Notice is hereby given that the Board of Appeals will hold a public hearing at the
Senior Citizen's Center located at the rear of Town Hall Building, 120 Main
Street, North Andover on Tuesday the 9th day of January 1996 at 7:30 o'clock
to all parties interested in the appeal of Edward Hamel as a Party Agrrieved as a
result of a decision issued by the Building Inspector in regards to a log cutting
and splitting operation to supply the retail/mercantile selling of fire wood.
Said premise is located at 591 Turnpike Street which is in the R-6 Zoning
District. Plans are available for review at the Office of Community Development
& Services, Town Hall Annex, 146 Main Street.

The Board of Appeals held a regular meeting on Tuesday evening, January 9,
1996 upon the petition of Edward Hamel as a Party Aggrieved as a result of a
decision issued by the Building Inspector in regards to a log cutting and splitting
operation to the supply the retail/mercantile selling of fire wood on property
located at 591 Turnpike Street, Zoning District R-6.
The following members were present and voting: Walter Soule, Raymond
Vivenzio, Ellen McIntyre, John Pallone and Joseph Faris.
The hearing was advertised in the North Andover Citizen on 12.20.95 and
12.27.95 and all abutters were notified by regular mail.
Upon a motion by Raymond Vivenzio and seconded by John Pallone the Board
voted unanimously to allow the applicant to withdraw the petition without
prejudice.
Voting in favor Walter Soule, Raymond Vivenzio, John Pallone, Joseph Faris and
Ellen McIntyre.

Dear Mr. Hamel:
A complaint has been filed that you are conducting a log cutting
and splitting operation to supply the retail/mercantile selling of
fire wood in a Residential 6 (R-6) District.
Investigation of the site reveals a true complaint.
The processing of fire wood is not an allowed use in the R-6
District and within ten (10) -days of receipt of this decision, you
must cease all processing and selling activities at 591 Turnpike
Street.
Section 10.3 of the North Andover Zoning By -Law reads that:
"Whoever continues to violate the provisions of this Bylaw
after written notice from the Building Inspector demanding
an abatement of a zoning violation within a reasonable time,
shall be subject to a fine of three hundred dollars (5300).
Each day that such violation continues shall be considered
a separate offense."
Pursuant to Section 10.4 of the Zoning By -Law, you may grieve this
decision within thirty (30) days to the Zoning Board of Appeals.
In the event that the Zoning Board of Appeals upholds your
grievance, you will then have to file for a Special Permit to
market fire wood in the R=.6 District. The -Planning IBoard is the

District and within ten (10) days of receipt of this decision, you
must cease all processing and selling activities at 591 Turnpike
Street.
Section 10.3 of the North Andover Zoning By -Law reads that:
"Whoever continues to violate the* provisions. of this Bylaw
after written notice from the Building Inspector demanding
an abatement of a zoning violation within a reasonable time,
shall be subject to a fine of three hundred dollars (5300).
Each day that such violation continues shall be considered
a separate offense."
Pursuant to Section 10.4 of the Zoning By -Law, you may grieve this
decision within thirty (30) days to the Zoning Board of Appeals.
In the event that the Zoning Board of Appeals upholds your
grievance, you will then have to file for a Special Permit to
market fire wood in the R-6 District. The Planning Board is the
