RE: VIOLATION of the Massachusetts Wetland Protection Act (310 CMR 10.00)
and the North Andover Wetland ByLaw (Ch. 178 of the Code of North
Andover)
Dear Sir:
The Department of Environmental Protection, Environmental Strike Force Unit requested
that I respond to an anonymous complaint regarding the discharge of petroleum products
and/or cleansing agents from the above referenced property into the Shawsheen River.
A site inspection at the above referenced property at 3:00 p.m. on May 19, 1995 revealed
the following activities:
• Petroleum product release into a Bordering Vegetated Wetland (BVW) and riverine
system;
• Tree clearing within 100of a wetland resource area.
Any activity proposed within 100' of a wetland resource area as defined under the
Massachusetts Wetlands Protection Act (3 10 CMR 10.00) and/or the Town of North
Andover's Wetland ByLaw (Ch. 178 of the Code of North Andover) is subject to review
by the Conservation Commission (NACC) and the Department of Environmental
Protection (DEP). Activities proposed within a wetland resource area are subject to a
valid Order of Conditions issued by the local Conservation Commission.
A member of the North Andover Conservation Commission and myself witnessed an
employee from Napoli Trucking rinsing down a large truck with cleansing agents in the
driveway of#61 Inglewood Street. The rinse water contained an obvious sheen and it
became apparent at this time that a petroleum product was being illegally discharged into a
wetland resource area (Shawsheen River and BVW). Direct point source discharge of a

petroleum product into a wetland resource area without a valid permit is a violation of the
Act and regulations listed above as well as a violation of the Commonwealth of
Massachusetts Hazardous Waste Regulations. Enclosed please find an Enforcement
Order calling for a cease and desist of the above mentioned activity.
It was also noted that vegetation had been cleared within 100' of a wetland resource area
for the purposes of constructing a parking lot for construction vehicles. Enclosed please
find a Violation Notice documenting this activity. Future work within 100' of this
BVW will require the filing of a Notice of Intent with this Department. No work is
permitted in this area without a valid Order of Conditions issued by the NACC.

Signs And Symptoms Of Overexposure: EYES- Tearing, stinging, redness.
SKIN- Stinging, redness, some swelling possible. INHALATION-
Coughing, soreness in respiratory tract, chest tightness, difficulty
breathing.
Conditions Generally Recognized As Being Aggravated By Exposure:
Persons with pre-existing skin disorders may be more susceptible to
irritating effects. Persons with pre-existing lung disorders may be
more susceptible to irritating effects.
Emergency And First Aid Procedures: EYES- Immediately flush with plenty
of cool water for at least 15 minutes while holding the eyelids open.
Do not attempt neutralizing with chemical agents. Contact a
physician immediately. SKIN- Immediately remove contaminated
clothing and flush area with large quantities of water for at least
15 minutes. Do not attempt neutralizing with chemical agents.
Contact a physician if irritation develops. INGESTION- If patient
conscious, give several glasses of water for dilution effect and
contact a physician. Do not induce vomiting. Do not give an
