This agreement is made this 31st day of October, 1995, by and between Mr. Jay Philbin, Philbin Construction Co. . (Herein after "Philbin") of 33 Walker Rd. , N.Andover, Ma. , and Mr. Michael Geragosian, (Herein after "Geragosian") of 59 Paddock Lane, N.Andover, Ma. 2. Whereas Geragosian wants Philbin to perform work as described on attached Plans and Specification(s) Sheet at 59 Paddock Lane, N.Andover, Ma. , the parties agree as Follows: 3. In consideration of Philbin performing said work, Geragosian shall pay to Philbin the sum of $70,000. Further, Geragosian shall pay $10,000 of this figure upon the execution of this agreement by the parties. 4. The balance shall be paid as follows: Section 1 . PLANS/PERMITS- Prepare and submit plans and completed application to the Town of North Andover Building Department. Pay all necessary fees and obtain permit. 2. ENGINEERING- Engage the services of Christiansen Engineering to locate the garage side lot line by "flagging" the same. Geragosian to make existing certified plot plan avail- able to Philbin. Subsequently, Philbin will make available to Town of N.Andover and Geragosian, the "as-built" survey (Christiansen) upon the completion of the new garage foundation. 3. EXCAVATION- Excavate suitable foundation hole to accept footings and foundation walls. Create proper ramping for poured concrete foundation. 4. FOUNDATION- To be poured concrete (3000 psi) with 10"x20" footings,�� thick knee walls, required lally column footings. C. 5. BACKFILL/FLOOR PREP- The exterior of the new garage foundation will be backfilled with existing material (from excavation) and graded in a proper manner to comply with the current topography. Lawn to be reseeded in the Spring. The interior of the new garage will be backfilled with material conducive to the proper prep work to accept a poured concrete floor. 6. GARAGE FLOOR- To be poured concrete (3000 psi) , 4" thick, and 4" pitch to garage doors. Rear section (6'x24') to be stepped-up and leveled for storage area. 7. DUMPSTER- Philbin will maintain a suitably sized container for construction debris thru-out the construction period as he deems necessary. Said container will be located on site in a mutgtua I agreeable location. 8. PERSONAL PROPERTY--Geragosian will remove all non-structural items from the existing garage to a location well away from and not interfering with the construction area. Philbin will give Geragosian a (10) notification lead. 9. FRAMING- Lumber will meet or exceed Building Code and will include 2x6 PT sills, 2x10 floor joist, exterior walls, 3/4 T&G sub floor, 1/2 plywood sheathing, 2x4 interior partitions, afters, 2x10 ceiling joist, all necessary structural elements. Tyvek housewrap, 1x6 pine facia, 1x10 pine soffits, 2. DOORS/WINDOWS- Anderson thermopane windows (9) with screens and grilles (builders line) will be used. Anderson (or velux) skylights (2) will be used. Stanley metal doors (3) will be used-note- Geragosian to select from Philbin's builders line of selection. 3. ROOF- Ice and water shield on leading edges of roof, bird 80 lb asphalt shingle to match (as possible) existing house/garage shingles. 4. SIDING- Cedar clapboards (4j" to weather) will be 3nsfalled using stainless steel nails. All exterior siding, trim, doors, windows will be stain/painted (2) coats using Benjamin Moore brand. Colors to be selected by Geragosian from samples supplied by Philbin or his painter. SECTION 3 (Dec 26-Jan 12) 1. ELECTRICAL (Rough)- Labor and material to bring home run from existing service to new addition, Closets,..:garage, and storage area to have porcelain fixtures. There will be (12) recessed ceiling lights with new FR having a dimmer switch. New garage to have (1) 2-head flood and (1) single head flood. All convenience outlets, smoke detector, door bell system, and GFI as per code. Builders "bug" lights for front and rear doors. 2. PLUMBING (Rough)- Labor and material for (2) bathroom sinks, (1) elongated toilet, and (1) one-piece 5-0' Tub/Shower. All to be Kohler/Delta. All piping supply and waste as per code. 3. INSULATION- As per code with 3J batts exterior walls and 6" ceiling. Garage ceiling to be 6" Batts. Interior poly wrap stapled as required by code. 4. PHONE/CABLE TV- (3) phone outlets and (3) cable TV outlets to be provided. Wiring for '' Ga ge door_ openers to be provided. w SECTION 3 (cont) 5. BOARD/PLASTER- All interior walls will have 1/2" blueboard with skimcoat plaster. Ceilings and closets will have a textured finish while all walls will have a smooth. finish. Garage ceiling and common wall will fire code. 6. GARAGE DOORS- Doors to be supplied by Philbin's vendor (American Garage Dorr Co.) . Doors will horizontal paneled, wood grain, insulated (foam) , and will be equipped with automatic openers. SECTION 4 (Jan 15-26) 1. INTERIOR FINISH- Labor and material to install Morgan six-panel pine doors where shown on plans with 2J" colonial casing. Stairway to have 4x4 newel posts with 2x6 rail and 2x2 balusters wood prepped for carpet. Uphall railing to match stairway railing. All appropriate door/window hardware to be installed. Closets to have white wire enamel shelf systems. Bathroom and down hall to have appropriate underlayment. (1) 5-0' Pine Vanity with colonial style doors a (1) row of drawers to be installed. All double- hung windows to have 2J" colonial cased trim kits applied. 2. HEATING- Included in the contract price is a HEATING ALLOWANCE of $7,500. It is the intent of Geragosian And Philbin to use these monies as directed by Geragosian to supply an adequate source of heat and it's accompanying labor and material to meet with all existing Town/State Heating Codes. Geragosian agrees to make heating decisions in a timely manner to facilitate the on-going construction. SECTION 5 (Jan 29-Feb 9) 1. ELECTRICAL/PLUMBING-Complete all items as set forth in section 3 of this agreement. 2. INTERIOR PAINT- There is a PAINTING ALLOANCE of $1,500.
