RE: VIOLATION - Massachusetts Wetland Protection Act(MGL C.131 S.40)
and the North Andover Wetland ByLaw and Regulations (0.178 of the
Code of North Andover).
Dear Mr. and Mrs. Forbes:
This Department is in receipt of a complaint citing alteration of a wetland
resource area as defined under MGL C.131 S.40 at the above referenced property.
Specifically, it is alleged that fill material has been placed within the limits of an
on-site stream without a valid permit from the North Andover Conservation
Commission (NACC). The complainant alleges that the fill material in question
is restricting stream flow and, as such, adversely impacting adjacent properties
during storm events.
Any activity proposed or undertaken within an area specified in the Act(3 10
CMR 10.02)(1)(a) which will remove, fill, dredge or alter that area is subject to
regulation under M.G.L. c.131 s.40 and requires the filing of a Notice of Intent
with the North Andover Conservation Commission (NACC) and Massachusetts
Department of Environmental Protection (DEP).
Furthermore, any activity proposed or undertaken within 100' of an area
specified in 310 CMR 10.02(1)(a) (hereinafter called the Buffer Zone) which in the
judgment of the issuing authority, will alter an Area Subject to Protection under
M.G.L. c.131 s.40 is subject to regulation and also requires the filing of a Request
for Determination and/or Notice of Intent.
Upon receipt of this document please schedule accordingly with this Department
so that a site inspection can occur in a timely manner.
Your anticipated cooperation is appreciated.
