The Board of Appeals held a regular meeting on Tuesday evening, October 13, 1998, upon the application of Eric
and Lisa Dahl, 65 Weyland Circle requesting a Variance from the requirements of the Zoning By -Law section
7, paragraph 7.1,7.2,7.3, of table 2. The relief requested is front and rear setbacks. As indicated in the plan titled; Ian
of land titled lot 16 Weyland Circle, North Andover Mass.; prepared for Eric & Lisa Dahl; drawn by Atlantic
Engineering & Surveying Consultants; dated August 31, 1998.
The following members were present: William J. Sullivan, Walter F. Soule, Raymond Vivenzio, Scott Karpinski,
John Pallone, George Earley, Ellen McIntyre, Robert Ford,
The hearing was advertised in the Lawrence Tribune on 9/29/98 &10/6/99 and all abutters were notified by regular
mail. This application was continued to the final hearing on 1/12/99.
Upon a motion made by Scott Karpinski, and seconded by Raymond Vivenzio, the Board voted to approve the
applicants request for a variance and zoning relief as follows;
1. The Board found that granting of the variance would.not create a substantial detriment to the area nor cause the
intent and purpose of the by-law to be rendered moot.
The motion passed as follows: The following members voted in favor of the approval to grant:, Scott Karpinski
William J. Sullivan, Raymond Vivenzio, Robert Ford. One member voted against the motion to deny Walter F.
Soule,. The motion to approve passed four members to one.

Please be advised that petition number 038-98 for Eric & Lisa Dahl, for property located at 65 Weyland
Circle, (lot #16), currently on the Zoning Board of Appeals agenda, is of concern for the following reason.
At issue is a zoning violation for rear setback, as currently built, that is between the property owner,
builder and the developer. The requirement is a 50 foot buffer restriction and this buffer zone is being
violated by 8 feet. The petitioner is requesting a variance. The Zoning Board of Appeals consensus ----
"�this is the builder's responsibility".
It is my understanding that a bond is still outstanding for the development "Foxwood", and if so the
Zoning Board of Appeals, request that you hold that bond on the development until the Zoning Board of
Appeals agenda item has been resolved by the Zoning Board of Appeals, or Planning Board under their
jurisdiction.
Would you please furnish, from your records, the name and address of the developer and building
contractor for Lot #16 in the "Foxwood" site (65 Weyland Circle).
The petition is continued until November 10, 1998. We will inform you of the Zoning Board of Appeals
decision and information on the resolution of this issue. Please advise the Zoning Board of Appeals of the
Planning Board's action.

Kathleen,
At last night's Zoning Board of Appeals meeting (12/8/98) the petition of Eric & Lisa Dahl was heard by
the Board. After much time and consideration was given to the seriousness of the nature of the building
error, which involves Merrimack Engineering, and the builder of Foxwood Realty, the Board voted to
allow the petitioner to continue until next month's meeting (1/12/99). At this time the Board stated that.
this matter must be cleared up between Mr. Dahl and the builder, and that a solution must be made to
remedy this problem by the builder and/or his representative Tom Hurley,
The violation is 8' into the buffer zone and also approximately 1 foot from the front setback. The
developer and his attorney agreed that this was a builder's error and are working for a solution which has
been promised by the January 12, 1999 ZBA meeting,
I would like to ask that you continue to hold the bond at least until this January of 1999, by that time we
hope to have brought this situation to a close. We will notify you of the results of our January 12I'
meeting,
