Dear Mr. Burliss,
I write to inform you that the North Andover Board of Selectmen acting in their capacity as the Licensing
Commission for the Town of North Andover voted at their October 2, 2000 meeting to deny your application
for a change of premises from Winthrop Avenue North Andover, MA to Ace Hardware Center, Peters Street,
North Andover MA. The reasons for this denial areas follows:
Inadequacy of parking at the current location:
The Town's Building Department calculations shows that under current zoning regulations, there exists a
deficit in parking spaces in the shopping center where the licensed premises would be located of between
74 and 51 spaces. In addition, the owner of the shopping center recently allowed for the elimination of
several parking spaces further exasperating the problem.
Proximity to a church and schools:
The First United Methodist Church of North Andover is located within 500 feet of the proposed premises. In
addition, the church also operates a pre-school/day care center at this location. The Licensing Commission
made a determination that the existence of a full service liquor store that could sell on Sundays would be
detrimental to the spiritual and educational activities of the church.
Merrimack College is located across the street from the proposed premises. You provided no evidence that
a full service package store would not have a detrimental impact on school activities at the college.
Proximity to other retail selling alcohol establishments:
There is currently one full service package store and one beer and wine selling business within close
proximity of the proposed location. The Licensing Commission heard concerns from a store owner that the
location of another package store so close to his would have an impact on the viability of his business. The
Commission is also of the opinion that the public convenience would be better served having package stores
more geographically dispersed throughout the community.
You have a right to appeal this decision to the Massachusetts Alcoholic Beverage Control Board. Should
you wish to exercise this right you must do so within five(5)days of receipt of this decision.
