Rules and Regulations of the Planning Board and;
2.Site Plans-Plans submitted shall meet the requirements contained
in Section 8.3(Site Plan Review)to the extent applicable.
B.Review by Other Town Departments:The Planning Board shall within
ten days of receipt of an application under this Section,refer the applica-
tion to the Conservation Commission,Public Works Department,Board of
Health,Building Ins for,Police Department,and Fire Department for
written reports and re mmendations.No decision shall be made until
such reports are returned or thirty-five days have elapsed following such
referral without receipt of such report.
0. Findings of the Planning Board:The Planning Board may issue a
special permit under this section only it the Planning Board finds that the
PRD is in harmony with the general purpose and intent of this section and
Section 10.3 (Special Permit)and that the PRD contains residential
development and open space in a variety to be sufficiently advantageous
to the Town and meets the purpose and intent of this section,which
renders it appropriate to depart from the requirements of this bylaw
otherwise applicable to the Zoning District in which the PRD parcel is
located.
It a special permit is granted,the Planning Board may impose a condi
tion thereof that installation of municipal services and construction of
roadways within the PRD shall comply with the requirements of the Sub
division Rules and Regulations of the Planning Board. Further, tht
Regulations of the Planning Board may require sufficient security to em
sure compliAme with the Subdivision Rules and Regulations,planner
recreation facilities and site amenities; and may impose additiona
safeguards pertaining to public safety,welfare and convenience.
6.Development Standards:
A.Allowable Parcel Size:For each application filed for a special permi
under this section,the applicant must have a contiguous parcel of land
in single or consolidated ownership at the time of application,which is a

N. Andover, MA 01845 * DECISION
The Board of Appeals held a public hearing on May 10 and August 9, 1988 and a
Special meeting on Monday evening, August 22, 1988 upon the application of
Willows Park Child Care Center requesting a Special Permit of Section 4,
Paragraph 4.131(17) of the Zoning Bylaws so as to permit a day care center
at 65 Flagship Drive. The following members were present and voting: William
Sullivan, Acting Chairman, Augustine Nickerson, Clerk, Walter Soule and Raymond
Vivenzio.
The hearing was advertised in the North Andover Citizen on April 21 and April 28,
1988 and all abutters were notified by regular mail.
Upon a motion made by Mr. Nickerson and seconded by Mr. Vivenzio, the Board
voted, ' unanimously, to DENY the Special Permit as requested.
The Board finds that the petitioner has not satisfied the provisions of Section 10,
Paragraph 10. 31 of the Zoning ByLaws and the granting of this Special Permit would
derogate from the intent and purposes of the Zoning ByLaws and would adversely
affect the neighborhood.

Dear Sirs:
I enclosed herewith five copies of the revised plan for
the Board' s consideration. Please note that the rear entrance
to the building has been expanded in the access area to 12 feet
pet the request of the police and fire department.
There is one correction on the plan which does not appear
in the drafts. If you will note on the facade rendition of the
building, there is an indentation into the curb provided so as
to allow an area where automobiles can swing out of the flow of
traffic for the unloading of passengers. On one of the cite
plans submitted herewith, I made hand written notations to
correct the curb shown and advise the Board that amended plans
will be submitted to incorporate the curb line as shown on the
facade plan.

' Dear Sirs:
Please accept this letter as response to the input from
the municipal department heads.
A. FIRE CHIEF: The Fire Chief has been very cooperative in
reviewing the site on two occasions since last presenting
this matter to the Board. He has prepared a report
specifying the areas of noncompliance within the building
presently occcupied by Microwave Developement Corporation
which letter is appended hereto. The applicant stipulates
that he will comply fully with the recommendations of the
report and in addition thereto incorporate within the
child care area the following suggestions of the Fire
Chief:
1. The fire alarm system installed in the child care
center will have the capacity to handle the child
care area and in addition allow for expansion into
the area presently occupied by Microwave Development
Corporation. It is anticipated that on change of
tenancy in the Microwave area, that the fire system
will ' be updated and the intent is to provide the
present capacity to do so.
2. The plans presented to the Board are amended so as to
allow fire truck access to the rear and side of the
building. The intent is to complete as nearly as
possible a 360 degree access to the facility.
We defer to any further recommendations the Fire Chief may
wish to make.

B. BUILDING INSPECTOR: The painting area which the Building
Inspector is concerned with is exhausted to the outside of
the building after a filtering process. There is some back
draft of fumes through an adjacent door and it is your
applicants recommendation and stipulation that the vent
fan be exhausted with a stack to lift the exhaust point
above the roof line to prevent any infiltration of fumes
into the building.
The traffic concerns are addressed later in this report.
C. TOWN PLANNER: The specific site concerns regarding
traffic circulation, fire emergency access, and the other
six items enumerated in Mr. Stocking's memorandum of May
10, 1988 are incorporated into the plans as previously
submitted to the Board.
D. POLICE REPORT: The concerns of the Police Department
regarding traffic safety are addressed by the preliminary
traffic study submitted through Richard F. Kaminski &
Associates, Inc. , a copy of which is appended hereto. The
plans submitted to the Board incorporate the traffic
patterns per the recommendation of various Town officials
which substantially address the traffic safety issues.
In addition, there is presently a petition circulating
through the Flagship Drive and Willow Park subdivision
pledging support to the extent of $15,000.00 to provide
the traffic study necessary to install lights at the Route
114 intersection with Willow Park. We recently received
input from the Massachusetts Department of Public Works
that the charges on the traffic study plans were increased
to $30,000.00 presumably due to the budget constraints
that the Commonwealth is presently facing. While no
positive representations can be made at this time, the
applicant will continue to support the efforts of the
business people in the area to effect the installation of
traffic signals at the intersection with Route 114.
The Board requested an update of the connection of the
Willow Park Extension to the Andover By-Pass, Route 125.
The right of way was established in the North Essex
Registry of Deeds on Plan No. 9650 and designated as Road
A, showing interconnection with Route 125 in addition a
temporary turn around easement that presently exists. From
various input from municipal officials, I conclude that
the Conservation Commission raised serious wetlands issues
with respect to completing this interconnection, and the
District 5, Department of Public Works, Commonwealth of
Massachusetts, has likewise resisted any further entries j
onto state highways. While the right of way exists and the
Town has the potential of completing this interconnection,
there is no present direction to effect the same.

Date: June 10, 1988
After your last meeting concerning this matter, I visited the
building to which this day care is to be incorporated.
I found conditions such that I scheduled an inspection by the
Fire Prevention Officer and the Engine II crew. This was done
on June 9, 1988. A copy of Lt. Melnikas ' s report is attached.
I could not at this time recommend that this site be utilized
for day
care because of the conditions found and would need a
proven record of fire safety consciousness prior to any such
approval.
As stated at the last meeting, neither Officer Rand nor I are
against the concept of a day care center, but as a matter of
safety for the children who will utilize this space, I must
restate my opposition to this particular site for this use.
I intend to beY resent at our June 14th meeting.

The applicant has appeared before the Technical Review Committee
in order to receive Town Department comments on this matter prior to
todays hearing .
Upon review of the project , staff has the following comments:
Overall Concerns
1 . Concern over creating 100 to 200 additional trips per
day to this facility by way of the Willow Street and
Route 114 intersection which is already heavily utilized
and does not have adequate traffic controls,
2. Planning concerns with placing 100 children in an
industrial area. Public health and safety concerns
would in most cases prohibit this type of facility
adjacent to industrial uses.
Site Specific Concerns
1 . Revision to the site plan to improve parking lot
circulation patterns. Suggest a drop off asile adjacent
to the structure. Problems with children, required to
cross thru the parking lot and traffic lanes to reach
the structure.
2. Provide for direct fire/emergency access to the front of
the structure.
3. , Landscaping required as stated in Section 8.4 of the
Zoning Bylaw,

4. Rear loading docks should be removed . The loading docks
which remain should be demonstrated by the applicant
that they can be utilized by the applicant without
blocking internal access to the rear of the structure.
5. Need a handicapped access ramp from the parking lot .
6. Need a 3 hour fire wall between the industrial use and
the day care center .

After having reviewed the plans for the proposed child care
center on Flagship Drive I am opposed to the granting of a
special permit.
This area is an industrial park which is heavily trafficed and
the nature of the businesses surrounding the area would, in
time of emergency, fire etc, pose a possible servere exposure
hazard to any children in the area.
Therefore, I strongly urge that the request not be granted.

Names & Addresses of persons involved:
On May 5 , 1988 I recieved from the Board Of Appeals a copy of a Prpposed
Daycare Center for 66 Flagship drive . It is my feeling that this would be
a bad addition to an already poor situation . These small children would
have to be transported through Rte . 114 and the intersection of Mill Road
and Turnpike St . Rte . 114 . This intersection if of great concert to me and
I feel that conditions are right for a very serious accident there. I would
hate to see a small child being transported by a parent late for work to
be that situation.
The building they wish to put the center in fronts on Flagship drive . The
volume of heave trucks and the materials these trucks carry makes the location
a poor site . I also have a concern about the playrarea , in the rear of this
building is a plant that makes Laminated products . I feel that to put the play
yard next to or near this type of plant is a poor idea.
As you know we are now trying to get a set of traffic light for this
area and intersection. If the Board of Appeals should decide to grant this
special per mit I would ask that they have this develpoer and any others who
come to this area share in the coatuof these traffic signals .
