Dear Mr. Reed:
At the September 24, 2003 Conservation Commission pubic meeting,the Commission voted to
issue a Negative Determination of Applicability for the construction of two decks. Special
conditions voted upon by the Commission included the installation of wetland markers along
the 25' No-Disturbance Zone around the perimeter of the property. Markers are available for
sale at the Conservation Department for$2.00 each. I recommend you purchase approximately
15 markers and space them evenly 25 feet apart. The markers are permanent and should be
installed on either trees, fences, or wooden posts.

Wetlands Protection Act and regulations:

Note: No work within the jurisdiction of the Wetlands Protection Act may proceed until a final Order of
Conditions (issued following submittal of a Notice of Intent or Abbreviated Notice of Intent) has been
received from the issuing authority (i.e., Conservation,Commission or the Department of
Environmental Protection).

Removing, filling, dredging, or altering of the area requires the filing of a Notice of Intent.
❑ 2a. The boundary delineations of the following resource areas described on the referenced
plan(s) are confirmed as accurate. Therefore, the resource area boundaries confirmed in this
Determination are binding as to all decisions rendered pursuant to the Wetlands Protection Act and its
regulations regarding such boundaries for as long as this Determination is valid.

must consider the following alternatives. (Refer to the wetland regulations at 10.58(4)c. for more
information about the scope of alternatives requirements):
❑ Alternatives limited to the lot on which the project is located.
❑ Alternatives limited to the lot on which the project is located, the subdivided lots, and any
adjacent lots formerly or presently owned by the same owner.
❑ Alternatives limited to the original parcel on which the project is located, the subdivided
parcels, any adjacent parcels, and any other land which can reasonably be obtained within
the municipality.
❑ Alternativesextend to any sites which can reasonably be obtained within the appropriate
region of the state.
Negative Determination
Note: No further action under the Wetlands Protection Act is required by the applicant. However, if the
Department is requested to issue a Superseding Determination of Applicability,work may not proceed
on this project unless the Department fails to act on such request within 35 days of the date the
request is post-marked for certified mail or hand delivered to the Department. Work may then proceed
at the owner's risk only upon notice to the Department and to the Conservation Commission.
Requirements for requests for Superseding Determinations are listed at the end of this document.
❑ 1 The area described in the Request is not an area subject to protection under the Act or the
Buffer Zone.
❑ 2. The work described in the Request is within an area subject to protection under the Act, but wil
not remove, fill, dredge, or alter that area. Therefore,said work does not require the filing of a
Notice of Intent.
® 3. The work described in the Request is within the Buffer Zone, as defined in the regulations, but
will not alter an Area subject to protection under the Act. Therefore, said work does not require
the filing of a Notice of Intent, subject-to the following conditions(if any).

D. Appeals
The applicant, owner, any person aggrieved by this Determination, any owner of land abutting the land
upon which the proposed work is to be done, or any ten residents of the city or town in which such land is
located, are hereby notified of their right to request the appropriate Department of Environmental
Protection Regional Office (see Appendix A)to issue a Superseding Determination of Applicability. The
request must be made by certified mail or hand delivery to the Department, with the appropriate filing fee
and Fee Transmittal Form (see Appendix E: Request for Departmental Action Fee Transmittal Form) as
provided in 310 CMR 10.03(7)within ten business days from the date of issuance of this Determination. A
copy of the request shall at the same time be sent by certified mail or hand delivery to the Conservation
Commission and to the applicant if he/she is not the appellant. The request shall state clearly and
concisely the objections to the Determination which is being appealed. To the extent that the
Determination is based on a municipal ordinance or bylaw and not on the Massachusetts Wetlands
Protection Act or regulations, the Department of Environmental Protection has no appellate jurisdiction.

Violation.of the Massachusetts Wetland Protection Act(MGL c.131 s.40) and North Andover
Wetland Protection ByLaw (c.178 of the Code of North Andover).
Dear Mr. Reed:
This is a follow up letter to my inspection at and subsequent phone conversation of the above
referenced property,which was triggered by your request for a Certificate of Compliance,
received on July 9,2003.
Approved work under the above referenced Order of Conditions consisted of the construction
of a replacement septic system and associated grading only. However,upon inspection, the
following violation was observed. Two decks were constructed within the 100-foot buffer zone,
which is subject to protection under the Massachusetts Wetland Protection Act(the"Act")
M.G.L. c.130, s.40 and the North Andover Wetland Protection Bylaw(the`Bylaw")Section 178.
In addition,no building permit was issued from the building department for the work.
Upon discussion with the Administrator, Ms.Julie Parrino, an after the fact Request for
Determination of Applicability filing is required. To help expedite the process, I have notified
Ben Osgood,Jr., the engineer who had prepared your as-built plans, of the filing requirement.
You may however choose to have your application submitted by any other qualified engineer.
Specific wetland resource areas affected by construction activities include the following:
• 100-Foot Buffer Zone(NACC Bylaw Section I.C.)
ORDER:
Acting as an Agent of the Commission under MGL C.40,S.21D and the Act(310 CMR 10.08(3)),

Applicability filing for all unauthorized structures located within the 100-foot buffer zone. This
filing shall be conducted in accordance with the conditions described below.
The property owner shall immediately take the following actions:
1. Plans:

Existing Conditions Plan: The existing conditions plan shall include all information
required for a Request For Determination of Applicability filed with the NACC. This
plan shall include structures, facilities, storage area, etc., within 100-feet of the
delineated wetlands, as well as the location of the 100-foot buffer zone, 50-foot No-
Construction Zone and 25-foot No-Disturbance Zone.
2. Request For Determination of Applicability
A Request for Determination of Applicability filing under the Massachusetts Wetland
Protection Act and North Andover Wetland Protection Bylaw.
The Request for Determination of Applicability must be filed with the Conservation
Department no later than August 29,2003.
The violations as documented herein are subject to a $300 per day penalty, until such time as
the impacted resource areas have been mitigated. Each day or P g portion thereof during which
this violation continues shall constitute a separate offense. At this time the Conservation
Department has elected to waive a fine. However, we reserve the right to take additional
action in the future should this Enforcement Order not be complied with retroactive from the
date we were first made aware of the violations.
Failure to comply with this Order and the deadlines referenced herein will result in the
issuance of additional penalties. MGL C.131 S.40 and the North Andover Wetland Bylaw,
C.178 authorizes the Conservation Commission to seek injunctive relief and civil penalties per
day of violation. In addition, a violation of the Massachusetts Wetland Protection Act and the
North Andover Wetland Bylaw constitutes a criminal act, which is subject to prosecution and
the imposition of criminal fines, also per day. This Enforcement Order shall become effective
upon receipt.

The issuing authority hereby orders the following (check all that apply):
® The property owner, his agents, permittees, and all others shall immediately cease and desist
from the further activity affecting the Buffer Zone and/or wetland resource areas on this property.
® Wetland alterations resulting from said activity should be corrected and the site returned to its
original condition.
® Complete the attached Notice of Intent.The completed application and plans for all proposed
work as required by the Act and Regulations shall be filed with the Issuing Authority on or before
August 29, 2003

has been issued to regulate said work.

Failure to comply with this Order may constitute grounds for additional legal action. Massachusetts
General Laws Chapter 131, Section 40 provides: "Whoever violates any provision of this section (a)
shall be punished by a fine of not more than twenty-five thousand dollars or by imprisonment for not
more than two years, or both, succi fine and imprisonment; or(b)shall be subject to a civil penalty not
to exceed twenty-five thousand dollars for each violation". Each day or portion thereof of continuing
violation shall constitute a separate offense.
