The current exemption for "homeowners" was extended to include owner-occupied dwellings
of six units or less and to allow such homeowners to engage an individual for hire who does
not possess a license, provided that the owner acts as supervisor. (State Building Code Sec-
tion 109.1.1)
DEFINITION OF HOMEOWNER:
Person(s) who owns a parcel of land on which he/she resides or intends to reside, on which
there is, or is intended to be, a one to six family divelling, attached or detached structures ac-
cessory to such use and/or farm structures. A person who constructs more than one home in a
two-year period shall not be considered a homeowner . Such "homeowner" shall submit to
the Building Official, on a form acceptable to the Building Official, that he/she shall be
responsible for all such work performed under the building permit. (Section 109.1.1)
The undersigned "homeowner" assumes responsibility for compliance with the State Building
Code and other applicable codes, by-laws, rules and regulations.
The undersigned "homeowner" certifies that he,/she understands the Town of No. Andover
Building Department minimum inspection procedures and requirements and that he/she will
comply with said procedures and requirements.

RE: Permit application for garage roof repairs and new deck @ 65 Ferncroft Circle
Dear Mr. & Mrs. Rooney,
Please be advised that upon an inspection at the above referenced property it was
observed that the work was completed without the benefit of a building permit. Please be
advised that this is in violation of the MA State Building Code Chapter 1 section 101.2
(780 CMR Commonwealth of Massachusetts Regulations) "shall control all matters
concerning the construction, reconstruction, alteration, repair, removal, inspection,
issuance and revocation of permits or licenses..." ,
Please be advised that the State Building Code Chapter 1 Section 118.4 Violation
Penalties: "Whoever violates any provisions of 780 CMR except any specialized code
referenced herein shall be punishable by a fine of not more than $1000., or by
imprisonment for not more than 1 year, or both for each such violation. Each day during
which a violation exists shall constitute a separate offense..."
