Dear Mr . Long:
The Board of Appeals held. a public hearing on Monday evening,
January 30, 1984 upon the application of George Farr. The
hearing was advertised in the North Andover- Citizen- on
January 12 and 19, 1984 and all abutters were notified by
regular mail . The following members were present -and - voting:
Frank Serio Jr. , Chairman; Alfred E. Frizelle, Esq. , Vice-
Chairman; and Associate Members Walter F. - Soule; Maurice S . -
Foulds; and -Raymond A. Vivenzio, Esq.
The petitioner seeks a variance from the provisions of-
Section 7, Paragraph 7 . 3 and Table 2 of the Zoning By Law
so as to permit relief from the setback requirements to
allow the continued existence of a dwelling which does not
meet the side setback requirements on premises located at
60 Granville Lane, also known as Lot #25, Granville Lane .
Mr . Farr and his surveyor testified that through an engin-
eering error, a porch was constructed on the rear of the
dwelling too close to the side property line. The porch
will be enclosed and used as part of the structure. The -
petitioner would suffer an economic hardship if the variance
is denied, since the porch will have to be removed or
additional_ land purchased. The porch was not shown on
the building permit .
No opposition was voiced at the hearing.

A motion was made by Mr. Vivenzio and seconded by Mr . Soule
to grant the variance as requested. The motion failed to
carry, with Members Serio, Vivenzio, and Soule voting in
favor and Members Frizelle and Foulds voting in opposition.
Pursuant to M.G.L. , Chapter 40-A and the Zoning By Law of
North Andover, Section 10, Paragraph 10.4 ( 2 ) , the petition
is denied .
In denying the petition, the Board finds that Section 10 .4
of the Zoning By Law has. not been satisfied. In particular,
the Board finds that the evidence presented by the petitioner
failed to show a hardship as required by Section 10.4 of
the Zoning By Law.
