a Sunroom addition.
Legal notices were sent to all the certified abutters provided by the Town of North Andover,Assessors
Office, and were published in the Eagle-Tribune, a newspaper of general circulation in the Town of North
Andover, on June Sf' and June 12"'2012.
The following voting members were present: Ellen P. McIntyre, Richard J. Byers and D. Paul Koch Jr.
The following Associate members were present: Michael Liporto and Tyler Speck
Byers made a motion to Grant the Variance under Table 2 of the Zoning Bylaws, for the left side set
back of 10.5 feet to construct the addition of the sunroorn in the R-1 Zoning District.
With the following condition: that the "Notice of Decision-Watershed Special Pen-nit-Waiver", from
the Planning Board to the applicant be submitted into the files, for 59 Bonny Lane(Map 62, Parcel 56).
Koch second the motion to Grant the Variance.
The following members voted in favor to GRANT the Variance: Ellen P. McIntyre, Richard J. Byers, D.
Paul Koch Jr., Michael Liporto and Tyler Speck.
All voted in favor 5-0.
The Board finds that that owing to circumstances relating to soil conditions, shape, or topograph�, of the
land or structures and especially affecting such land or structures but not affecting generally the zoning.

The North Andover Board of Appeals held a public hearing at The Senior Center, at 120R Main Street,
North Andover, MA on Tuesday, June 19, 2012 at 7:30 PM on the application of Donna Taylor for
property located at 59 Bonny Lane(Map 62,Parcel 56),North Andover,MA 01845. Petitioner is
requesting a Variance and Special from Section 9,Non-Conforming Uses and Sections 9.1, 9.2, and 9.2.1
and also Table 2 of the Zoning Bylaws within the R-1 Zoning District to construct a Sunroom addition.
Legal notices were sent to all the certified abutters provided by the Town of North Andover,Assessors
Office, and were published in the Eagle-Tribune, a newspaper of general circulation in the Town of North
Andover,on June 5"'and June 12"'2012.
The following voting members were present: Ellen P.McIntyre,Richard J. Byers and D. Paul Koch Jr.
The following Associate members were present: Michael Liporto and Tyler Speck
Byers made a motion to Grant the Variance under Table 2 of the Zoning Bylaws, for the left side set
back of 10.5 feet to construct the addition of the sunroom in the R-1 Zoning District.
Wth-the-following-condition: that-the"'Notice of-Decision-Watershed-Special-Permit=Waiver", from
the Planning Board to the applicant be submitted into the files,for 59 Bonny Lane(Map 62,Parcel 56).
Koch second the motion to Grant the Variance.
The following members voted in favor to GRANT the Variance: Ellen P. McIntyre, Richard J. Byers,D.
Paul Koch Jr., Michael Liporto and Tyler Speck.
All voted in favor 5-0.
The Board finds that that owing to circumstances relating to soil conditions, shape, or topography of the
land or structures and especially affecting such land or structures but not affecting generally the zoning
district in general, a literal enforcement of the provisions of the Bylaw will involve substantial hardship,
financial or otherwise, to the petitioner or applicant. The Board finds that desirable relief may be granted
without substantial detriment to the public good and without nullifying or substantially derogating from
the intent of the purpose of this bylaw
The Board also finds that this use, as developed by the building and site plans, will not adversely affect
the neighborhood. There will be no nuisance or serious hazard to vehicles or pedestrians since there are
provisions for the required off-street parking. Adequate and appropriate facilities are provided to the
existing residential dwelling for the proposed addition of the Sunroom to be constructed. The Board finds

that the sunroom will not be substantially detrimental to the existing single-family dwelling and to the
neighborhood and that this use, of a sunroom will be in harmony with the neighborhood and general
pur ose and intent of this B law.

Premises Affected: 59 Bonny Lane,North Andover, MA 01845, Map 64 Parcel 56, within
the R-1 zoning district.
HISTORY AND BACKGROUND
On May 23, 2012, the applicant requested a waiver of the Watershed Protection District Special
Permit, in accordance with the North Andover Zoning Bylaw section 4.136.8, so as to allow the
construction of a 210 sq.:ft. (15' X 14') sunroom. The sunroom will be constructed on top of an
area that was previously a concrete deck. The concrete deck will be removed and the sunroom
will be constructed using sonotubeg. The new deck will be located within the 250-foot Non-
Disturbance buffer zone of the Watershed Protection District.
DECISION
After a Planning Board meeting on the above date, and upon a motion by R. Rowen and 2nd by T.
Seibert, a vote was taken with regard to a waiver of the Watershed Special Permit. The vote was
unanimous in favor of the waiver.
FINDINGS OF FACT
The Planning Board has.made its decision based on the following findings:
• The existing concrete deck will be removed and the sunroom will be built using
sonotubes.
• The proposed changes will not create a more detrimental impact on the wetlands than
exist on the property and there will not.be_any significant degradation of the quality or
quantity of water in or entering Lake Cochichewick.
CONDITIONS
1. Proper erosion control will be constructed and will remain throughout the project,
according to the conditions approved by the Planning Office staff
2. The Planning Office will perform an inspection before and after construction.
