Mr. Adams was refused permission to operate a retail bakery
at 1591 Osgood Street. Such use, however, is allowed by a sp6cial
permit issued by your Board.
Petition ##27 - Douglas R. Moulton:
Mr. Moulton was referred to your Board for the necessary'
special permit to allow a family suite on his property located at
864 Winter Street..
Petition #28 = Joseph Giacalone:
Mr. Giacalone was referred to your Board for the necessary
special permit to allow a family suite on his property located at
125 Sullivan Street.
Petition ##29 = James Fitzgerald:
It was discovered that the dwelling located at 44 Sylvan.
Terrace was too .close to the sideline and Mr. Fitzgerald is applying
to your Board for relief.
Petition #30 - Jefferson Office Park:
Jefferson Office Park was refused a building permit because
the barn that they plan to convert to business use did not meet the
required setbacks for an industrial zone.
Petition #31 = James Hetherington:
Mr. Hetherington was refused a building perm:'-t because his.
proposed addition did not meet the required setbacks.
Petition #32 = Andrew Varrichione:
Mr.. Varrichione was refused a building permi- because his
proposed addition did not meet the required setbacks.

Re: Jefferson Trust - Variance Application
Dear Mr. Serio:
It is our understanding that Jefferson Trust has applied for a 'front setback
zoning variance' to allow their barn to be converted to serve as a restaurant under
Section 4. 129 (3).
It has been the Town's position that 'use' variances are not permitted unless
otherwise specified. The Planning Board views this petition as not only a request for
a setback variance, but a use variance as well.
The Planning Board would recommend that the Board of Appeals deny the request
on the basis that use variances under Section 4.129(3) are not permitted in the 1-1
Zoning District.
We appreciate you giving us the opportunity to comment on this proposal.

The principle points T base my application on are as follows:
There currently exists a barn which was erected. at a time which
conformed to zoning. This applicant wishes to convert the
existing barn into a restaurant to serve local businesses and the
general public as allowed under Section 4.129, Paragraph 3. The
building inspector has determined that the proposed restaurant is
a change in use and does not meet the setback requirements for an
industrial T district. The building inspector is reluctant to
issue a building permit without a decision from the Board of
Appeals. We believe that the change in use will not be
detremental to the neighborhood but will enhance the area
asthetically and economically.
