Town Office Building 67 Chestnut Street North Andover , Mass . 01845 Petition No . 58- ' 83 Dear Mr . Long : The Board of Appeals held a public hearing on Monday evening , September 19 , 1983 upon the application of Frank E . Elander , Jr. The hearing was advertised in the North Andover Citizen on September 1 and 8 , 1983 , and all abutters were notified by mail . The. following members were present and voting : Frank Serio Jr , Chairman; Alfred E . Frizelle , Esq . , Vice-Chairman ; Richard J . Trepanier , Esq . , Clerk ; and Associate 'Members Walter F . Soule and 14aurice S . Foulds . The petitioner seeks a variance from the provisions of. Section 7 , Paragraph 7 . 3 and Table 2 of the Zoning By Law so as to permit relief from the setback . requirement to allow the construction of an addition on premises located at .67 Chestnut Street . Counsel for the applicant testified that the dwelling was con- structed thirty years ago and the petitioner now wishes to add a family room which will not meet the setback requirements of the Zoning By Law . The proposed addition is 14 ' x 132' and is necessary as the result of a growing family . No opposition was heard at the public hearing . A motion was made , seconded , and passed unanimously to take the petition under advisement . On October 17 1983 , the Board rendered its decision , with Members Serio , Frizelle , Trepanier , and Associate Members Soule and Foulds again present and voting , ,AFLI T -a Frank E . Specifically , the Board finds that a literal enforce- ment of the provisions of the Zoning By Law would create a hard- ship to the petitioner . According to the present zoning regulations, the lot is iindPrGi7.Pd-, but comfortably large enough to accommodate the proposed family room. The variance requested is the result of the propcs ed addition being less than the required number of feet f Street, the addition will be built on the side of the house facing Hewitt Avenue and the end of thea av Hewitt Avenue. The addition will be designed to blend in style with the rest of our home. At the present time we are not in an economic position to purc ase a larger family"room' of which we have a present need because our daughter is growing older. Because the house is over 30 years old, it is significantly smallb-r than those being ui today and we also feel if we were to sell the house at a future date we would not be able to get a fair market value because of its present state and size.
